Mr. Akins, chairman of the Highway Gommittee, submitted orally the
follm%rin report respecting the addition to the Town Storehouse:
(1 The roof Installation is complete and acceptable, _.
(2) The electrical installations are 75% complete.
(3) Oil pit installation,, 85Y. complete.
(4) Heating, doors , and floor installation have not been
started.
The majority of equipment is under cover and is being painted, and the
grounds have been cleaned up.
Mr. Akins also reported as a result of the meeting the T(n%zn Board had
on Zoning that he had a meeting, i�rith George B.. Robinson, Director of
the Bureau of Planning, and George Haynes , both of the Department of
Commerce,, and, as a result of this meeting, Mr. Robinson- requested that
the Town Board and members =of` thet Zoning Commi-ssion meet with them
• as soon as possible. Points to be discussed at this meeting wduld
include their recommendations for additional residential classification
and agricultural area.
Mr. Akins suggested that a date be set for such meeting.
Mr. Bentley stated that he saw no reason to hold such meeting for
numerous reasons..
A discussion was had between the members of this Board respecting this
matter and no further action was taken..
Mr. Bentley moved, T,971hich was seconded by Mr. Lampson, that the Zoning
Ordinance duly presented to the Board by the Zoning Commission, be
and the same is hereby adopted. A discussion was had respecting the
foregoing motion. Mr. Miller moved that the motion of Mr. Bentley be
laid on the table. A discussion was had respecting a point of.order.
Mr. Bentley requested that the question on his motion be called. The
chairman overruled the point of order of Mr. Bentley. Mr. Bentley
moved that the motion of Mr. Miller be laid on the table.:
The Chairman at this point sent for a copy of "Robert's Rules af Par-
liamentary Procedure", and after examining the-same and considering
the matter, Mr. Harris ruled that the motion of Mr. Miller be .ay .the
motion of Mr. Bentley respecting the adoption of 'the Zoning Ord, nance
on the table, was out of order. ..
Mr. Miller (which was seconded by Mr. Akins) , appealed from the order
of the chairman respecting the ruling on his point of order.
The chairman called for a vote of Ayes and Nays.
The chairman thereupon ruled that the appeal from his ruling made by
Mr. Miller was lost.. <
Thereupon: the chairman requested a vote on the motion of Mr. Bentley

AUTHORIZING THE ISSUANCE AND SALE OF
SERIAL.BONDS OF THE TOWN OF. QUEENSBURY,
WARREN COUNTY, NEW YORK, IN THE AMOUNT
OF $80452.00 FOR THE PURCHASE OF AN
INTERNATIONAL TRUCK AND SNOW PLOW.
BE IT RESOLVED,, this 25th day of October, 1958, by the Town Board
of the Town of Queensbury, Warren County, New York, as follows:.
Section 1. The purchase of an International truck and Frink snow
plow is hereby authorized and for the - object or purpose of providing funds
to defray the cost thereof', $8,452.00 of general obligation serial bonds
of the Town of Queensbury, Warren County, New York, to be of the terms,
form and contents hereinafter provided for, shall be issued pursuant to
the provisions of the Local Finance Law of the State of New York.
Section 2. The sum of $9,870.00 is estimated as the maximum cost
of the object or purpose for which such serial bonds are to be issued, to
wit: the purchase of an International truck and Frink snow plow.
Section 3. The plan for the financing of such object or purpose,
to wit: the purchase of an International truck and Frink snow plow,
consists of the issuance of the serial bonds of the said Town of Queensbury

in the principal sum of $5,,452,,00, thereby providing a portion of the
maximum estimated cost of such object or purpose ,* and the balance of
$1,418.00 from the trade in -of a used truck.

Section 4. It is hereby determined that the object or purpose
for which such serial bonds are to be issued fall within *sub-par'agraph
11 of Sub-division (a) of Section 11:00 of the Local Finance Law and
that the period of probable usefulness of such object -or purpose is
five years.
Section 5. That the proposed maturity of the serial bonds hereby
authorized will not be in excess of five years*
Section 6. The said $8,452.00 in. serial bonds shall be numbered
1 to 3 ,inclusive , and shall .be of the following denominations and matur-
ities , to wit: Bond No. I shall be of the denomination of $2,852.00
and shall, mature_ on April 25, 1959, and the bonds numbered 2 and Z shall
be of the denomination of $2,800,00 and shall mature annually on April
25 in each of the years 1.960 and 1961, shall bear interest at a rate
not exceeding three per cent per annum., payable annually on the, 25th
of April in each year. That said bonds shall be signed in the name of
the Town of' Queensbury, by the Supervisor, sealed with the corporate
seal of said town and shall be attested by the Town Clerk,, and both the
principal of and interest on said. bonds shall be payable in lawful money
of the United States of America at the office of the Town Clerk in the

Section 7. The said serial bonds shall be issued in substantially

the sum of' Two Thousand Eight Hundred Fifty-Two Dollars and to pay
interest on said sum at the rate of three per centum, (3%) per anrum,

tion of the payment of such interest thereon, or, if thiA bond be regis-
tered , to the registered holder. Both principal of an interest on this

Section 8. *The Supervisor is hereby authorized and directed to
sell such bonds at private sale at a price of not less than par value

shall be delivered to the purchaser upon the payment by him of the pur-
chase price in cash to the Supervisor and the receipt of the Supervisor

The Clerk reported that there had been received a statement of the price
of the forms for New York State Lottery Control Commission, which was
received and placed on file.
The Supervisor presented (which were filed) the following contracts
with the Town of Queensbury in connection with the new addition to the
storehouse:
This AGREEMENT made this 1st' day of October, 1958, between the

State of New York, party of the first part, and LEROY A. PHILLIPS, of
the Town of Queensbury, County of Warren and State of New` York, party
of the second` part,,
WITNESSETH, THAT
WHEREAS,, the party of the first part is constructih& a new highway
storage building and the Town Beard has advertised ror sealed bids and
the party of the second part mad the low bidder for the electrical work,
Now,, Therefore , it is agreed between the parties as follows:
1. The party of the second part agrees to furnish' a.11 materials
and to perform all labor required to install the electrical wiring and
fixtures in the new town highway storage building' on Aviation Road
according to the plans and specifications prepared by the Town Board for
the sum of $1815.00.
2.. The party of the first part agrees to pay one-half of said
contract price when the conduits and entrance have been installed and the
balance when the work is completed according to such specifications and

has been inspected and approved by the underwriters inspection service
and proof of such inspection and approval has. been filed with the Town
Board. In view of the fact that no bond is required of the party of
the second part, the party of the first part reserves the right before
making the final payment to require from the party of the second part
that all laborers and materialmen have been paid in full or, in lieu of
such proof, releases executed by all persons performing labor and furn-
ishing materials in the performance of this contract by the party of the
second part.
3. The party, of the second: part agrees to procure and ieep in
force at his own expense full workmen's compensation coverage on all
persons employed by him. in the performance of this contract and to pay
such employees at an hourly wage rate established by the State Department
of Labor.
4. The party of the second part agrees to commence such work within
ten: days after notice by the Town Board and to complete such work within
a reasonable time and to perform such work in a good workmanlike manner,
and to clean up and remove all tools ,, equipment, materials and debris
from his work upon the completion thereof.

storage building and the Town Board has advertised for sealed bids for
the heating work and the party of the second part was the low bidder,
Now, Therefore , it is agreed between the parties as follows :
1. The party of the second part agrees to furnish all material and
perform all labor required to install four Reznor gas-fired heating units
complete with connecting pipe installed at curb, together with electrical
wiring on units and ready for operation according to the terms of the
proposal submitted by the party of the second part and accepted by the
Town Board , which proposal is hereby incorporated by reference into this
contract to the same extent as though the same were fully set forth herein
in the specifications of materials and labor, for the sum of $2,435.00.
2. The party of the first part agrees to pay to the party of the
second part the said sum of. $2,435.00 upon completion of the installation
of the heating units and connection according to specifications and upon
inspection and testing of said operation by the Town Board.
3. The party of the second part agrees to procure at its own expense
and keep in force during the performance of the work full workmen',s com-
pensation coverage on all employees engaged in the performance of. the work
and to pay all such employees at an hourly wage rate at least equal to the
rate established by the State Department of Labor for such work.
4. The party of the second part agrees. to commence such work within
ten days after notice: by the party of the first part and to complete the
same within a reasonable time.

town highway storage building on Aviation Road according to the terms

forth herein in the specifications of materials and labor,, for the
sum of $1,254.00 plus an additional payment of $75.00 for a twenty
year guarantee bonds making a total contract price of $1,329.00.

the second part the said sum of $1s,329.00 upon completion of the roof
according to specifications and upon inspection and approval by the
Town Board and upon the delivery to the Town Board of said twenty year
guaranty bond.
