Russell Harris Supervisor Henry Sleight Justice of the Peace Meredith Bentley Justice of the Peace Curtis Lam pson Councilman Raymond Walkup Councilman The board convened at 7:30 P.M. The board generally discussed with Mr. Beecher the repairs to the road grader and allowance, etc. towards 4cquisition of new equipment. The privilege of the floor was extended to Mr. Dennis Cronin who spoke brie fly and in favor or Miss Rose Bibby being continued as a Democrat- iclaspector of elections in Dist. No. 3. Mr. Charles Jeckel, chairman, Erwin Martin, Louis CoLrlew, Herbert Ells- worth, representing the Queensbury Association, and idney Van Dusen, all members of an unofficial planning committee of the Town of Queens- bury, were present .and generally discussed with the members of the Town Board a proposed general plan of zoning and building code. Various members of the committee and of the board discussed the prop- osition and expressed their views unofficially. Seward Thomson and John Hurley were present in reference *to the pro- posed drainage- of the Glendale"development and the board generally dis- cussed with Mr. Thomson and Mr. Hurley the overall picture, and it was agreed members of the board would meet the following Friday night to examine the area, In the matter of the ,proposed contract with Ernest L.H. Meyer, the following Resolution was proposed: Resolution No. 55 introduced by Justice Sleight, seconded by Councilman Sampson: Resolved that the Supervisor be and is hereby authorized and di- rected to sign a contract on behalf of the Town with Ernest L.H. Meyer in the following form: j THIS AGREEMENT made this lst day of August, 1952, between the TOWN BOARD OF THE TOWN OF QUEENSBURY, ,Warren County, N.Y. , party of the first part, and ERNEST L.H. MEYER, of 38 Lincoln Avenue, Glens Falls, N.Y,, party of the second part, WITNESSETH, that WHEREAS, the party of the first part, the governing body of the Town of Queensbury, desires to make an investigation, survey and study to, determine whether it is feasible to acquire a source of supply and to set up a water supply and distribution system to serve the souther- ly portion of the said town, and desires to engage a competent engin- eer to make such investigation, survey and study and to report thereon, and I WHEREAS, the party of the second part is a duly licensed engineer in the State of New York and has been for many years Superintendent of the Water Department of the City of Glens Falls,: and has had consider- able experience in the planning, laying out and operation of municipal water systens, { NOW,, THEREEORE, in consideration of the sums of money hereinafter provided to be paid, and other valuable considerations, the parties do mutually covenant and agree as follows: 1. The party of the first part agrees to hire and does hereby i hire and retain the party of the second part to make an investigation I 462 Y and study of the availability of a source or sources aced of wale supply , adequate to serve the existing needs and anticipated expansion of needs in an area of approximately 25 square miles adjacent to the City of Glens Falls and extending from the Hudson River on the south to the Country Club Road on the north and from the Town Line on the west to the West Mountonsnandast dies the andsto and makethise, written report of his investiga recommenda- tions thereon. 2. The party of the second part hereby accepts such employment and retainer and agrees to furnish all services necessary to make an adequate investigation and study of the- available sources of water supply in the aforesaid area and to make a complete and comprehensive report and submit his recommendations. 3. The fee and compensation to b6 paid to the party of the second part shall not be less than $800.00 nor more than $19000.00 and the party of the" second part agrees to render and perform all of the professional services herein provided to be rendered and performed for such amount. It is contemplated that it will require about one year to complete such investigation -and study and payment shall be made approximately quarterly from the date of the commencement f such work ornkd and progress reports shall be made by the party of re aired. filed with the Town Board at the time such payments q 4. In addition to the payment of the aforesaid fee, the party of the first part Shall pay for all labor and materials necessary to con- struct measuring weir s on any stream sources for accurately measuring the flow thereof. As such weirs are required by the party of the second part, he shall submit to the- party of the first part an estimate of the cost thereof and the same shall be authorized and approved by res- olution of the Town Board before the party of the second part shall proceed with all such construction of todtherTowndBoard vouchers for a P for audit prior to payment. 5. All reports, findings, data, information and recommendation: submitted by the party of the second part shall be the property of the Town of Queensbury regardless of whether the construction of a water — system is authorized by the Town Board following the completion of such study. IN WITNESS WHEREOF, the pasty of the first part has caused the agreement' to be executed by the Supervisor and the party of the second part has hereunto set his hand and seal on, the day and the year first above written.
