PUBLIC HEARING-Pershing Ashey Coolidge Sewer
Improvements-Notice Shown

Supervisor Borgos-We are dealing with a 202B hearing to make
a number of small improvements to the Pershing Ashley
Coolidge Sewer Dist . we have retained the services of an
engineer and the report has been filed . We are looking at
an extension of approximately 200 feet and the addition of
oneman hole and the repair of a piece of the sewer pipe
which is apparenty broken on the top and we are
threatened with the possibility of collapse from above . The
estimated maximum cost of this project is $12 , 000. We would
propose that we would be having our water dept . crews
contract with the sewer dist . to perform the labor involved.
The proposed method of payment is by either BAN or long
term serial bonding. We are looking at approximately $3 . 00
per thousand of assessed valuation if it were to be paid off
at one time. A five year BAN we can reduce that to 60 cents
plus the interest or about 80 cents per thousand, if we do
lit five years or less or we can tie this to a much larger
bond issue and extend the period of payment over 20 or 30
years , if this is approved we will be looking at this over
the next several days .
Councilman Montesi-The reason for our concern is that. there
are only 32 people.
Supervisor Borgos-That is our concern. Twelve thousand
dollars is a relatively small amount for repair and a brief
extension.
Water Supt. Thomas Flaherty-That is the engineer ' s estimate .
Supervisor Borgos-We may be able to come in under that and
there is some extra money available in this year ' s
contractual fund so we may be able to reduce the amount that
we have to borrow, but in any event it will not be greater
than what has been reported.
Councilman Monahan-Tom, was that the engineer ' s estimate
with your forces doing the work or going out to bid .
Water Supt. Flaherty-With us doing the work.
Supervisor Borgos-Is there anyone here wishing to speak for
or against this project? Or does anyone have any questions?
If not . . .The Public Hearing is Closed. . .
Councilman Montesi-Is this the area that we did the TV line
review of this district or another one . . .
Water Supt. Flaherty-We did all of this district. That is
how we found the damaged line .
Councilman Montesi-Is there anything more that have to be
done in there, other than the damaged line?
Water Supt. Flaherty-That system has not had any maintenance
in the last 30 years, it is not in the best of shape , at
some point in time the problems over there are going to have
to be addressed . In this particular_ instance we found a
piece of main at the top of the sewer main that had
disintegrated, whether we extend the line to serve the
Cantwell property or not we would still be faced with the
responsibility of repairing the line or facing a law suit if
someone drove into a collapsed sewer .
RESOLUTION ADOPTING DETERMINATION OF NON-SIGNIFICANCE OF
PROPOSED IMPROVEMENT TO PERSHING-ASHLEY-COOLIDGE SEWER
DISTRICT
RESOLUTION NO. 371 , 1990 , Introduced by Mrs . Marilyn Potenza

WHEREAS , the Town Board of the Town of Queensbury is
presently considering the approval and authorization of an
improvement of the facilities of the
Pershing-Ashley-Coolidge Sewer District consisting of the
construction and installation of an extension of the sewer
line on Coolidge Avenue by approximately 200 feet and
construction of a new manhole at the upstream end of the
extension, and fund.inq the same , and
WHEREAS , the proposed action is an unlisted action under the
rules and regulations adopted by the Department, of
Environmental Conservation pursuant to the State
Environmental Quality Review Act, and
WHEREAS , the Town Board of the Town of Queensbury may act as
lead agent for review of potential environmental impacts in
accordance with the State Environmental Quality Review Act,
NOW, THEREFORE BE IT
RESOLVED, that after review of the engineering report and
sketch for the proposed improvement to the
Pershing-Ashley-Coolidge Sewer District described in the
preambles hereof , and the Environmental Assessment Form
prepared in connection with this action for possible
environmental impacts and after reviewing, in particular,
Section 617 . 11 of the Rules and Regulations of the
Department of Environmental Conservation, the Town Board of
the Town of Queensbury hereby determines that the
environmental effects of the proposed improvement to the
Queensbury Consolidated Water District will not be
significant, and
BE IT FURTHER
RESOLVED, that the Town Board hereby finds that. the proposed
responses inserted in Part II of said Environmental
Assessment Form are satisfactory and approved , and
BE IT FURTHER
RESOLVED, that the Town Board of the Town of Queensbury
hereby adopts the annexed notice of determination of
non-significance and hereby authorizes and directs the Town
Supervisor to sign, execute, and place the seal of the Town
of Queensbury upon the same , and
BE IT FURTHER.
RESOLVED, that the' annexed negative declaration is hereby
approved and the Town Clerk is hereby authorized and
directed to file the same in accordance with the provisions

RESOLUTION NO. 372 , 1990, Introduced by Mrs . Marilyn Potenza

WHEREAS , the Town Board of the Town of Queensbury, Warren
County, New York, has duly caused to be prepared, an
engineering report and sketch and estimate of cost for the
increase and improvement of the facilities of the
Pershing-Ashley-Coolidge Sewer District of the Town of
Queensbury consisting of the construction and installation
of an extension of the sewer line on Coolidge Avenue by
approximately 200 feet and construction of a new manhold at
the upstream end of the extension, all at a maximum
estimated cost of $12 , 000 , 00, the same also being more fully
described in an engineering .report and sketch prepared by
Rist-Frost Associates , P. C . , Consulting Engineers , and on
file with the Town Clerk of the Town of Queensbury, and
WHEREAS , said Town Board duly adopted a resolution on June
12 , 1990, calling a public hearing to consider said proposed
increase and improvement and estimate of expense , to be held
at the Queensbury Activities Center, 531 Bay Road,
Queensbury, Warren County, New York, on the 25th day of
June, 1990, at 4 :00 P .M. , and
WHEREAS , notice of said public hearing was duly published
and posted in the manner provided by law and proof thereof
has been submitted to said Town Board, and
WHEREAS , said public hearing was duly held at the time and
place aforesaid at which all persons interested were duly
heard, and
WHEREAS , said Town Board has duly considered all the
evidence given at such public hearing, and
WHEREAS , the said Town Board has reviewed the proposed
action under the State Environmental Quality Review Act and
has found that the water district improvement will not have
a significant environmental impact ,

SECTION 1 . Based upon the aforesaid engineering report
and sketch, and other evidence presented at the aforesaid
public hearing, it is hereby found and determined to be in
the public interest to provide for the aforesaid increase
and improvement of the facilities of the
Pershing-Ashley-Coolidge Sewer District of the Town of
Queensbury, Warren 'County , New York, as described in the
preambles hereof, at an estimated cost of $12 , 000. 00 and the
same is hereby authorized subject to the provisions of
Section 2 hereof.

SECTION 2 . Definite plans , specifications , and a
careful estimate of the aforesaid improvement are hereby
directed to be prepared and the Town Attorney is hereby
directed to assi,st in the preparation of the proposed
contract and to eubmit the same to this Town Board for
examination and approval .
SECTION 3 . The costs of the improvement shall be an
expense of the Pershing-Ashley-Coolidge Sewer District and
the improvement shall be constructed by employees of the
Town of Queensbury. The method of financing for this
improvement shall be by the issuance of serial bonds or a
bond anticipation note to be authorized by separate
resolution.
SECTION 4 . This resolution shall take effect
immediately .

WHEREAS , the Director of Purchasing for the Town of
Queensbury, Warren County, New York, duly advertised for
bids for the performance and completion of Contract No . 7
for the Central Queensbury Quaker Road Sewer District, which
contract provides for the purchase and installation of low
pressure pumping systems within the aforesaid sewer
district, as more generally identified in the proposed
contract documents in possession of the Town Clerk of the
Town of Queensbury, and
WHEREAS , the firm of The Belden Company, Inc . , submitted the
lowest bid for the said low pressure pumping systems
contract, a copy of the bid being presented at this meeting ,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury,
Warren County, New York, hereby approves and accepts the bid
of The Belden Company, Inc . , and awards the bid to The

insurance coverage through an insurance company licensed in

named as an additional insured and that the insurance
coverage contain a hold harmless clause which sha.11 protect

RESOLVED, that the permit or letter of authorization by the
Town Clerk of the Town of Queensbury shall , pursuant to the
Penal Law of the State of New York , Section 405 , provides :
the actual point at which the fireworks are to be fired
shall be at least two hundred feet from the nearest
permanent building, public highway or rall.raod or other
means of travel and at least fifty feet from the nearest
above ground telephone or telegraph line, tree or other
overhead obstruction, that the audience at such display
shall be restrained behind lines at least one hundred and
fifty feet from the point at which the fireworks are
discharged and only persons in active cliarae of the display
shall be allowed inside these lines , that all fireworks that
fire a projectile shall be so set up that the projectile
will go into the air as nearby [nearly] as possible in a
vertical direction, unless such fireworks are to be fired
from the shore of a lake or other large body of water, when
they may be directed in such manner that the fallincr residue
from the deflagration will fall into such lake or body of
water, that any fireworks that remain unfired after the
display is concluded shall be immediately disposed of in a
way safe for the particular type of fireworks remaining,
that no fireworks display shall be held during any wind
storm in which the wind reaches a velocity of more than
thirty miles per hour, that all the persons in actual charge
of firing the fireworks shall be over the age of eighteen
years , competent and physically fit for the task, that there
shall be at least two such operators constantly on duty
during the discharge and that at least two sodaaci.d or other
approved type fire extinguishers of at least two and
one—half gallons capacity each shall be kept at as widely
separated points as possible within the actual area of the
display.

WHEREAS, the Warren County of the Aging has presented to the
Town Board of the Town of Queensbury, an agreement which

provides " for, upon compliance with certain conditions set
forth therein, the payment to the Town of Queensbury in the
sum of $5 , 962 . 00 , for the year 1990 , for the conducting of a
transportation for the elderly program, and
WHEREAS , a copy of the aforesaid agreement has been
presented at this meeting, and
WHEREAS , said agreement has been reviewed , and is in the
form approved by the Town Attorney,
NOW, THEREFORE BE IT
RESOLVED, that the Town Board of the Town of Queensbury

Borqos-Introduced Mr. & Mrs . Adams and Carol Pulver. . . spoke
to the Town Board regarding a proposal for middle income
housing on a parcel of property before the Board for
rezoning. . .Ricciardelli property on Corinth Road . . .The
Warren Co . Planning Dept . gave approval , the Queensbury
Planning Dept , gave approval , the Town of Queensbury
Planning Board was on the fence . . . it has now come back to
us , the next step would be to set a public hearing on the
rezoning request . . .Mr. Adams , reviewed the proposed project,
it is a 22 acre parcel on Corinth Road. . . the construction of
. housing to middle income families to be conducted under the
sponsorship of a non-profit corporation Homefront and
hopefully with some assistance from the State to off set the
infrastructure costs . . . a subdivision project with 40 houses ,
single family detached averaging 1000 sq . ft . of finished
space to start with expansion within the house itself . . . this
would be afforded by the person in the income medium
$26 , 000. to 36, 000 dollars . . . spoke on clustering
concept . . .Councilman Monahan discussed the distance for side
setbacks . . .Mr. Adams noted that they would like to keep the
10 ' minimum setback and shrinking the total setback to 20 ,
instead of 301 . . .Councilman Monahan-what are your plans for
septic systems . . .Mr. Adams-they are being discussed with the
Dept., of Health, advised to try for a septic system that
would serve two units . . . want to preserve trees and green
space . . .Councilman Monahan-Will the banks give a mortgage on
a house sharing a septic system? Mr . Adams-yes . Councilman
Montesi-questioned if there will be more than one entrance
into the subdivision. . .Mr . Adams-there is no way to use this
property that we know of such that you can get more than one
entrance and exit into a major thoroughfare like that . . .
`— Councilman Montesi-What if you do not get state funding, who
has control and what is the price? Mr' . Adams-There is no
guarantee on the funding, we are informally encouraged by
our associates that this will be approved. . . .asked the
property be rezoned with condition for this implementation
of a specific public policy. . .Carla Corpus-This would be a
straight rezoning , there can be no conditions . . .what your
discussing is more of a zoning ordinance amendment, perhaps
an overlay district, floating zones which would take a great
deal of time and a separate process . . . Councilman
Monahan-spoke to board in regard to overlay zones . . .Carol
Pulver-The Town can pass a law stating that you will rezone

to do affordable housing, providing affordable housing
targets middle income and under . . .Mr . Adams-I want to make ,
we have no other interest in this land to get. it rezoned for
any purpose other than affordable housing . . . I wonder if
there would be a way for the rezoning to go through where ,
in a signed agreement with the town , the landowner agrees
with the Town that , that new zoning will not be used for
anything except affordable housing . . .Carla. Corpus-I have a
problem with that , when you rezone , it is permanent , you
could have an agreement but what would be the impedes if it
did not happen? Mrs . Adams-noted that if we do not have
progress on the zoning then we will not get the grant from
the state . . . spoke on the process of obtaining
grants . . .Councilman Monahan-questioned if there ' s a limit on
profit for those constructing the homes? Mrs . Adams-this is
bid upon, and they have to disclose everything . . .Carol
Pulver-this is rezoning a large track of land that we want
to have rezoned for the community benefit . . . Supervisor
Borgos-suggest that we go to the next stage which would be
to go to public hearing . . .Mrs . Adams-Spoke to the Board
regarding an antispeculation clause . . . 15 year
restriction. . .Councilman Montesi-Questioned if an out of
state contractor was used does this have any effect on the
funding? Mr. Ada-ms-No . Councilman Monahan-questioned the
second phase of the development . . .Mr . Adams-There are two
phases , out of the forty units , thirty have been applied for
from N .Y . State . . .the other ten unit , we. have made a
committment to Homefront that we will build these houses

WHEREAS , the Town Board of the Town of Queensbury is
presently considering an amendment , supplement, change,
and/or modification to the Town of Queensbury Zoning
Ordinance which was adopted on October 1 , 1988 , and more
specifically considering a petition for change of zone by
Anthony P . , or Carol A. Ricciardelli. , Jr. or Robert
Ricciardelli , whereby their parcel of land, known as Tax Map
No . 148-1-7 . 1 , would be changed from SR-1A to SR-20 , thus
modifying the existing Zoning Ordinance and map, and
WHEREAS , in order to so amend, supplement , change , modify,
or repeal the Ordinance , it is necessary to hold a public
hearing prior to adopting said proposed amendment ,

WHEREAS , the Town Board of the Town of Queensbury is
presently considering the amendment , supplementation,
change, or modification of the Zoning Ordinance of the Town
of Queensbury which was adopted on October 1 , 1988 , and more
specifically a change of zone of property owned by Anthony
P. , or Carol A. Ricciardeli , Jr . , or Robert Ricciardeli ,
their parcel of property being tax map no . 148-1-7 . 1 ,
changed from SR-1A to SR-20 , thus modifying the existing
Zoning Ordinance and map, and
WHEREAS , it would appear necessary to comply with the State
Environmental Quality Review Act in Connection with
conducting an environmental review of the proposed action
which consists of adopting the proposed amendment , and
WHEREAS , it would appear that the action about to be
undertaken by the Town Board of the Town of Queensbury is an
unlisted action,
NOW, THEREFORE BE IT
RESOLVED, that the Town Board of the Town of Queensbury
hereby indicates that it would desire to be the lead agency
in connection with any reviews necessary pursuant to the
State Environmental Quality Review Act , and hereby directs

of this desire , and that a lead agency must be designated

DISCUSSION HELD IN REGARD TO THE PROPOSALS ON ENGINEERING
QUALIFICATIONS FOR THE WATER DEPT. EXPANSION
Supervisor Borgos-Mr . Flaherty is here and has distributed
to us a copy of the three responses that came from our
request for engineering qualifications for the water plant
expansion, you will recall that we had set a dead line of
Monday, June 18th for these to arrive . Since that time we
have received phone calls from CT Male and we did have a
letter pending in our files from Sear Brown that said they
wanted to be notified when this was available , obviously the
public notice should have taken care of that . CT, called
and asked if they still could submit their qualifications, I
told them we would send them the information, I talked with
Paul Dusek, he said it was lip to the Town Board entirely .
We had by resolution set a dead line , if this Board wishes
to extend the dead line if it does I would suggest a few
days we may do that , if not we can say we had the dead line
and it is past and go ahead with it . . . Councilman Montesi-- I
would certainly welcome CT they have been involved in a few
of our interviews . . . Supervisor Borgos-I Would suggest a new
dead line of July 2nd . at 2 : 00 p.m. --
RESOLUTION TO EXTEND TIME FOR ACCEPTANCE OF QUALIFICATIONS

RESOLVED, that the Town Board of the Town of Queensbury
hereby extends the time for acceptance of qualifications for
professional engineering planning and designs services
related to the Town of Queensbury Water Treatment Facility
until July 2nd, 1990 at 2 : 00 P .M.

Supervisor Borgos-No , this is not a bid —Councilman Montesi
noted that he would notify by phone Stetson and Clough
Harbour regarding the proposal . . . y
Supervisor Borgos-Asked the Board if they would lease to
Niagara Mohawk the the siren portion of the signal tower
given to the Town by Ciba Geigy, for six months or a
little longer at $250 .00 per month. . . for use at the
Stewarts Bridge Dam N.Y . Fire and Signal would install this
at no cost to the Town. . .
Councilman Monahan-Asked that our insurance company be
notified of this transaction , due to the fact that we are
not in the leasing business . . .
Supervisor Borgos-If' we agree to this , that it be in a lease
form and in a form acceptable to the Town Attorney with
insurance provisions . . .

agrees to lease to Niagara. Mohawk Power Coy-p . a siren at

RESOLVED, that the Town Attorr-�ey must approve the form of
the lease and that insurance provisions must be made .
