An ordinance regulating dumps , dumping and garbage disposal in the town of Queensbury. ' BE IT RESOLVED AIM ORDAINED by the Town Board of the Town of Qu.eensbu.ry, ...Warren. County •New York, as follows : r 14 I Section 1. Definitions . The term "persony as used in this ordinance shall include an indiviglual., society,. club ,_:C�m, partnership, co- rporation, municipality or association' of persons , and'the singular number shall include the plural number. The term "rubbish" as used in this ordinance shall include waste j metal„ tin" cans , ashes , cinders , wood, glass , pottery and all dis- carded substances of a solid nature . " I The term"garbage's as used in this ordinance shall include waste fooaL . fruit, vegetables , meat, dead animals, birds or fish or parts thereof, or any kind of waste material capable of fermentation or decay Section 2. Site . The premises oz�med by the Toun. of Queensbury sit-- uat9d on the easterly side of the Ridge Road and northerly of the premises now or formerly known as Branch_!s store and southerly of the Farm to Market Road are hereby designated as the dumping ground for the Town .of Queensbury by residents of the tovml subject to the pro- ' visions of' this ordinance. The provisions' of this ordinance shall also apply to any other lands hereafter acquired or leased by -the Town of Qu.eensbury for the purpose of disposal of rubbish. " Section 3. General restrictions . No person shall dump, deposit or leave rubbish in or upon any public highway, street or place within the Town of Queensbury. Section 4. Garbage disposal . No person shall dump, deposit.,, place or heave garbage at the town dufnp hereinbefore described or upon any public highway, . street or place within the Town of Queens�ury., nor deposit or leave garbage open and uncovered,upon any lands., public or private.within the Town of Queensbury. A, person may dispose of garbage which is produced or accumulated as an incident to and-in conpect.ion, with the occupahcy of premises situated-"in they.Town 'of Queensbur-r by burying the same upon such premises and-' overin� the same to a depth of at least four inches of soil. Nb person shall collect garbage either within or without the Town of Queensbury and dispose of the same in the Town of Queensbury unless such per-- � } son shall have first obtained a. permit for such disposal. from the 1 Town Board of the Town of Queensbury as hereinafter provided. Section 5. Permit. The Town Board shall have the power by reso- lution hereafter adopted by majority vote to permit any person to establish and operate in the Town of Queensbury a dump for the dis- posal of rubbish or garbage or to permit any person to enlarge an existing dump or to establish an incinerator or &them` equipment or apparatus for the disposal of rubbish or garbage orb th, or to . establish a garbage or sewage disposal plant. Such pe " sYiall be granted by the Town Board only upon written applicatitin therefor by the owner of the premises sought to be used for such, purpose, which application shall contain a definite deseripticin of- the premises sought to be used for such purpose, kwhich application s all con - tain a definite description of the p emises sought tc ` ' used for such purpose, the material to be disposed of on such.`�pra ses, The method of such disposal and any 'pertinent facts I r6lat ng� -to the. premis- es and the ,permit for which such application is m ade. e ;Town Board may impose conditions in the granting -of" he pert � t� t` the public interest, health and welfare and may refuse permit in any case where it is deemed that the prop6s6 .. i e' shall endanger the public interest, health or welfare., Any u h permit shall. expire on the 31st day of December of' the year in - h h it was granted but may be renewed from year to* year and shall expire on the 31st day of December of each of such years. The t 6for such permit shall be the -sum of $10.00 for each year or portibn thereof and such fee shall be paid to the Supervisor before such permit or renewal thereof shall be valid. w � 1~49 Section 6. Penalties . Every violation of any of the provisions of 1 thig ordinance shall be a misdemeanor and upon. conviction thereof,. such person shall be subject to a fine of not more than $100.00 or imprisonment for a period of not more than three months or both. Every violation of any provision or condition of any permit issued and granted by the Town-Board of the Town of Queensbury to any person pursuant to this ordinance as hereinbefore provided shall be deemed to be a violation of this ordinance and shall be a misdemeanor and be pu.nishible as herein provided, and in addition upon conviction of such violation,; the Town Board shall have the power by resolution to revoke any such permit. The Town Board shall also have the po`.,rer to 1 enforce this 'ordinance by civil action for injunction. Section 7.. The judgement of any court of competent jurisdiction that any portion of this ordinance is invalid shall not invalidate the whole ordinance but only that part thereof declared to be invalid and the remainder of this ordinance 'shall remain in full force and effect. Section 8. This ordinance shall take effect ten days after its publication and, posting as provided by the Town Law., Duly adopted by the followir..g vote - Ayes - Mr. Walkup, Mr. Bentley , Nor.
