3.10 3.10 GRANTS\Lake George Town-Applicant-McPhillips Preserve at French Mt-Support-Contribute S5k for Grant Applications-6-17-19 RESOLUTION AUTHORIZING SUPPORT OF TOWN OF LAKE GEORGE AND/OR LAKE GEORGE LAND CONSERVANCY'S GRANT APPLICATIONS FOR FUTURE SHARED PARK TO BE KNOWN AS "MCPHILLIPS PRESERVE AT FRENCH MOUNTAIN" RESOLUTION NO.: , 2019 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No.: 335,2018, the Queensbuiy Town Board authorized an Agreement with the Lake George Land Conservancy, Inc. (LGLC) providing for the Town's purchase of property bearing Tax Map No.: 265-1-28 in an effort to protect and preserve that portion of property in the French Mountain Preserve located in the Town of Queensbuiy, such property to be part of a future shared park with the Town of Lake George and LGLC likely to be named the "McPhillips Preserve at French Mountain" (Park Project), and WHEREAS, the Town of Lake George is applying to the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) for a grant under the Environmental Protection Fund for such Park Project and as part of such grant process, has engaged the services of consultants to help with preconstruction analysis/site planning, conceptual design work and the grant application work for a total cost of$15,000, and WHEREAS, the Town of Lake George will be the grant administrator should grant funds be awarded, and WHEREAS, the Town of Lake George has requested that the LGLC and Town of Queensbury, as equal stakeholders/partners in the Park Project, contribute equally toward the preconstruction analysis/site planning, conceptual design work and grant application work for the shared Park facility, with each party to contribute $5,000, and WHEREAS, the Town Board supports the preconstruction analysis/site planning, conceptual design work and grant application efforts toward the collective Park Project with the understanding that the Town of Lake George will be the grant administrator should grant funds be awarded, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby supports the Town of Lake George's application to the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) for a grant under the Environmental Protection Fund at the French Mountain Preserve for the future shared park with the Town of Lake George and Lake George Land Conservancy, Inc., likely to be named the McPhillips Preserve at French Mountain (Park Project) with the understanding that the Town of Lake George will be the grant administrator should grant funds be awarded, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs a contribution of$5,000 to the Town of Lake George toward the preconstruction analysis/site planning, conceptual design work and grant application work as delineated in the preambles of this Resolution to be paid for from Account#: 001-8510-4400, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer 2 to take all actions needed to provide for the $5,000 expenditure including amendment of the Town Budget by decreasing the Town's Undesignated, Unappropriated General Fund Balance#001-0000- 0909 by$5,000 and increasing Account#001-8510-4400 by$5,000, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any needed Agreement between the Town, Town of Lake George and/or the LGLC and/or any other needed documentation and the Town Supervisor, Town Counsel and/or Town Budget Officer to take such other and further actions necessary to effectuate the terms of this Resolution. FOR PROPERTY PURCHASE AND CONSERVATION EASEMENT IN CONNECTION WITH FRENCH MOUNTAIN PRESERVE RESOLUTION NO.: 335,2018 INTRODUCED BY: Mr. George Ferone WHO MOVED ITS ADOPTION SECONDED BY: Mrs.Jennifer Switzer WHEREAS, the Lake George Land Conservancy, Inc. (LGLC) has advised that it wishes to purchase certain property in the Towns of Lake George and Queensbury currently owned by French Mountain Forest, LLC for the price of$525,000 consisting of 318± acres east of Bloody Pond Road with property bearing Tax Map No.: 265-1-28 located in the Town of Queensbury and properties bearing tax map nos. 264.16-1-27, 264.16-1-28, 265.00-2-1 located in the Town of Lake George, such properties collectively referred to as the French Mountain Preserve, and WHEREAS, in an effort to protect and preserve that portion of property in the French Mountain Preserve located in the Town of Queensbury, the Queensbury Town Board wishes to subsequently purchase from LGLC that portion of property bearing Tax Map No.: 265-1-28 for the amount of$67,000, and WHEREAS, the Town Board also wishes to grant to the LGLC a Conservation Easement restricting the use of the property to passive recreation uses by the public and/or to permit forestry management and donate $10,000 to LGLC for administration of the Conservation Easement, and WHEREAS, a proposed Agreement between the LGLC and the Town of Queensbury regarding the Town's property purchase is presented at this meeting and is in form acceptable to Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes the Agreement between the Lake George Land Conservancy, Inc. (LGLC) and the Town of Queensbury providing for the Town's purchase of property bearing Tax Map No.: 265-1-28 for the amount of $67,000, and an additional $10,000 for the administration of the Conservation Easement, as more specifically delineated in the preambles of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute the Agreement substantially in the form presented at this meeting, as well as a Conservation Easement with the LGLC to be in form acceptable to Town Counsel and/or the Town Supervisor, and any other needed documentation to effectuate the property purchase and Conservation Easement, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to take all actions needed to provide for the expenditures of $67,000 for the property purchase and $10,000 for the administration of the Conservation Easement, including amending the Town Budget by decreasing the Town's Undesignated, Unappropriated General Fund Balance #001-0000-0909 by $77,000 and increasing Land Acquisition Appropriation Account #001-1940-2820 by $77,000, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Budget Officer and/or Town Counsel to take any other needed actions to effectuate the terms of this Resolution.
