Resolved that pursuant to Section 130 of the Town Law of the
State of New YArk,, a. Public Hearing, to control and or prohibit the
dumping 'of Garbarge. on public and private property in the manner
provided for in the proposed `Ordinance to be held- on 30day of November
1953 at 7x30 P.M. at the Town. Clerk's office, Ridge Road, Town of
Queensbury, Marren County, New York-and be it, ,
Further resolved that the Town Clerk be and is hereby
authori'zed.and directed to cause to be-publish once in the Glens Falls
Times, a newspaper circulating in the Town of Queensbury, a Notice to

Legal Notice is hereby given that pursuant to Sectiott,X30 ,
the Town Law of the State of New York, and pursuant to a resolution of Q
' the Town Board of the Town of Queensbury adopted November 17th, 19539
the said Town Board till hold a Public Hearing at the Office of the Town
Clerk, Ridge Road, Town of Queensbury, Warren County,, New York on the
30th day of November 1953 at 7:30 O'Clock P.M. _Eastern. Standard Time

' The term "rubbish" as used in this ordinance shall include waste
metal, tin cans ,..,ashes , cinders , wood,, glass , pottery and all discarded
{{ substances of a solid nature.
I The term "garbage" as used in this ordinance shall include waste
food,. fruit, vegetables , -meat, dead animals , birds or fish or parts
thereof,; or any kind of waste material capable of fermentation or decay.
Section 2. Site. The premises owned by the Town of
I Queensbury situated on th easterly side of the. F.idge Road and northerly
of the premises now or formerly known as *Branch- 's Store and southerly
of the Farm to Market Road are hereby designated-as -the dumping
ground for the Town of .Queensbury by residents of the town,- subject
to the provisions of the ordinance . The provisions of this ordinance
shall also apply to any other lands hereafter acquired or leased by the
Town of Queensbury for the purpose VatE disposal of rubbish.
Section 3. General restrictions. No person shall dump,`
depositor leave rubbish in or upon any public highway, street or
place within the T(yn of Queensbury.
Section 4. Garbage disposal. No person shall dump, deposit,
place or leave garbage at the town dump here3nb,6.fore described or upon
any public highway, street or place within the Town of Que -�nsbu , nor
deposit or leave garbage open and uncovered upon dny lands¢, 6" or
private , within the Town of Cueensbury. A person may dispole of ga,r-
bage which is produced or accumulated as ai incident to an41n connec-
tion with the occupancy of premises situated 'in' the Toum 'af Queensbury
by burying the same upon such premises and covering the same _to a depth-
of at least four inches of soil. No person shall collect garbage
either within or without the Town of Queensbury and dispose of the same
in the Town of Queensbury unless such-.person shall have first obtain a
permit for such disposal from the' Town Board ofthe Town of. Queensbury
as hereinafter provided.

Section 5. Permit. The T&.qn Board shall have the power by
resolution hereafter adopted. by majority vote to permit any person to
establish and operate in the Tarn of Queensbury a dump for the disposal
of rubbish or garbage or to permit any person to enlarge an existing
aump,or to establish an incinerator or other equipment or app.pparatus
y; for the disposal of rubbish or garb'bge or both, or to establish a
garbage or sewage dispoail plant. Such permit shall be granted by
the Town Board only u on written application therefor by,-the owner
of the premises sougU to be used for such purpose, which application
shall. containsa definite description of the premises sought to be
used for such purpose, the material to be d$sposed of on such
premises , the method of such disposal and any pertinent faots relating
to the premises and the permit for which such applicat on is made.
The Town Board may impose conditions in the granting of the permit to
protect the -bublic interest, health and welfare and may refuse to grant
a permit in any case where it is deemed that the proposed use shall
endanger the public interest, health or welfare. Any such permit shall
expire on the 31st day of December of the year in which it bras granted
but may be renewed from year to year and shall expire on-�tY e 31st day
of December of each of such years. The fee for such permit shall be
the-sum of #10.00 for each year or portion theref and such fee shall
` be paid to the Supervisbr before such permit or reneiil lifireof shall
be valid. 1
Section 6. ' Penalities. Every violation of any nf"- the prov-
isions of the` ordinance shall be a-mis demeanor and upon., conviction
therof, such person shall be subject to a fine of not mo >'than
100.00 or imprisonment for a period of not more than three months
or both. Every violation of any provision or condition of any
permit issued and granted by the Town Board of the Town of Queensbury
to any person pursuant to this ordinance as hereinbefore provided
shall be deemed to be a violation of this ordinance and shall be a
misdemeanor and be punishable as herein provided , upon conviction of
such violation, the Town Board shall have the power by resolution to
revoke, any such permit. The Town Board shall also have the power to
enforce this ordinance by civil action for injunction,

i Section 7. The Judgment of any court of competent jurisdiction
that auy portion of this ordinance is invalid shall not invalidate
the whole ordinance but on.l-,T that part thereof declared to be
invalid and the remainder of this ordinance shall remain in full
force and effect.
Section 8. This ordinance shall take effect ten days after
its publication and posting as provided by the Town Law.

of the highway law,, of Ernest B. Lackey, Superintendent of highways,
was read. Such report showed that- there was 114 miles of road. The
report was-placed on file.
