1992-04-29 SPECIAL TOWN BOARD MEETING APRIL 29, 1992 5:00 P.M. MTG#42 RES 251-257 BOARD MEMBERS PRESENT MICHEL BRANDT -SUPERVISOR BETTY MONAHAN-COUNCILMAN SUSAN GOETZ-COUNCILMAN NICK CAIMANO-COUNCILMAN PLINEY TUCKER-COUNCILMAN TOWN OFFICIALS KATHLEEN KATHE Supervisor Brandt opened meeting ... Councilman Monahan-Referred to meeting of the Library Board regarding the revised legislation ... noted that Glens Falls is concerned that their population may go way down, another community may get top heavy, taking most of the board members ... the suggestion was made that each municipality shall be entitled to a maximum of 7 and a minimum of 4 on the board... which I'm relaying to this Board for discussion. Councilman Caimano-Agrees with putting on a cap but would like to note, that if we, the Town is the overwhelming majority, then the Town should have control of the vote ... I think the maximum should be 8. After further discussion, Town Board agreed with the proposed revision of legislation. RESOLUTIONS RESOLUTION AUTHORIZING TOWN ATTORNEY TO PURCHASE ADDITIONAL SETS OF TOWN LAW BOOKS RESOLUTION NO. 251, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by Mr. Michel Brandt. WHEREAS, the Town Board is desirous of purchasing additional copies of the Town Law, NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes the Town Attorney to purchase five (5) additional sets of the Town Law, in an amount not to exceed $400.00, and to be paid for from the Books, Publications & Subscriptions Account, No. 01-1420-4050. Duly adopted this 29th day of April, 1992, by the following vote: AYES : Mrs. Monahan, Mrs. Goetz, Mr. Tucker, Mr. Caimano, Mr. Brandt NOES None ABSENT: None RESOLUTION TO TRANSFER FUNDS RESOLUTION NO. 252, 92, Introduced by Mr. Michel Brandt who moved for it's adoption, seconded by Mr. Nick Caimano. WHEREAS, a certain department has requested a transfer of funds, and WHEREAS, said request has been approved by the Town of Queensbury Accounting Office and the Chief Fiscal Officer, NOW, THEREFORE, BE IT RESOLVED, that the funds be transferred as listed below: TOWN ATTORNEY FROM TO AMOUNT 01-1420-4090 01-1420-4050 $400.00 (Conference Expense) (Books, Pubs. & Subscriptions) Duly adopted this 29th day of April, 1992, by the following vote: AYES Mr. Caimano, Mr. Tucker, Mrs. Goetz, Mrs. Monahan, Mr. Brandt NOES : None ABSENT: None RESOLUTION AUTHORIZING THE HIRING OF BRUCE E. CAZA RESOLUTION NO. 253, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by Mrs. Susan Goetz. WHEREAS, the Town Board of the Town of Queensbury is desirous of authorizing the hiring of Bruce E. Caza, to prepare a court ready appraisal, and WHEREAS, Mr. Bruce E. Caza advises that he can prepare a court ready appraisal at a maximum cost of $500.00 and testify in court at a cost of $50.00 per hour, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes the retaining of the services of Bruce E. Caza to prepare a court ready appraisal at a maximum cost of $500.00, and be prepared to testify in court at a cost of $50.00 per hour, and BE IT FURTHER RESOLVED, that the amount authorized to be expended in connection with the aforesaid appraisal shall not exceed the sum of $500.00 without further Town Board approval, and payment for the appraisal shall be from Account #32-8110-4830. Duly adopted this 29th day of April, 1992, by the following vote: AYES Mrs. Monahan, Mrs. Goetz, Mr. Tucker, Mr. Caimano, Mr. Brandt NOES : None ABSENT: None Supervisor Brandt-Would like to form a resolution to authorize us to advertise a newspaper ad for the new position for Planning, Zoning and Codes Administrator ... we have to authorize the money to be spent in advance... noted that the county civil service person has gotten back to us after reviewing the job description that we sent, we're down to some minor adjustments ... I would like to move with the advertising and keep the process moving along ... discussion held regarding the placement of ad's, Kathleen Kathe noted that it's scheduled to run in 25 newspapers across the State, Councilman Monahan suggested an attempt to run the ad in a Planning Magazine that she's familiar with and she agreed to work with Mrs. Kathe on that ... Councilman Monahan questioned whether there was a guarantee that this position is going to be an untested position ... Supervisor Brandt noted yes, that it's been verbally agreed to ... Councilman Monahan recommended making a 6 month probation period for the position ... Supervisor Brandt agreed ... the following resolution was proposed. RESOLUTION AUTHORIZING ADVERTISEMENT RESOLUTION NO. 254, 92, Introduced by Mr. Michel Brandt who moved for it's adoption, seconded by Mr. Pliney Tucker. RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes the expenditure, not to exceed more than $1,000.00, for advertising of the new position of Planning, Zoning and Code Administrator to be paid for from the Appropriate General Fund Accounts. Duly adopted this 29th day of April, 1992, by the following vote: Ayes: Mr. Tucker, Mrs. Goetz, Mrs. Monahan, Mr. Brandt Noes: None Absent: None Abstain: Mr. Caimano Supervisor Brandt-Noted that the West Glens Falls Fire Department has a 4th of July celebration and historically the Town of Queensbury provides the fireworks there. They've been dealing with a local man, Mike Young, who brought me a list of what he's going to provide for the display... he has the proper insurance, which is 1/2 million dollars ... he asked that we prepay the expense, at least a portion of the expense so that he can provide a better display. Councilman Goetz-Questioned whether he usually does this every year? Supervisor Brandt-I don't know the history, he did it last year and it was a good display. Councilman Tucker-This is the one that's done at Fireman's Field and the whole Town looks forward to this. Supervisor Brandt-Noted the budgeted amount, $4,500 and he's asking for three quarters of it with final payment at the end of it. Councilman Caimano-Noted concern with having enough insurance. Supervisor Brandt-He's saying he will provide a million dollars, we require a half million. Councilman Monahan-I thought we required more insurance than that. Supervisor Brandt-Would like to suggest that we pay 50 percent. After further discussion, the following resolution was proposed. RESOLUTION AUTHORIZING PAYMENT REGARDING FIREWORKS DISPLAY RESOLUTION NO. 255, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by Mr. Michel Brandt. RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes payment of 50 percent or $2,250.00 to Mr. Michael Young up front towards the $4,500.00 with the balance to be paid 15 days after the fireworks display, and BE IT FURTHER RESOLVED, that the Town Board is requesting with the first payment a Certificate of Insurance in the amount of one million dollars with the Town being an additional name insured on the Certificate. Duly adopted this 29th day of April, 1992, by the following vote: Ayes: Mrs. Monahan, Mrs. Goetz, Mr. Tucker, Mr. Caimano, Mr. Brandt Noes: None Absent: None Town Board held discussion regarding procedural process for interviewing, when the Town Board should take a direct role in the interview process, when to allow the Town Managers to conduct the interviews ... recommended, those positions that report directly to the Town Board, the Town Board should have full interview process, for those positions that report to managers, the possibility of department heads recommending a certain percentage of the applicants to the Town Board ... agreed, as a general rule, to look at each situation and then make determination of proper procedure. RESOLUTION CALLING FOR EXECUTIVE SESSION RESOLUTION NO. 256, 92, Introduced by Mr. Michel Brandt who moved for it's adoption, seconded by Mrs. Susan Goetz. RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Regular Session to enter Executive Session to discuss Potential Litigation and Personnel Matters. Duly adopted this 29th day of April, 1992, by the following vote: All Those In Favor: Ayes All Those Opposed: None Absent: None RESOLUTION TO RECONVENE RESOLUTION NO. 257, 92, Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by Mrs. Susan Goetz. RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Executive Session and enter Regular Session of the Town Board.
