WHEREAS, the Queensbury Town Board wishes to identify and inventory the Town
highway’s stormwater conveyances systems, facilities and designs, to better manage inspections,
maintenance and repairs, and
WHEREAS, the Town Board wishes to accordingly engage the services of a consultant to
identify its stormwater system components including culverts, catch basins, retention ponds and
related facilities for which the Town is responsible so that the Town may better manage inspections,
maintenance and repairs, and
WHEREAS, in the past the Town Board has engaged the services of Cost Control Associates,
Inc., (Cost Control) and was pleased with its services, and
WHEREAS, the Town feels that this task has the potential to be a very elaborate and
complicated undertaking, and

WHEREAS, Cost Control offered to investigate a small study area and use its services and
resources with the intent of identifying the challenges and needs that this effort is likely to face before
it seeks proposals to make this effort Town wide, and
WHEREAS, Cost Control will locate the Town’s stormwater systems and components, gather
GPS coordinates, determine ownership, assess the general condition of each component and launch a
Pilot Program covering a specific area, such services to be provided at the rate of $85 per hour but
not exceeding a total amount of $7,500, in accordance with Cost Control’s “Proposal to Provide a
Study of Culverts (Pilot Program) for the Town of Queensbury” dated May 17, 2019 presented at this
meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes engagement
of the services of Cost Control Associates, Inc. to locate the Town’s stormwater system components,
gather GPS coordinates, determine ownership, assess the general condition of each component and

WHEREAS, by Resolution No: 154,2019, the Queensbury Town Board authorized the
Director of Building and Codes Enforcement’s (Director) engagement of the monthly lawn mowing
services of Cheap Pete’s Lawn Care for certain properties in the Town of Queensbury in a state of
serious neglect, and
WHEREAS, the Director has advised the Town Board of an additional property in the Town
of Queensbury needing mowing services located at 171 Sherman Avenue, and
WHEREAS, in addition to the needed mowing services, the Director has advised that there is
additional neglect of the property in that a fence, pool and deck are in disrepair and therefore, the
Director also recommends that the Town Board authorize a one-time clean-up of the property for
removal and disposal of the fence, pool and deck, and
WHEREAS, the Town Board has concluded that the condition of the property creates a public
health hazard due to concerns regarding fire and the harboring of ticks and other vermin in the tall
grass, and
WHEREAS, the Director reports that he has attempted to contact the owner of record by
certified letter and/or posting of the property and reports that his efforts have been to no avail and he
has been unable to reach anyone or to obtain any resolution of the situation, and

WHEREAS, in accordance with Town Law §64 (5-a), the Town Board may require the
owners of land to cut, trim or remove from the land owned by them, brush, grass, rubbish or weeds
or to spray poisonous shrubs or weeds on such land, and upon default, may cause such grass, brush,
rubbish or weeds to be cut, trimmed or removed and such poisonous shrubs or weeds to be sprayed
by the Town and the total expense of such cutting, trimming, removal or spraying may be assessed
by the Town Board on the real property on which such grass, rubbish, weeds or poisonous shrubs or
weeds were found and the expense so assessed shall constitute a lien and charge on the real property
on which it is levied until paid or otherwise satisfied or discharged and shall be collected in the same
manner and at the same time as other Town charges,
WHEREAS, the Director obtained quotes for monthly mowing of the property for a period
of four (4) months and for a one-time clean-up of the property, and
WHEREAS, Cheap Pete’s Lawn Care submitted quotes dated 5/17/2019 for the: 1) mowing

services in the amount of $60 total per month commencing on or about July 1 for a period of four
(4) months for a total amount not to exceed $240, and 2) one-time clean up services, i.e., the removal
and disposal of the fence, pool and deck for a total amount of $2,000, and
WHEREAS, the Director recommends that the Town Board engage such services,
NOW, THEREFORE, BE IT,
RESOLVED, that the Queensbury Town Board directs that a final notice shall be sent by U.S.
mail to the Property Owner of Record for the property described in the preambles of this Resolution
requiring that they mow the lawn and clean-up their property as set forth above within 10 days and
failing to do so, the Town will cause such action to be taken and the cost thereof will be assessed by
the Town Board on the real property and the assessment shall constitute a lien and charge on the real
property until paid or otherwise satisfied or discharged and shall be collected in the same manner and
at the same time as other Town charges, and
BE IT FURTHER,
RESOLVED, that the Town Board further approves of and authorizes the Director of Building
and Codes Enforcement’s engagement of Cheap Pete’s Lawn Care for the: 1) monthly lawn mowing

Departments which are considered to be surplus, and

WHEREAS, the Town of Queensbury believes that the environmental health and overall quality of
life in the Lake George Watershed area is critical to the social and economic well being for the Town of
Queensbury, Warren County and the region in general and has partnered with local municipalities (Parties),
including the Village of Lake George (Village), in completing certain water quality assessment and
management activities for Lake George, and
WHEREAS, the Village has been awarded grant funds by the New York Department of State for a
Project referred to as the Lake George Watershed Management Priority Action Plan Implementation –
Village of Lake George – Grant #C1000532, and
WHEREAS, the Village intends to use the grant funds to reimburse the Village and the Parties’
actually paid Project costs, with the Parties to provide for and achieve matching funds or qualified matching
services, goods or equipment under the grant, and
WHEREAS, a proposed Memorandum of Agreement Relating to Lake George Watershed Priority
Action Plan Implementation Village of Lake George C1000532 between the Village, Town and Parties
providing for the acceptance of grant funds and payment of expenses is presented at this meeting,

of grant funds and payment of expenses in the interest of advancing the important work of protecting the

WHEREAS, the Town of Queensbury’s Town Clerk and Tax Receiver (Town Clerk) has

recommended reestablishing the duties and responsibilities of the 1 and 2 Deputy Tax Receivers, and

WHEREAS, the Town Board wishes to amend the 2019 salaries for the 1 and 2 Deputy Tax

RESOLVED, that the Queensbury Town Board hereby amends Resolution No.: 465, 2018 such that

FOR PROVISION OF WATER SERVICES BETWEEN
TOWN OF QUEENSBURY AND JONATHAN AND MINDY HESS

WHEREAS, the Town of Queensbury established and created the Queensbury Consolidated Water
District (Water District) and the Queensbury Water Treatment Plant, and
WHEREAS, Jonathan and Mindy Hess have requested water service from the Water District for their
lot located at 4 Blackberry Lane in the Town of Queensbury (Tax Map No.: 289.19-1-3) although the property
is located directly adjacent and outside of the Water District, and
WHEREAS, the Town of Queensbury’s past practice is to grant water service to residents outside of
the Water District until the next time that the Water District is extended, at which time the residents’ properties
will become part of the Consolidated Water District, and
WHEREAS, the Water Superintendent has recommended that the Town Board authorize an
Agreement for the supply of water to Jonathan and Mindy Hess in accordance with Town Law §198(3)(b),
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the supply of water from the
Queensbury Consolidated Water District’s Water Treatment Plant to Jonathan and Mindy Hess for their lot
located at 4 Blackberry Lane in the Town of Queensbury (Tax Map No.: 289.19-1-3) contingent upon Jonathan
and Mindy Hess signing an Out-of-District Agreement, such Agreement to be in form approved by the Town
Water Superintendent and/or Town Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Water Superintendent to make
all necessary arrangements, including collecting the $100 capital buy-in fee and other applicable soft costs from
Jonathan and Mindy Hess, and executing and delivering the Agreement and documents for the supply of water
in accordance with Town Law §198(3)(b), to effectuate the terms of this Resolution and connections
authorized herein.

Spoke regarding both Pine View and Mount Herman Cemeteries.
Suggested that the Town ask Richard Schermerhorn to put the stone on the new trail.
5.0 TOWN BOARD DISCUSSIONS
COUNCILWOMAN ATHERDEN (WARD II)-
Spoke regarding LED lighting and approval of $50,000 grant from the Community
Energy Committee.
Received a National Grid grant to install the 20 ports or the 10 electric vehicle-charging
stations.
The Clean Air Action Network will be holding a presentation on June 10th from 6:30pm-
8:30pm at Crandall Public Library regarding air pollution and human health.
Chris Navitsky reached out to inform of the Fund for Lake George annual meeting on

July 6. Queensbury will be receiving an award this year.
COUNCILMAN FERONE (WARD III)- Attended the Warren County EDC luncheon last week.
The topic on tourism was very interesting.
COUNCILWOMAN SWITZER (WARD IV)-

On Thursday, July 11 from 10:00am-12:00pm the Warren County Employment and
Training Administration will be holding a Veteran’s Job Fair. Businesses interested in
participating in the job fair should contact Director, Chris Hunsinger at (518)743-0925.
Thanked Mr. Winters for recognizing our Town Cemeteries. Cemetery Superintendent,
Connie Goedert does a great job; but some of that credit goes out to the seniors at
Queensbury High School who volunteered during their senior give back day.
