Questioned Lake Luzerne Attorney's comments in the newspaper. SUPERVISOR BORGOS-Noting the agreement was that the Town of Queensbury would except nothing less severe, restriction wise, than the Town of Lake Luzerne, ending up with a three part agreement, our attorney, their attorney and West Mountain attorney worked on all the components. Their attorney was here, for a portion of the discussions over a period of time. Now its up to the Lake Luzerne's Town Board to go through their side and see if they have any concerns. If there are any differences between what they will except and what we've excepted, it would then have to come back to this Board. A TTOR NF_ Y D USEK-That is correct. SUPERVISOR BORGOS-1 believe the Town Board for Lake Luzerne will be meeting on Wednesday. Ib1R. TUCKER-Questioned Lake Luzerne's request regarding the water for the Town of Lake L uzerne. SUPERVISOR BORGOS-The proposal that was presented to us for the first time the other night, was that water be provided to the residents in the Town of Lake Luzerne who are within the water district to be created as part of this project. The proposal was that they would get water for the same price as the residents in the Town of Queensbury. We explained that there is a number of components in tracing the water system, in Queensbury we will have to maintoin and operate the system and Luzerne will have to do the some thing. Our proposal was that we should agree to sell to the Town of Lake Luzerne in one master meter situation vnIuMeS of water at a rate which is comparable to what we charge our other municipal customers. MR. TUCKER-Regarding the trooper barracks, questioned the prevailing wage rate effected the increased cost of the building. SUPERVISOR BORGOS-The estimate from the firm that hired the architects that designed the building was in the range of $170,000.00 for the actual cost of the building. It was realized that there were four separate contracts and prevailing wage rates must be paid, that increased the price to somewhere in the range of $220,000 or so, for the building portion with all the components. COUNCILMAN MONTESI-One of the reasons for the increase in cost was that the lowest bidder was not able to make the performance bond. COUNCILMAN KUROSAKA-Understand that the people that gave the original construction estimate didn't use the prevailing rate. AIR. TUCKER-Requested a copy of the contract that the Town has with the County Board regarding the additional police coverage. Referred to the budget, the 221 thousand dollar surplus in the Highway fund, would like to know what that was. 56 SUPERVISOR BORGOS-The Highway operates in a separate fund from the general fund, any money that is unspent at the end of the year from any of the accounts in the Highway Department is put into the surplus fund in the Highway Department by itself which keeps growing each year. MR. TUCKER-Noted the darkness of Quaker Road. SUPERVISOR BORGOS-Agreed, I've spoke with Mr. Austin about getting street lights back up, I should have an answer momentarily. We've asked for delineator's but the ground froze too fast for delineators to be put in, as soon as possible they'll get them in. S 1, Introduced by the Entire Town Board. 6VHFREAS, the Town Board of the Town of Queensbury is aware that local home heating oil prices have increased approximately forty-percent (40%) since December 1, 1989, and WHEREAS, there have been no definitive answers available as to the reason for this dramatic increase, and WHEREAS, the Town Board of the Town of Queensbury is desirous of prompting an official investigation into this phenomena in order to obtain accurate information, and NOW, THEREFORE BE IT RESOL VED, that the Town Board of the Town of Queensbury hereby requests that the New York State Legislature and the Governor's Office conduct an investigation into the dramatic increase in home heating oil prices since December 1, 1989, and BE iT FURTHER RFSOL VED, that the Town Clerk shall distribute this resolution to Representative Robert O'Andrea, Senator Ronald Stafford, Congressman Gerald Solomon and Governor Mario Cuomo as a formal request for said investigation. WHEREAS, Mr. David Hatin, Director of Building & Codes Enforcement for the Town of Queensbury, has advised that he has investigated and inspected certain property identified as the Adirondack Baptist Church, Town of Queensbury, and bearing tax map no. 121-1-33 and has made findings as more specifically set forth in a memorandum, the original of which is presented to this meeting, and IVIIEREAS, Mr. David Hatin advises the Town Board of the Town of Queensbury that the carport attached to the structure is dangerous and unsafe to the general public and has asked the Town Board of the Town of Queensbury to provide for the demolition and removal of said carport, and WHEREAS, photographs have also been presented at this meeting, and [11HEREAS, pursuant to Local Law Number 3, 1983 the Town Board may, by resolution, determine whether, in its opinion, that the structures are unsafe and dangerous and thereafter order their repair or demolition and removal, and WHEREAS, said local Law Number 3, 1983 provides that notice be served upon the owner or other certain persons interested in said property, NOW, THEREFORE BE IT RE-SOLVED, that upon reviewing all of the evidence presented at this time, the Town Board of the Town of Queensbury is of the opinion that the structure thereon bearing tax map number 121-1-33 is: 1. presently unsafe and dangerous 2. and is unfit for the purposes for which it may be lawfully used, and BE IT FURTHER RFSOL. Road, on the north side of the road. They have a car port that was built approximately 2 years ago to the church. Noticed a hump in the roof when I first came on the this job, stopped to investigate it and found some structural problems with it. We contacted Rev. Lynn at that time and through a series of meetings tried to resolve the situation. We recommended some temporary measures to mitigate the circumstances which they did do eventually but to date they've had no formal corrections with the problem. I therefore requested, after meeting with the attorney, for Rist-Frost to do an engineering evaluation of the structure which you have in front of you and to go to public hearing. COUNCILMAN MONAHAN-Referring to the resolution, you want it demolished. Is there anyway that that could be strengthened? AIR. HA TIN-According to the engineer's evaluation, it cannot be corrected as is, it would have to be taken down and rebuilt. A T TOR NEY D USEK-Would like to clarify that a matter like this, the resolution would set a hearing not a public hearing, so that the property owners can be heard. RFV. ROBERT LYNN, Pastor of the Church-We submitted plans for that in 1987, we were granted a building permit, built the building, then were told it was built unsafely. We were asked by the Town to secure an engineer, we could not afford one so they found us one, Mr. Ray Buckley, we've been waiting for him to make a decision. fie feels it could be corrected tint torn down and we have a contractor lined up to do it as soon as Mr. Buckley gives us the P10175, which he told us he would handle and all other paper work. SUPERVISOR BORGOS-So you have no argument that the building needs to be corrected? RFV. LYNN-No. AIR. HA TIN-Noted that Rist-Frost engineers have done a complete evaluation of the structure and they differ with Mr. Buckley's opinion. The other problem we have here is that the structure was not built according to the original plans which they did receive approval for. SUPERVISOR BURGOS-Have the property owners seen a copy of the Rist-Frost Report? AIR. HA TIN-No, I don't believe so. SUPERVISOR BORGOS-(submitted copy to Rev. Lynn. Read into the record last page of report). 'The results of our structural analysis indicate that the carport structure is not capable of supporting the required design loads. The degree of overstress of the principal framing members and the inadequate resistance to uplift create a condition where failure is possible for loading conditions which are significantly less than the design loads analyzed. As noted previously, some temporary supports were provided which were not included in our structural analysis. We cannot address the adequacy of these structural analysis. We cannot address the adequacy of these structural supports at this time. However, no temporary measures were taken to provide additional resistance to uplift or to reduce the overstress in the roof ra f ters'. AT TOR NEY DUSEK--My recommendation to the Board that you hold the hearing and afford _ hoth parties the opportunity to bring in the respective engineers and hold a discussion. SUPERVISOR BORGOS-Recommended that the engineers meet with one another before the hearing. COUNCILMAN MONTESI-Recommended for safety reasons that the carport not be used, possibly rope off. 69 RFV. L YNN-Don't agree with the safety concerns but will agree to do that. COUNCILMAN KUROSAKA-I disagree with Rist-Frost's report .. it could be saved, but it does need to be fixed.
