WHEREAS the Town of Queensbury is, by operation of Law, the Local Board of Health for the Town of
Queensbury and, as such, is authorized under Section 5.035 of the Sanitary Sewage Disposal Ordinance of
the Town of Queensbury to issue variances to such Ordinance, and
WHEREAS, Mr. Edward D. Lockhart has applied to the Local Board of Health of the Town of
Queensbury for five (5) variances from certain standards of the Sewage Disposal Ordinance set forth in
Section 3.050-5, such standard providing as follows:

WHEREAS, pursuant to Section 103 of the General Municipal Law, it is necessary to advertise for

DISCUSSION
1. The number of Members on the Zoning Board of Appeals-The State Law change will be effective
July 1st. 1992, it has revised the old 5 to 7 members to make them 3 or 5 members depending upon the
choice of the Town Board, the question has arisen, can the Town Board if it chooses maintain its 7 member
board.. . right now it can maintain its 7 member board and if in fact the 7 member board is in effect at the
time of July 1st, 1992, that 7 member board may continue as that until someone resigns or their
appointment expires...the question then becomes if that happens can the Town Board then continue with the
7 member board... the law in this regard is not clear unfortunately in the way they wrote it the first part of
the law would tend to indicate that the only authority the Town Board has is to appoint a three or five
member board...if you read down below in another paragraph, it indicates that in terms of addressing,
decreasing the board, that the Town Board can continue it's 7 member board until it changes it back by
resolution so this would tend to make you think that maybe you could just continue it and continue
appointing members...ifyou wanted to protect yourself one step further a local law reestablishing the 7
member board or at least authorizing the continuance of the 7 member board may not be a bad idea.. . hasn't
researched this aspect it would seem that you would be able to adopt such a local law because it affects
only your own internal affairs and management of government which is one of the reasons you can adopt
municipal home rule laws and actually amend or change the Town law...ifthe Board doesn't wish the added
protection, you can still make an argument that, as it currently reads, you have a 7 member board, the only
problem with that is, who knows where we go with it,...I can see an argument being made with it both
ways.
Councilman Goetz-Noted that the Zoning Board of Appeals has requested a 7 member board. As a former
Board member, it seems that you get a better cross section of people with a 7 member board, better for
applicants, better to get a quorurn.
Supervisor Brandt-Noted that he is in favor of the 7 member board. Board members instructed Town
Attorney Dusek to construct a local law for this purpose.
Town Attorney Dusek-Recommended to Board to fill vacancies on the Zoning Board before the July 1st,
deadline.
Supervisor Brandt-Noted that there is presently a vacancy on the Planning Board at the present time.

2. Anmesty/water hookup...Board held discussion on residents in Town that have not
hooked up to the Queensbury water system, but want to hookup now. Town Attorney Dusek noted that in
order to do this a local law would have to be drafted and a public hearing held, as long as
there is no prohibition this could be done. Town Attorney to report back to Board members
regarding this matter.

3. Supervisor Brandt noted he has received correspondence from Hiland Park as a matter of record.
Asked Town Attorney Dusek to reply to this matter.

4. Discussion held on amount to be spent at Association of Towns for anyone who is going to
Association of Towns. Board drafted the following resolution.
RESOLUTION PLACING CAP ON SPENDING AT ASSOCIATION OF TOWNS MEETING

attends the Association of Town Meeting in New York City.

Discussion
4. Sheriffs Contract...Members from County Board Lloyd Demboski, c.P. South and Betty Little
spoke with Town Board members concerning Sheriffs Contract for 1992. Mr. Demboski noted that 50
percent of calls received at Sheriffs Department in Warren County come from Queensbury...noted if
contract isn't renewed, cars will have to be pulled out of Queensbury.. . citizens concerned for their
safety...shortfall in the county budget of $275,000 at this particular time. Supervisor Brandt noted residents
feel that it's a double taxation...would like to try to find a way of keeping a reasonably good presence of
police and slowly phase out the contract over a period of time... Councilman Monahan asked if the basic
coverage has gone up with increase population, increase commercial property...getting more protection
now than when contract originally was signed...Councilman Caimano asked if Town were to agree to a
three year agreement and phase out would county be willing to think about this? Mr. Demboski noted a
meeting will be held with the Sheriff Committee to discuss alternatives... Supervisor Brandt noted while
Queensbury does have a line item in it's budget for police services at the amount that was discussed and
shows up in the County contract it lacks sufficient money for the landfill closure operation this year and it
tells that the Town will be short $700,000 of what is needed for landfill closure and there is no source of
money for that...knows that something more has to be done with Hovey Pond, nothing provided for
this... starting to take measures in Town to do this...in police contract would like to try to find a way of
phasing it down so it's workable and livable...noted people in Queensbury spent money to build State
Trooper's Barracks has talked with Lieutenant, barracks has ten troopers assigned to it and one sergeant,
plus three investigators, and one senior investigator they have no plans to lower the number, noting that this
is a factor, something to be gained here...would like to see if a solution can be found this yearfor $175,000,
hopefully the following year of $125,000 and the third year at $75,000 and then be out of it... would like the
county to consider this and think about it...Betty Little noted that there is a level of service that's provided
for all of Warren County and then an additional level of service that is provided to the Town of Queensbury
which guarantees two cars will never leave the Town...concerned that if there are no contracts for police
protection with the Towns in Warren County once Queensbury gets out of their contract, other counties will
want to get out of their contract... Queensbury is going to pay 35 percent of all of the Sheriff s Department
to provide all of those services...may save money on the town tax, but will cause the Queensbury residents
county tax to increase...Councilman Monahan asked if there has been an increase in crime with the
presence of police units in Town...Mr. Demboski noted that the Sheriffs report has indicated that there has
been an increase in crime in Queensbury due to the population increase...Mr. Demboski noted that having
the police in Queensbury, this is a deterent for crime...Councilman Tucker noted he would like to talk to the
Sheriff...Mr. Tim Brewer noted if $275,000 was eliminated that the $275,000 would be spread out among
the residents in Warren County, believes taxes would be less for residents in Town of Queensbury...Mrs.
Little noted that then you pay 35 percent of the $275,000, then when other communities contracts run out
you'll pay 35 percent of each of these, if you were to keep the same level of service... Supervisor Brandt
noted the real question is the level of service.. . noted that with the Trooper station and the Sheriff
Department, maybe more coordination between the two can be done... Councilman Goetz noted that she
would be for the compromises suggested, but in writing, as to when it would end...Town Attorney Dusek
noted a letter was written to Warren County Supervisors back in October 1991 indicating that the contract
was not automatically to be assumed to be renewed and that it would be negotiated...Mr. Steve Sutton,
business owner and resident of Town.. .feels priorities should be kept in favor of keeping the level of
protection as currently exists... Supervisor Brandt noted he thinks there is room for discussion on both
levels... Supervisor Brandt noted that if Sheriff Fred Lamy enters meeting, we will continue this discussion
later in the meeting.
DISCUSSION HELD
Town Clerk Dougher noted that commercial haulers are requesting refunds for tickets already purchased,
but can no longer use them due to the Burn Plant, asked Supervisor Brandt how this matter should be
handled. The Town Board adopted the following resolution.
RESOLUTION TO REFUND LANDFILL FEE FOR UNUSED TICKETS

Councilman Tucker-Noted a few things from the Superintendent of the Landfill concerning bids for scrap
metal, tires, requesting that these items go out to bid. Town Attorney Dusek noted that they have rough
drafts of documents ready, have to place them in final form to go out to bid.
Councilman Goetz-Has spoke with Dean Beckos of the Queensbury Economic Development Corporation
requesting a meeting with the Town Board. Noted that Doug Keenan, Nancy Beaty, and Mary Lee Goslin
residents of Queensbury have agreed to work on a Citizens Committee to help solve the problem
concerning Hovey Pond. Asked if the Department of State has ever made a presentation to Town
concerning possible options regarding the sewer rent bills.
Town Attorney Dusek-Noted to his knowledge they haven't.
Councilman Goetz-To contact Department of State to see if a representative can talk to the Town regarding
sewer rent bills.
Councilman Caimano-Spoke to Board regarding vacation time for Town employees. Would like to adopt a
policy regarding this matter.
Supervisor Brandt-Noted he his in favor of this.
Town Attorney Dusek-Spoke to Board regarding the re-roofing for maintenance building Water Treatment
Plant. Noted bid opening done in December and the contract awarded. The contract hasn't started because
bidder would like to substitute cash instead of the bond. Board members adopted the following resolution.
RESOLUTION ACCEPTING CASH BOND
RESOLUTION NO. 40, 1992

RESOLVED, that the Town Board of the Town of Queensbury after considering the contract currently
awarded to Corinth Construction Corp. for the re-roofing of the maintenance building at the Queensbury
Water Treatment Plant hereby determines that it would be appropriate to accept a cash bond with an
indenmity agreement from the Contractor instead of requiring the standard performance bond and hereby
directs that upon receipt of a cash bond in the full amount of the contract that the same will be deposited in
an escrow account or similar account where it is isolated and interest earned on that money will be credited
toward that fund and as the job progresses portions of that money as to be determined in the future by the
Town Board will be refunded to the contractor.

COMMUNICATIONS
Town Clerk Dougher noted she has received a letter from Department of Transportation noting the speed
limit has been reduced to 40 rn.p.h. on Chestnut Ridge Road.
OPEN FORUM
Barbara Bennett -Spoke to the Board regarding meeting with Sheriff Committee, asked if further public
hearings will be held.
Supervisor Brandt-Noted that the Board would open this up for public input before the Board passed a
resolution.
Mrs. Bennett-Requested that the Board continue the policy of broadcasting Board Meetings on the local
news on WWSC to let the public know what meetings are being held and at what time.
Supervisor Brandt-Noted the Board will continue this policy.
Mrs. Bennett-Spoke to the Board regarding the Workshop Meetings to be held, asked if they were open to
public.
Supervisor Brandt -Yes.
Mrs. Bennett-Questioned Councilman Caimano about the $999.00 to the Library Fund, asked why he chose
this number.
Councilman Caimano-Noted the original salary set by the previous Town Board for Deputy Supervisor was
$1,000 reduced this to $1.00 and gave balance to the library and leaves this a paid job.
Ralph VanDusen-Deputy Water Superintendent. Noted that the bids for chemicals should be treated
separately. Suggested that when the Board holds a workshop or public session to discuss policies or things
regarding personnel, whether union or non-union, that they might also request employees of Town to sit in
and give their perspective.
Supervisor Brandt-Noted he hopes that they invite employee input in everything they do noted that it's
important to encourage this.

Discussion Continued Sheriff Contract/Sheriff Fred Lamy entered meeting.
Sheriff Fred Lamy noted that historically the department has always done a separate activity sheet for
Town of Queensbury at Mr. Borgos's request, two years ago Mr. Borgos stated that they did not have to do
an activity sheet anymore...noted they have no objections to redoing this...January 1st, 1983 prior to this
basically tried to maintain one car in Town of Queensbury. . . Today maintain not less than four cars, a good
part of the time there are five sometimes, six, seven depending on what's going on. Winter months operate
on a different minimum staffing level due to activity.. .Enormous amount of activity that has nothing to do
with the Queensbury contract that has been absorbed over the last eight, nine, years not only in
Queensbury, but throughout the county...activity has leveled off to 27,000 to 29,000 calls per year number,
doesn't include Village of Lake George which accounts from 3,500 to 4,000 calls...noted every number the
department looks at, basically will run 50 to 64 percent in what the department handles in Town of
Queensbury for the whole county some numbers fluctuate depending what your looking at...biggest
concern is that the department can't take away personnel without seeing reduced services...a loss in
manpower would force department in deleting numerous things like investigators...concerned that the
budget was appropriated at the county... were lead to believe that the $275,000 was in the Queensbury
budget... Supervisor Brandt noted that he suggested earlier in the meeting to a proposal that might be
considered to try to resolve this...Councilman Caimano questioned where the $275,000 came from and
what is the number where the department would have to start laying ofLMr. Lamy noted that the $275,000
was created by the two political subdivisions, it was originally designed around the amount of manpower
that made the transition... $250,000 was the number that was originally created three years ago, this was re-
negotiated and it went to $275,000...Mr. Lamy noted the predicament is that the budgets are all adopted and
the loss of $275,000, the only place to take it from in the department's budget, is in personnel
services...Councilman Tucker noted that it's been said that if the Town of Queensbury phases out the sheriff
contract, Lake George might do this also, Mr. Lamy noted this is an issue. Councilman Tucker asked if
towns phase out their contracts, can the department survive on the service that the department will be able
to provide...Mr. Lamy noted level of service won't change provided that the number of employees aren't
taken away...Mr. Lamy noted he was instructed to include the $275,000...Councilman Goetz asked if
services are cut back, will we be hurt that badly.. .Mr. Lamy noted it depends on how much the staff would
be cut... Councilman Goetz noted she would like to see emphasizes from the county on preserving public
safety and cutting other places...Mr. Lamy stated that the buildup during the last four or five years is what's
holding them together at this point, noted the total patrol division counting investigators, sergeants, there
are sixty one people total for the whole county and they are servicing forty thousand plus the influx in the
summer... Councilman Tucker asked if committee has given any figures if the Town of Lake George
decides not to renew their contract...Mr. Lamy noted the concern is that whatever is does in Queensbury,
sets the tempo for that to happen in Lake George...biggest concern in adopted budget the only place the
$275,000 can come from is staff, will effect what happens on the street, noted that they are holding their
own. Councilman Monahan noted, thought the message was going to the county that the Town was
considering cutting back and in keeping with the original agreement made with the county years
ago...asked what is the area that the State Trooper covers in the area? Mr. Lamy stated his understanding is,
it depends on what patrol your talking about, they have a station patrol and interstate patrol. The station
patrol covers the same geographical area covered when they were in South Glens Falls includes Town of
Queensbury, Kingsbury, part of Town of Moreau, Hadley. They have a unique setup with State Police, cut
into teletype world for staffing because sheriff despatches all 911 calls, they communicate on frequency
maximum utilization of patrols who are out there irregardless of who you work for, this is very
effective... Councilman Monahan asked how many businesses have alarm systems coming in to Sheriff
Department and how many homes in Queensbury have alarm systems Noted they don't have anymore
coming into department physically that ring, have eliminated this through vendors because they have
answering services, they call the department and advise us that there is an alarm and then we
respond...alarm calls for services up in the last two years by 20 to 25 percent... Councilman Monahan asked
if we didn't have the police force to the extent that it is, out there, what would be the results from that? Mr.
Lamy noted that the numbers would escalate, there is no question that it would have an impact... Supervisor
Brandt noted the county does have other options, noted Queensbury is willing to go part way. Applauds the
effort of the police department, hopes a solution can be found.
