WHEREAS, the Queensbury Town Board serves as the Town's Local Board of Health and
is authorized by Town Code Chapter 136 to issue variances from the Town's On-Site Sewage
Disposal Ordinance, and
WHEREAS, 10 Dunham's Bay Road, LLC (Applicant) has applied to the Local Board of
Health for variances from Chapter 136, §136-11 which requires that an applicant obtain a variance
for holding tanks, as the Applicant wishes to install a 6,000 gallon capacity holding tank, thus
meeting the required total capacity of 6,000 gallons, and
WHEREAS, the Applicant has applied for an additional variance from Chapter 136
to replace the existing pump in the building with a pump station, such pump station to be
located at the current distance of 28'7" from Lake George in lieu of the required 50' setback
on property located at 10 Dunham's Bay Road in the Town of Queensbury,
NOW,THEREFORE, BE IT
RESOLVED, that the Town of Queensbury Local Board of Health will hold a public

hearing on Monday, April 15th, 2019 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay
Road, Queensbury, to consider 10 Dunham's Bay Road, LLC sewage disposal variance application
concerning property located at 10 Dunham's Bay Road in the Town of Queensbury and bearing Tax
Map No.: 239.20-1-4 and at that time all interested persons will be heard, and
BE IT FURTHER,
RESOLVED, that the Local Board of Health authorizes and directs the Queensbury Town
Clerk to publish the Notice of Public Hearing presented at this meeting and send a copy of the
Notice to neighbors located within 500 feet of the property as required by law.

Septic Variance Request for Holding Tanks
Dear Town Board:
Our firm is counsel to 10 Dunham's Bay Road, LLC,the new owners of the former Dunham's
Bay Marina in Dunham's Bay on Lake George. I previously submitted an application for
holding tanks on for the septic for the property. In working with the engineers, we have arrived
at a modification that I enclose herewith. This will serve to also amend the application of course.
The amendment is as follows: whereas previously we were proposing a"pump tank"up to the
upper holding tank, in locating the replacement fuel tank, the"pump tank"if you will became a
bit unworkable. The engineers in turn worked up a proposal for a larger tank further from the
lake. As such,the distances here are as follows:
1. Pump station(replaces the existing pump in the building): Current distance 28'7" and
proposed is the same 28'7"-no change,but still within the required 50 foot setback from
the Lake. The reason for this is that given the cement and internal structure of the
building,relocating this from its current location within the bathrooms could not be
achieved in any sort of feasible manner. Thus, we are proposing to replace and upgrade it
in its current location.
2. Force main- 10 feet from the property line which is compliant.
3. Tank- 10 feet from the property line and 110'9" from the Lake,both of which are
compliant.
I apologize for the late submission here but the engineers literally arrived at this latest
amendment on 2:30pm of this date and I am rushing this down to the Town so that hopefully we
can maintain schedule for the upcoming season.
