Ordinance, and
WHEREAS, Peter Collins (Applicant) has applied to the Local Board of Health for variances from
Chapter 136 to install a replacement wastewater treatment system as follows:
1. Absorption bed to be 2' from the property line instead of the required 10' setback;
2. Absorption bed to be 70' from the shoreline instead of the required 100' setback; and

Connie Goedert, Superintendent of Cemeteries reviewed her department's proposed resolution,
`Resolution Authorizing PPI Cremation Unit Repairs and Rebuilding Capital Project And
Engagement of Matthews Environmental Solutions'. Referred to resolution and recommended a
correction in the resolution to remove `Crawford' in the third WHEREAS. Crawford is no
longer one of our operating machines, it's been removed from the facility. Town Board agreed
to recommended correction.

RESOLUTION AUTHORIZING HIRING OF MICHAEL CORLEW AS
FULL-TIME LABORER FOR TOWN HIGHWAY DEPARTMENT

WHEREAS, the Town of Queensbury's Highway Superintendent has advised the Town Board that
there is currently a vacancy in a full-time Laborer position in the Highway Department, and
WHEREAS, the Highway Superintendent posted availability for the position, reviewed resumes and
has made a hiring recommendation to the Town Board to hire Michael Corlew,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the hiring of Michael
Corlew as a full-time Laborer in the Town's Highway Department effective on or about March 5th,2019 subject
to Mr. Corlew's successful passing of a pre-employment physical as required by Town Policy and successful
completion of a twenty-six (26) week probationary period, and contingent upon the Town successfully
completing background checks as reasonably necessary to judge fitness for the duties for which hired and drug
and/or alcohol screening, and

RESOLVED, that Mr. Corlew shall be paid at the hourly rate of pay for the Laborer position as
delineated in the Town's current Agreement with the Civil Service Employees Association, and

WHEREAS, the Queensbury Town Board finds that public records are essential to the
administration of local government and can be retained either on paper or electronically, and
WHEREAS, the provisions of New York State Arts and Cultural Law Article 57-A and the MU-1
Records Retention and Disposition Schedule set forth requirements for the maintenance of local
government records and the minimum length of time that a municipality must retain its records, and
WHEREAS, in compliance with the provisions of State Law, the Town of Queensbury now
retains a very large number of paper records from its various Town departments, and
WHEREAS, the Town has the ability to reliably create and maintain electronic records and also
anticipates that in the future, all of its records will be converted to and maintained as electronic records,
and
WHEREAS, the Town Board wishes to accept and adopt electronic records as one of the Town's
form of recordkeeping for all Town records effective as of March 5, 2019, and
WHEREAS, the Town Clerk has the ability to deem any electronic record of the Town's as the
official copy,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts and adopts electronic records as
one of the Town of Queensbury's form of recordkeeping for both temporary and permanently retained
records effective March 5, 2019, and

from time to time by the Information Technology Department, and

Information Technology representatives to adopt policies and procedures consistent with this Resolution and

records are not rendered unusable because of changing technology, and

RESOLUTION AUTHORIZING PPI CREMATION UNIT REPAIRS AND
REBUILDING CAPITAL PROJECT AND ENGAGEMENT OF
MATTHEWS ENVIRONMENTAL SOLUTIONS

WHEREAS, the Town of Queensbury's Cemetery Superintendent and Town Cemetery Commission
have requested that the Town Board authorize certain necessary repairs and rebuilding of the PPII Cremation
Unit at the Pine View Cemetery(Capital Project)by Matthews Environmental Solutions(Matthews)as a single
source vendor, and
WHEREAS, the Cemetery Superintendent has advised that the projected cost of such Capital Project
is $53,233 consisting of $42,663 for repairs and rebuilding to be performed by Matthews as set forth in
Matthews'December 19,2018 Proposal presented at this meeting,plus an additional$10,570 to cover expenses
including but not limited to shipping materials($4,300),roof work($4,000),crane($1,300)and interior repairs
($1,000), and

WHEREAS, Matthews has performed annual Power Pak Cremator inspections, is accepted by the
New York State Department of Environmental Services as meeting statutory requirements regarding
inspections, and is the manufacturer of these Cremators, possessing proprietary engineering drawings and
specifications for such equipment,and for these reasons,the Town Board wishes to declare Matthews as a sole
source provider related to this proposed Capital Project, and
WHEREAS, this will ensure that the Town's retorts will continue to operate in a safe and efficient
manner while continuing to meet DEC's regulatory requirements, and
WHEREAS,the Town will adhere to all New York State Law bidding requirements, and
WHEREAS,the Town Board wishes to authorize such Capital Proj ect with funding to be from Capital
Reserve 964, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town Board is
authorized to withdraw and expend funds from Capital Reserve 964 subject to permissive referendum,
NOW, THEREFORE, BE IT
RESOLVED,that for the reasons outlined above,in these circumstances the Queensbury Town Board
hereby waives its requirement under the Town of Queensbury's Purchasing Policy for two (2)written quotes,
and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the repairs and rebuilding of the
PPII Cremation Unit at the Pine View Cemetery (Capital Project) and the engagement of Matthews
Environmental Solutions (Matthews)for the amount of$42,663 as set forth in Matthews' December 19,2018
Proposal substantially in the form presented at this meeting, and
BE IT FURTHER,
RESOLVED,that the Town Board further authorizes an additional$10,570 to cover such expenditures
including but not limited to shipping materials($4,300),roof work($4,000),crane($1,300)and interior repairs

RESOLVED,that the Town Board hereby finds that the withdrawal and expenditure for such Capital
Project is an expenditure for a specific capital project and/or certain maintenance project for which the Capital
Reserve Account 964 was established, and

RESOLVED, that the Town Board hereby authorizes the Town Budget Officer to take all actions
necessary to amend the Town Budget and effectuate the transfer from Capital Reserve Account 964 in the
amount of$53,233 as follows:

RESOLUTION AUTHORIZING HOME RULE REQUEST TO
STATE LEGISLATURE FOR BILL AMENDING TOWN LAW TO
AUTHORIZE TOWN BOARD TO DIMINISH AREA OF
GLEN LAKE AQUATIC PLANT GROWTH CONTROL DISTRICT

WHEREAS, the Queensbury Town Board duly established the Glen Lake Aquatic Plant Growth
Control District pursuant to New York State Town Law for the benefit of the property owners who border
or otherwise have access to Glen Lake, and
WHEREAS, the boundaries of the District were described by using tax map parcel identification
numbers, and
WHEREAS, it appears that five parcels situated within the District do not benefit from the
improved water quality resulting from the management of invasive species, and
WHEREAS, the Town Board does not have the authority pursuant to Town Law Section 202-c to
remove these parcels from the District on its own motion, and
WHEREAS, under Municipal Home Rule Law Section 40, the Town Supervisor with the
concurrence of the Town Board or the Town Board by a vote of 2/3 of its total voting power without the
approval of the Supervisor may request the State Legislature to pass a bill relating to the property, affairs
or government of the Town, and

WHEREAS, the Supervisor and the Town Board wish to request the State Legislature to adopt
special legislation so that the parcels of real property identified as not being benefitted by the District can
be removed from the District,
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF
QUEENSBURY, WARREN COUNTY,NEW YORK, AS FOLLOWS:
Section 1. The Town Supervisor, Town Clerk and/or the Town Board are hereby authorized and
directed to execute and submit a Home Rule Requests to the State Legislature substantially in the forms
attached hereto requesting the State Legislature to adopt special legislation identified as Senate Bill S.2024
and Assembly Bill A.4539 so that the parcels of real property identified as not being benefitted by the Glen
Lake Aquatic Plant Growth Control District can be removed from the District.
Section 2. Necessity exists for the enactment of the requested legislation because the Town Board
does not have the authority pursuant to Town Law Section 202-c to remove these parcels from the District
on its own motion.
Section 3. The Town Supervisor, Town Board, Town Assessor, Town Clerk and Town Counsel
are hereby authorized and directed to prepare and execute such other documents and take such other and
further actions as may be necessary or advisable in connection with submission of such Home Rule Request
to the State Legislature.
Section 4. This Resolution shall take effect immediately.

WHEREAS, the Queensbury Town Board duly established the Town of Queensbury Consolidated
Water District(the "District")in accordance with New York Town Law, and
WHEREAS, the Town Board wishes to improve the District's water transmission facilities by
replacing certain water main along Ridge Road between Quaker and Cronin Roads(Project), all in accordance
with Town Law §202-b, and
WHEREAS, the Town's Water Superintendent requested proposals for professional Design, Bidding
and Construction Phase Engineering Services(Services)related to the Project, and
WHEREAS, the Water Superintendent and Purchasing Agent have received and reviewed four (4)
proposals, with the lowest, most responsible submitted proposal submitted by The Chazen Companies
(Chazen),and therefore the Water Superintendent and Purchasing Agent have recommended that the Town
Board authorize engagement of Chazen for such Services in the amount of $118,800 as delineated in
Chazen's February 20, 2019 Proposal 9PM19-011 presented at this meeting, and
WHEREAS, the Water Superintendent has advised that there are times when Change
Orders may become necessary related to such Services and has requested that the Town Board also
authorize him to approve and sign certain Change Orders up to a 10% contingency for Change
Orders that he deems necessary or appropriate, and
WHEREAS, the Town Board accordingly wishes to establish a Capital Project Fund related to the
Project,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of The
Chazen Companies (Chazen) for professional Design, Bidding and Construction Phase Engineering
Services (Services)related to the Ridge Road Water Main Replacement Project(Project)for the amount of

RESOLVED, that the Town Board further authorizes and directs that funding for such Capital
Project shall be by using $130,680 of unappropriated, undesignated Fund Balance 040-0000-0909 and
transferring such balance to the Capital Project as follows:

RON BALL, Queensbury spoke to the Town Board regarding the damage that is happening to his
property from the runoff caused by Verizon's building of a cell tower five (5) years ago. The storm
water runoff continues to cause damage to my property and that the Town Board has done nothing to
rectify the situation.
SUPERVISOR STROUGH noted that in reference to the storm water runoff, we see very little
evidence of that. But to better accommodate him, we have the engineers designing an improved
retention area and drainage area and the Town Water Department will be working on those
improvements this spring.

COUNCILWOMAN SWITZER I do have one item I would like to announce. The Southern
Adirondack Realtors Association is sponsoring a presentation regarding the Transfer Law this
Friday, March 8t' at 2 p.m. at the Activity Center.
