Duly adopted this 25th day of August, 1997, by the following vote: AYES: Mrs. Monahan, Mr. Turner, Mrs. Goedert, Mr. Champagne NOES: None ABSENT: Mrs. Pulver QUEENSBURY BOARD OF HEALTH RESOLUTION TO SET PUBLIC HEARING ON APPLICATION FOR VARIANCES FROM SANITARY SEW AGE DISPOSAL ORDINANCE FOR RICHARD WILLETT BOARD OF HEALTH RESOLUTION NO. 23, 97 INTRODUCED BY: Mr. Theodore Turner WHO MOVED ITS ADOPTION SECONDED BY: Mrs. Connie Goedert WHEREAS, the Town Board of the Town of Queensbury is, by operation of Law, the Local Board of Health for the Town of Queensbury and, as such, is authorized under Chapter 136 of the Town of Queensbury On-Site Sewage Disposal Ordinance to issue variances from such Ordinance, and WHEREAS, Richard Willett has applied to the Local Board of Health of the Town of Queensbury for two variances from certain standards of the Town of Queensbury On-Site Sewage Disposal Ordinance set forth in Chapter 136, Appendix A, such application requesting that there be a one foot (1 ') distance between the septic tank and the property line in lieu of the required 10 feet (10') distance and an eighty feet (80') distance between the sewer line and the well in lieu of the required one-hundred feet (100') distance, NOW, THEREFORE, BE IT RESOLVED, that the Local Board of Health for the Town of Queensbury will hold a public hearing on September 15, 1997, at 7:00 p.m., at the Queensbury Activities Center, (reasonably accessible to persons with mobility impairment) 742 Bay Road, Town of Queensbury, Warren County, New York, to consider the application for variances of Richard Willett to allow a one foot (1 ') distance between the septic tank and the property line in lieu of the required ten (10') feet distance and an 80 feet (80') distance between the sewer line and the well in lieu of the required one-hundred feet (100') distance on property situated at 57 Palmer Drive, Town of Queensbury, New York, and bearing Tax Map No. Section 144, Block 1, Lots 24 and 25, and at that time all persons interested in the subject thereof will be heard, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury be and is hereby directed and authorized, when in receipt of a list of neighbors within 500 feet of the subject property, to publish and provide Notice of said Public Hearing as may be required by law, and authorized to mail copies of said Public Hearing Notice to the adjoining neighbors. Duly adopted this 25th day of August, 1997, by the following vote: AYES: Mrs. Goedert, Mrs. Monahan, Mr. Turner, Mr. Champagne NOES: None ABSENT: Mrs. Pulver REGULAR SESSION RESOLUTION TO SET PUBLIC HEARING ON PROPOSED CENTRAL QUEENSBURY QUAKER ROAD SEWER DISTRICT BENEFIT TAX ROLL RESOLUTION NO. 334, 97 INTRODUCED BY: Mrs. Connie Goedert WHO MOVED ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, the Town Board of the Town of Queensbury is presently considering the adoption of a proposed Central Queensbury Quaker Road Sewer District Benefit Tax Roll for 1998, and WHEREAS, it is necessary to hold a public hearing prior to adopting said proposed Benefit Tax Roll for 1998, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury shall hold a public hearing, at which time all parties in interest and citizens shall have an opportunity to be heard upon and in reference to the proposed Benefit Tax Roll for 1998, and BE IT FURTHER, RESOLVED, that said public hearing shall be held on September 15, 1997, at 7:00 p.m., at the Queensbury Activities Center, 742 Bay Road, Queensbury, Warren County, New York, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury is hereby authorized and directed to publish a Notice of Hearing in the official newspaper for the Town not less than ten (10) days prior to the date of the hearing, which Notice of Hearing shall be in a form substantially consistent with the Notice presented at this meeting. Duly adopted this 25th day of August, 1997, by the following vote: AYES : Mrs. Monahan, Mr. Turner, Mrs. Goedert, Mr. Champagne NOES : None ABSENT: Mrs. Pulver 2.0 ATTORNEY MATTERS - NONE 3.0 COMMITTEE REPORTS Councilman Goedert noted that she has an executive session matter in reference to negotiations with the umon. 4.0 PLANNED DISCUSSION ITEMS 4.01 Birdsall Road Town Counsel Schachner-Mr. Goralski and I reviewed some administrative history regarding Mr. Doherty's residence, or the residence he resides at on the weekends... there were variances granted for this residence including a variance for lack of frontage on a public road. The woman who owns the property, Ms. Fitz submitted an application with Mr. Doherty's assistance in which they said it's not a public road, it's a perfectly good private road and the access is great which we thought was interesting, but the bottom line is that the records do indicate this is a town road and Mr. Doherty's real interest and real concern is winter maintenance... I did talk with Paul before the workshop and I think Paul is of the opinion that we can plow the road... Town Board held brief discussion regarding improvements to the road, no decision made... will discuss further at a later date. 4.02 Mobile Home Park Fee Executive Director, Mr. Goralski -You asked me to get together with Henry regarding what mobile home park inspection... with an average of one hour per mobile home park, some a little more, some a little less, Henry did a cost analysis and came up with a cost per inspection per hour of fifty-six dollars and twelve cents. That doesn't include any administrative time that Darleen puts in... Councilman Monahan-A hundred dollars would probably cover everything... Town Board held discussion, agreed to the recommended one hundred dollar fee for each and to move forward in taking action to amend the ordinance. 4.03 Lake George Storm Water Regulations Executive Director, Mr. Goralski-There's two issues, one is the grant that the town received from the funds for Lake George and C. T. Male was hired to work with the Lake George Stormwater Committee to come up with a stormwater plan. The committee and C. T. Male have indicated responses to the original draft, they need one more meeting in order to go over those responses...as soon as the committee has that meeting, they'll be forwarding it to the Town Board for review. The other issue is the Lake George Park Commission amendments that they're proposing for their stormwater regulations and as part of their amendment, they're going to require all municipalities within the Lake George Park, or partially within the Lake George Park to either adopt stormwater regulations or the Lake George Park Commission will enforce their own regulations. If the municipality opts to adopt their own regulation, they must be at least as restrictive as the model ordinance that the park commission has drafted... Town Board held discussion, agreed to review the park commission's proposed regulations before making a decision on what action to take... Mr. Goralski noted that he'll get copies to the board members tomorrow and contact Mike White to see whether he'll be available to give a presentation. Discussion - Adult Entertainment Councilman Goedert noted that she has received numerous phone calls regarding video store on Aviation Road and the possibility of the sale of adult movies... requested Mr. Goralski check into it. Mr. Goralski agreed and also noted that the adult use moratorium expires in October and if the board is considering rolling that over to a local law, the board will have to take some action soon. 4.04 Penflex and Fire Companies Re: Service Award Program Annual Reporting Town Board held discussion, agreed to schedule something for October. 4.05 Pre Preliminary Budget Discussion - 98' Capital Projects Town Board held brief discussion... unaware of any capital projects planned at this time, other then the present ones being carried over... will continue discussion at budget time. 4.06 M. VanDyke's Conference Request Town Board held discussion and approved Marilyn VanDyke's conference request to Ithaca, New York. Discussion - Highway Meeting Mr. Paul Naylor, Highway Superintendent requested the supervisor to schedule a meeting with his Highway Committee and the Warren County Officials to discuss the snowplowing situation.
