Supervisor Borgos-Opened the Meeting...Introduced Mr. Thomas Flaherty
Mr. Flaherty-Qsby. Water Supt.-The Water Supt. for Hudson Falls has contacted my Dept., they have
stated that they have a potential problem that may require the usage of Queensbury Water on a short term
period... we would like a resolution in place so that if something did happen we would be able to provide
the assistance...
Supervisor Borgos-I have spoken with Mayor Jones....he has stated the same...there is an interconnection
there already, a meter can be installed...
Attorney Dusek-Noted that the General Municipal Law provides for mutual aid services, however it
assumes that there will be an agreement in advance between the municipalities, that is why the meeting is
necessary to make sure we have covered the bases...
Councilman Montesi-Questioned Mr. Flaherty, will this cause us a problem with the supply of water?
Mr. Flaherty-No...because of the season and the drop in use, we can pick this up without a problem.
Discussion held in regard to payments...it was agreed to leave it at 60 days...
RESOLUTION TO APPROVE SALE OF WATER ON TEMPORARY AND EMERGENCY BASIS TO
VILLAGE OF HUDSON FALLS
RESOLUTION NO. 470, 1991, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded
by Mrs. Betty Monahan:
WHEREAS, the Village of Hudson Falls is experiencing difficulties with its water supply and officials
from the Village of Hudson Falls have contacted the Town of Queensbury concerning the possible sale of
water, on an emergency basis only, to the Village of Hudson Falls, and
WHEREAS, the Town of Queensbury is desirous of assisting the Village of Hudson Falls is connection
with its water supply difficulties on a temporary and emergency-basis only, and
WHEREAS, a proposed agreement has been presented at this meeting for the sale of water to the Village of
Hudson Falls as aforesaid, and
WHEREAS, the Town Board of the Town of Queensbury is desirous of arranging for the sale of water to
the Village of Hudson Falls on an emergency basis and in furtherance of its authority to provide mutual aid
as set forth in the General Municipal Law of the State of New York,
NOW, THEREFORE BE IT
RESOLVED, the Town Board of the Town of Queensbury hereby approves the sale of water to the Village
of Hudson Falls, on a temporary and emergency basis only, at the rate set forth in the proposed contract of
sale presented at this meeting, and
BE IT FURTHER
RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes and approves of the
agreement presented but also authorizes the Town Supervisor to engage in negotiations with the Village of
Hudson Falls to enter into an agreement that is substantially in the form presented at this meeting, but
which agreement may contain some variations in the terms and provisions, so long as the cost of the water
is not varied and the terms and provisions of the same providing for cancellation upon thirty (30) days
notice are not varied.
Duly adopted this 6th day of September, 1991, by the following vote:
Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos
Noes: None
Absent: Mr. Kurosaka
Councilman Montesi-Noted it will be $1.65 per thousand...
Discussion held in regard to the agreement -the meter if it has to be placed will be at the expense of the
Town of Queensbury, the agreement will be modified.
On motion the meeting was adjourned.
