October, 1952, at 7:30 P.M. at the Clerk's office for the presentation of
estimates and consideration thereof, and adoption of preliminary budget
unless the matter is, deferred to another meeting and such other busi -
ness as may come before the meeting at such time„

Gentlemen:
I have been -requested to write you in reference to notice dated
September 12, 19529 signed by D. Frank Sullivan, Chairman -of the Warren
County Democratic Committee, requesting that Bessie Brand, Inspector of
Election District No. 2-, Rose Bibby, Inspector of Election of District
No. 3 and Evelyn Grant, Inspector of Election of District No. 5 be re-
moved, .
I have examined this notice and it is my opinion that the same
complies with the statute. I have also examined Section 45 of the Election
Law which in part provides as follows:.

. It shall be the duty of the Board making
the appointment of an election officer, to remove
forthwith such officer, without preferring any
charges. and without notice to such officer, upon the
written request of the official of the political
T party who certified the name of such election officer, --
or his successor. All such vacancies so created shall
- be filed in the same manner as the original appointment
was made.- , N

This section is very plain and it is your duty as the town board
to forthwith remove the three inspectors referred to in the notice signed
by the Chairman of the Democratic County Committee..
It is my opinion that there is no discretion on the part of the town
board in this matter, and that you should pass a resolution removing
these three inspectors without delay,, and if this is not done, no doubt,
there will be a proceeding instituted against the town board.
I enclose herewith a proposed resolution which I believe complies
with the law and you may adopt this resolution or prepare your own reso-
lution.

Also, it is your duty to fill the Vacancies created by the removal
of the three inspectors from the list filed with you on June 20th, 1952.

Mr. Bentley offered the following resolution, seconded by Mr. Sleight:

WHEREAS, U. Frank Sullivan, Chairman of the Warren County Demo -
cratic Committee, has filed with the town board of the town of Queensbury
a demand for the removal of Bessie Branch, Inspector of Election of
District No. 2, Rose Bibby, Inspector of Election of District' No. 3, and
Evelyn Grant, Inspector of Election of District No. 5, and
WHEREAS, Section 45 of the Election Law provides that it is the duty
of the town board to forthwith remove said inspectors*'

j RESOLVED, that pursuant to the provisions of Section 45 of the
Election Law, Bessie Branch, Rose Bibby and Evelyn Grant be and hereby
are removed from the office of inspector of election, and it is further
RESOLVED that the clerk forthwith serve upon said inspectors a copy
of this resolution.

mittee, has demanded the removal of certain Democratic inspectors of
election from each of the following election districts : Election Districts
No. 203 and 5; and t
WHEREAS it is the duty of this Board upon such demand to remove
forthwith such officers, without preferring any charges and without notice
to such officers under the provisions of Section 45 of the Election Law, and
WHEREAS under the provision of such section and pursuant to such
demand, the Town Board has removed such officers thereby creating a vacancy
in the office of one Democratic inspector of election in each of the follow-

Town Boa rd of Queensbury.
Gentlemen:
In the matter Of the determination of a water supply 'for the
southern area of the Town of Queensbury, I have made exam nation of 5
potential sources , namely: Clendon Brook, Halfway Brook, Pineview
Cemetery Brook,, the brook flowing past Sleight 's Mill and Rush Pond, The
latter four sources are tributary to the Halfway Brook on which the
Niagara-Mohawk Power Corp'n owns extensive water rights. 'The Clendon Brook source at the present time is owned by the City of Giens Fall1S1,
There remains yet the examination of the Bear Pond source.
The 5 examined would all necessitate Pumping while the Bear Pond
source, if sufficient, would probably be a gravity supply, something to
be desired if feasible of development.
I have chemical, and basteriological analyses of the Halfway Brook,
Pineview Cemetery Brook and Rush Pond waters. These indicate the most
acceptable water as being that from Rush Pond. Analyses of the other waters X:
will be forthcoming in the near future.
I have decided it to be advisable at this time to place measuring
weirs on the Clendon Brook, Pineview Cemetery Brook and possibly on the
outlet from Bear Pond. r would estimate the cost of these installations,
materials and labor, to be in the neighborhood of $300 and am asking
your approval of such an expenditure at this time, .

The privilege of the floor was extended to Mr. Ralph Bean- who- was
present and discussed with the Board the boundary line between the Town
of Fort Ann in Washington County and the Town of Queensbury in Warren ,
County with a view of ascertaining to what extent, if any, his property
lies within the Town of Fort Am in the County of Washington,
