P R O C L A M A T I O N
To designate the Week of May 19 - 25, 2019, as Emergency Medical Services Week
WHEREAS, emergency medical services is a vital public service; and
WHEREAS, the members of emergency medical services teams are ready to provide lifesaving
care to those in need 24 hours a day, seven days a week; and
WHEREAS, access to quality emergency care dramatically improves the survival and recovery
rate of those who experience sudden illness or injury; and
WHEREAS, emergency medical services has grown to fill a gap by providing important, out of
hospital care, including preventative medicine, follow-up care, and access to telemedicine; and
WHEREAS, the emergency medical services system consists of first responders, emergency
medical technicians, paramedics, emergency medical dispatchers, firefighters, police officers,
educators, administrators, pre-hospital nurses, emergency nurses, emergency physicians, trained
members of the public, and other out of hospital medical care providers; and
WHEREAS, the members of emergency medical services teams, whether career or volunteer,
engage in thousands of hours of specialized training and continuing education to enhance their
lifesaving skills; and
WHEREAS, it is appropriate to recognize the value and the accomplishments of emergency
medical services providers by designating Emergency Medical Services Week;
NOW THEREFORE, the Queensbury Town Board, in recognition of this event do hereby
proclaim the week of May 19-25, 2019, as EMERGENCY MEDICAL SERVICES WEEK With
the theme, EMS Strong: Beyond the Call, I encourage the community to observe this week with
appropriate programs, ceremonies and activities.

1.1 PUBLIC HEARING – CHARLES MASON’S APPLICATION FOR SANITARY
SEWAGE DISPOSAL VARIANCES

SUPERVISOR STROUGH reviewed the three variance requests for property located at 300
Cleverdale Road. Noted that this application is also asking for a waiver from the inspection
process required by our Town Code Chapter 137 due to the installation of a whole new system.
DENNIS MACELROY-For the record, I am Dennis MacElroy with Environmental Design
representing Charles Mason the owner of the property at 300 Cleverdale Road. This property is
under contract being purchased by the neighbor to the south, Freihofer family. They recognize
that the first step they will make upon purchase is the construction of a replacement wastewater
system. Thus, we felt the inspection process was not necessary. There is some expense to that
certainly so if we can avoid, that’s the reason for the request for the waiver. The setbacks are
pretty standard for these replacement systems around the lake; we don’t have proper setbacks to
a property line, to a dwelling so that’s what these three variances are related to. The important
point is that it’s a new system, new septic tank, new pump tank in a field that is the required one
hundred (100) feet from the lake. So those are all good improvements to a system that has
served its time.
SUPERVISOR STROUGH-And the secondary treatment, the filtration beds are an enhanced
treatment system too with the Eljens.

RESOLUTION APPROVING CHARLES MASON’S APPLICATION FOR
SANITARY SEWAGE DISPOSAL VARIANCES
RESOLUTION NO.: BOH 28, 2019

WHEREAS, Charles Mason (Applicant) is the owner of property located at 300 Cleverdale Road in
the Town of Queensbury, which property is currently under contract for sale and installation of a replacement
wastewater system to serve the residence is a condition of the sale, and
WHEREAS, the Applicant filed an application for variances from provisions of the Town of
Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install such replacement wastewater
treatment system as follows:
1. Absorption field to be located 16’ from the dwelling instead of the required 20’ setback;
2. Septic and pump tanks to be located 7’ from the dwelling instead of the required 10’ setback;
and
3. Force main to be located 7’ from the property line instead of the 10’ required; and
WHEREAS, the Applicant also applied for a variance from Chapter 137 to obtain a waiver from the
inspection process, as the Applicant is applying for a construction permit and variance for a replacement
wastewater system, and conveyance of the property to a new owner would be allowed and construction of a
new wastewater system would be completed by the new owner within six (6) months of the conveyance, and
WHEREAS, the Town Clerk’s Office published the Notice of Public Hearing in the Town’s official
newspaper and the Local Board of Health duly conducted a public hearing concerning the variance requests on

Monday, May 20, 2019, and
WHEREAS, the Town Clerk’s Office has advised that it duly notified all property owners within 500
feet of the subject property,
NOW, THEREFORE, BE IT
RESOLVED, that

1. due to the nature of the variances, the Local Board of Health determines that the variances
would not be materially detrimental to the purposes and objectives of this Ordinance or other
adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan
or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the specific
unnecessary hardship found by the Local Board of Health to affect the Applicant; and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves the application of Charles Mason for
variances from the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install a
replacement wastewater treatment system as follows:
1. Absorption field to be located 16’ from the dwelling instead of the required 20’ setback;
2. Septic and pump tanks to be located 7’ from the dwelling instead of the required 10’ setback;
and

RESOLVED, that the Town Board further authorizes the Applicant’s variance from Chapter 137 and
the waiver from the inspection process contingent upon the conveyance of the property to a new owner with
construction of a new wastewater system to be completed by the new owner within six (6) months of the
conveyance on property located at 300 Cleverdale Road in the Town of Queensbury and bearing Tax Map No:
226.12-1-85, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward by certified mail
a certified copy of this Resolution to the Adirondack Park Agency for its review, and
BE IT FURTHER,
RESOLVED, that this approval Resolution shall not be effective until 30 days after such notice to the
Adirondack Park Agency and shall be subject to any lawful action by the Adirondack Park Agency during such
period.

SUPERVISOR STROUGH reviewed proposed Local Law and read the language of the exemption.
Any thoughts on behalf of the Town Board before I open the public hearing? Alright, I am going to
open up the Public Hearing on this amending of Queensbury Town Code Chapter 137. Anybody in
the audience like to speak to how we’re proposing to amend that Law? Seeing none. Any further
thoughts on behalf the Town Board?
COUNCIMAN METIVIER-I just have one. We talked about this John and in the next round of this
since we know this is a working document, we really need to come up with some language for video
inspections. That is something I think we need to work on. You know, in the situations that we’ve
had so far where video inspections actually would have worked as opposed to digging up the D box.
SUPERVISOR STROUGH-I asked Dave about that and he said there is no alternate to digging up
the D box.
COUNCILMAN METIVIER-There is no alternate?
SUPERVISOR STROUGH-No, videotaping would not tell you what he needs to know. But, I
welcomed to invite him to a workshop to have him explain, okay?
COUNCILMAN METIVIER-Okay, that’s fine.

WHEREAS, by Resolution No. 380, 2018, the Queensbury Town Board adopted Local
Law 2 of 2018 entitled “Septic Inspection Upon Property Transfer” which is now set forth at
Queensbury Town Code Chapter 137, and
WHEREAS, at that time, the Town Board determined that there would be no significant
adverse environmental impacts resulting therefrom, and
WHEREAS, Town Code Chapter 137 requires inspection of Onsite Wastewater Treatment
Systems (OWTS) prior to the sale of certain real property, and
WHEREAS, Section 137-4(C) contains certain exemptions from this obligation, and
WHEREAS, the Town Board wishes to consider adding an additional exemption in cases
where property owners and/or prospective purchasers already know or believe that the OWTS
would not pass inspection and where the System is to be replaced within six (6) months of the
property transfer at issue, and
WHEREAS, a public hearing on proposed Local Law No.: 5 of 2019 was duly noticed and

on Monday, May 20, 2019 was duly conducted,
NOW, THEREFORE, BE IT
RESOLVED, that Local Law No.: 5 of 2019 constitutes a minor modification of a
previously reviewed SEQRA Action which will not result in any new, different or additional
environmental impacts which were not previously analyzed and, therefore, no additional SEQRA
Review is warranted, and
BE IT FURTHER,
RESOLVED, that Local Law No.: 5 of 2019 is hereby adopted, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Supervisor, Town

A LOCAL LAW TO AMEND QUEENSBURY TOWN CODE
CHAPTER 137 BY REPEALING AND REPLACING
SECTION 137-4 (C) TO INCLUDE AN ADDITIONAL
EXEMPTION FROM THE “SEPTIC INSPECTION UPON
PROPERTY TRANSFER” LAW

BE IT ENACTED BY THE QUEENSBURY TOWN BOARD AS FOLLOWS:
Section 1. Authority – This Local Law is adopted pursuant to Article 16 of the Town Law
and Article 3 of the Public Health Law
Section 2. Amendment of Town Code – Chapter 137 of the Queensbury Town Code is
hereby amended by repealing and replacing Section 137-4 (C) with the following:
C. Exemption from property transfer inspection. The following conveyances of real property
shall be exempt from the provisions of this article in the following situations and pursuant to
the terms identified below
(1) The property to be sold or transferred will not be inhabited, and the new owner
plans to demolish the existing structure. In order to qualify for the exemption, a notarized
affidavit must be submitted to the Building and Codes Enforcement Office stating that the
dwelling will not be inhabited and that it will be demolished with no immediate plans to
rebuild or the dwelling will not be inhabited, it will be demolished and rebuilt, in which
case the affidavit shall be accompanied by a site plan, including adequate detail to
demonstrate a lawful OWTS, together with a check payable to the Town of Queensbury in
the amount of $2,000. Such funds will be held in a non-interest-bearing escrow account
and will be released in the former case, upon issuance of a demolition permit and, in the
latter case, upon issuance of a certificate of compliance from the Building and Codes
Enforcement Office.
(2) An OWTS inspection was not able to be completed prior to the conveyance of real
property due to inclement weather. In order to qualify for the exemption, a notarized
affidavit from the new property owner to complete the requisite OWTS inspection within
six months of the date of the conveyance of real property, or June 1, whichever comes first,
must be filed with the Building and Codes Enforcement Office. A check payable to the
Town of Queensbury in the amount of $2,000 will be held in a non-interest-bearing escrow
account and shall be released upon the completion of a satisfactory OWTS inspection from
the Building and Codes Enforcement Office.
(3) The property to be sold or transferred contains an existing OWTS that does not
comply with the provisions of this Chapter and the prospective purchasers and/or the Seller
wish to forgo an inspection in favor of installing an approved OWTS within 6 months of
the transfer of property. In order to qualify for the exemption, a notarized affidavit must
be submitted to the Building and Codes Enforcement Office stating that the existing OWTS
will be replaced within 6 months from transfer of property. The affidavit must be
accompanied by a site plan, including adequate detail to demonstrate that the replacement
OWTS will comply with this Chapter, together with a check payable to the Town of
Queensbury in the amount of $2,000. Such funds will be held in a non-interest-bearing

escrow account and will be released upon issuance of a certificate of compliance from the
Building and Codes Enforcement Office.
(4) During the OWTS inspection, a failure of the septic system was determined. Due
to winter and frozen conditions, the repair to an existing OWTS could not occur or a new
OWTS could not be installed before the conveyance of real property. In order to qualify
for the exemption, a notarized affidavit from the new property owner to complete the
installation or repair of the septic system within six months from the date of the conveyance
of real property, or June 1, whichever comes first, must be filed with the Building and
Codes Enforcement Office. A check payable to the Town of Queensbury in the amount of
$2,000 will be held in a non-interest-bearing escrow account and shall be released upon
the completion of the repair or installation of a new septic system and a satisfactory OWTS
inspection from the Building and Codes Enforcement Office.
(5) There is record of the property's OWTS having passed Town inspection within the
last three years.
(6) Failure to complete the inspection, obtain the permit or complete all
repairs/installations identified in the preceding subsections of this section within the time
provided or any subsequent deadline established by the Building and Codes Enforcement
Office will result in forfeiture of the moneys held in escrow, and the Town may use such
funds toward abating the conditions caused by each such violation of this article.
Section 3. Severability – The invalidity of any clause, sentence, paragraph or provision
of this Local Law shall not invalidate any other clause, sentence, paragraph or part thereof.
Section 4. Repealer – All Local Laws or Ordinances or parts of Local Laws or Ordinances
in conflict with any part of this Local Law are hereby repealed.
2.2 PUBLIC HEARING – 2016/2020 AMENDED AGREEMENT FOR FIRE
PROTECTION SERVICES BETWEEN TOWN OF QUEENSBURY AND SOUTH
QUEENSBURY VOLUNTEER FIRE COMPANY

SUPERVISOR STROUGH reviewed the proposed amendment to the agreement which allows South
Queensbury Volunteer Fire Company, since they have paid off their outstanding debt, to use their
“Debt Service” for the firehouse building project as well. Any thoughts by the Town Board before I
open the public hearing? Any member of the public wish to speak to what we’re proposing here?
RON DUFOUR-Member of the Fire Department, past Chief and Chairman of the Building
Committee. I am sorry about my appearance, I rushed from my second job and forgot to grab an extra
pair of pants. I just wanted to thank the Town Board for cooperating with us in the process that we
were looking to do. I know it was a long process and we kind of butted heads a little bit here and
there but I appreciate what you guys have done and it’s going to be a total new station pretty much. I

know you guys have seen evidence; it definitely needs a lot of work and new roofs and I kind of
wanted to explain what we’re kind of looking at doing, not just throwing money away. All new roofs
where we had the mold removal… we’ll have all that taken care of. We’ve had a lot of issues with
people slipping on the floors in that rented space so that will all be taken care of with epoxy flooring.
We were lacking office spaces. This will take care of the office spaces and the EVAC for exhaust on
the trucks. So, I just wanted to explain a little bit on that. We have drainage issues in the back that
water runs through the bays; that’s going to be taken care of. Concrete issues, apron issues. So that’s
pretty much what I wanted to say and I appreciate the Town Board keeping an open mind and working
with us.
SUPERVISOR STROUGH-Thank you Ron and thank you for all the, the volunteers for South
Queensbury Fire Department does for our community and we know it’s not just fire service. What
they do for our community is automobile accidents, directing traffic, using Jaws of Life. They are also
responsible for the airport. They also pump out basements during times of flooding. They also, the
building becomes a safe harbor during times of needs such as an ice storm or incredibly bad water
storm and the public needs a place to go so they will go and we’ll have food there and we’ll have
medical there, we’ll have services there. So, it’s a safe haven; it’s part of the emergency services plan
for the whole town using their facility so it needs to be in good shape. But, you know what, it wouldn’t
be anything to anybody if wasn’t for the volunteers, many of them are here tonight who are doing
this. So, this Town Board and this Town of Queensbury thanks you all for all that you do. And they
do have fundraisers too. They’ve got probably the world’s best barbecue chicken dinner and that’s
usually in August, right? So, make sure everybody goes to that. You better order twice as much
chicken as you usually do and it is absolutely to die for chicken. Alright, so they are doing fundraisers
in addition to everything else that they do to try and provide this service and provide this equipment
to the community. Again, thank you. I will close the public hearing.

RESOLUTION APPROVING FIRE PROTECTION SERVICE AMENDED
AGREEMENT BETWEEN TOWN OF QUEENSBURY AND SOUTH
QUEENSBURY VOLUNTEER FIRE COMPANY, INC. FOR 2016–2020
RESOLUTION NO.: 177, 2019

WHEREAS, fire protection services are provided to the Town of Queensbury by the Bay Ridge
Volunteer Fire Co., Inc., North Queensbury Volunteer Fire Co., Inc., Queensbury Central Volunteer Fire Co.,
Inc., South Queensbury Volunteer Fire Co., Inc., and West Glens Falls Volunteer Fire Co., Inc., in accordance
with agreements between each Volunteer Fire Company and the Town, and

WHEREAS, by Resolution No.: 40,2016, the Queensbury Town Board, on behalf of the Fire
Protection District, authorized a five (5) year Fire Protection Service Agreement between the Town and the
South Queensbury Volunteer Fire Co., Inc., (“Fire Company”) for 2016-2020 dated January 1, 2016 (the
“Agreement”), and
WHEREAS, the budget in the Agreement included $180,428 each year which was only to be used for
debt service, and
WHEREAS, the Fire Company paid all its remaining outstanding debt in full in 2017 and informed
the Town Board of this, and
WHEREAS, the understanding of the parties was that such funds were to be used towards the Fire
Company’s firehouse building project, and
WHEREAS, the parties wish to clarify that their intention was that “debt service” in the Agreement
was to include payments toward the firehouse building project, and
WHEREAS, there is no change in the Town’s payments under such clarifications to the Agreement,
and
WHEREAS, a proposed Amended Agreement was prepared to set forth such clarifications and is
presented at this meeting, and
WHEREAS, in accordance with Town Law §184 and General Municipal Law §209(b), the Town

Board conducted a public hearing on Monday, May 20, 2019 and heard all interested persons concerning the
proposed Amended Agreement,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board, on behalf of the Fire Protection District, hereby
approves the Fire Protection Service Amended Agreement between the Town and the South Queensbury
Volunteer Fire Co., Inc., for 2016-2020 to clarify that “Debt Service” was intended for this Amended
Agreement to include debt service and firehouse building project expenses, including expenses associated with
investigation, professional services, and other expenses associated with the firehouse building project for years
2018, 2019 and 2020 (being the years after all outstanding debt was paid in full so there would be no debt
service), and
BE IT FURTHER,
RESOLVED, that all actions taken by the Fire Company and the Town with respect to the use of “Debt
Service” in the Agreement are hereby ratified and approved, and
RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute such
Amended Agreement incorporating the clarifying changes in substantially the form presented at this meeting
and the Town Supervisor and/or Budget Officer to take such other and further action necessary to effectuate
the terms of this Resolution, and
BE IT FURTHER,

WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid
to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth
in the Town’s bid documents and specifications, and
WHEREAS, by Resolution No.: 472, 2018, the Town Board authorized an advertisement for bids for
the Project in the official newspaper for the Town of Queensbury, and

WHEREAS, on March 21, 2019, the Purchasing Agent duly received and opened all bids, and
WHEREAS, the Purchasing Agent and Chazen have reviewed the bids and recommended that the
Town Board authorize the bid award to the lowest responsible bidder, Eagle Associates of Cazenovia,

WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the total amount of
$98,720 from Capital Reserve No. 64 toward this Capital Project, and

Change Orders may become necessary for such Contract and has requested that the Town Board also

RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for such Project
are expenditures for a specific capital project for which the Capital Reserve Fund #64 was established, and

property owned by the City located within the Town in the Halfway Brook Reservoir Watershed (“License
Agreement”), and
WHEREAS, by Resolution No.: 55,2019, the Town Board expressed its support of the License
Agreement and, upon completion of SEQRA review by the City of Glens Falls Common Council, its intention
to authorize and direct the Town Supervisor to execute the License Agreement, and

Declaration and authorized the License Agreement, and

This will help us to avoid huge swings with tax levies and tax rates. I will be circulating
this to the Board members and hopefully this will help us to make better decisions on the
fiscal health of the Town.
COUNCILMAN FERONE (WARD III)
Noted that tonight’s purchase of the radar speed signs will be a trial starting on three (3)
roads in the Town and based on our success, we might push some more out.
The pole went up on Cottage Hill in preparation of the new traffic signal light going in.
Referred to South Queensbury Volunteer Fire Company’s proposal to their building and
was happy they were able to agree and move forward with tonight’s Resolution. Looking
forward to touring the building.
COUNCILWOMAN ATHERDEN (WARD II)
Looking forward to marching in the Memorial Day Parade.
COUNCILMAN METIVIER (WARD I)
Announced that there were burglaries in North Queensbury last night, seven (7) cars were
entered into illegally. Every single car was unlocked and valuables were taken. People
need to lock their car doors and more importantly, lock your homes. There is also a huge
breakout in Queensbury of fraudulent wire transfers done thru emails. People need to be
aware and extremely careful.

Announced the 19 Glens Falls Queensbury Memorial Day Parade one week from today,

May 27. The theme of the parade is ‘Honor Those Who Never Returned’.
Thanked the parade committee members; Colleen Tarantino, Joan Aldous, Tim Banner,
Carl Fosco and Tony Garcia.
Announced the three (3) Grand Marshalls; Karl Frank, Wayne Humburg and Robert
Ovitt. Keynote Speaker will be Kenneth Aldous and the Lincoln’s Gettysburg Address
will be read by Brady Stark.
In response to the Memorial Day youth outreach program, we have a poster contest and
essay contest. The winners of the poster contest are Elijah Flint, Jaiden Mali, Adler
Palmer and Riley Sheehan. The essay contest winner is Julia Metivier, daughter of
Councilman Metivier.
