Town Board held discussion and agreed to hold further budget workshop with final resolution on Thursday,
October 29th, 1992.
Attorney Dusek referred to Monday night's Town Board Meeting, noting that questions were raised
concerning the funding of the Crandall Library District and at that time, the Town Board requested me to
render an opinion concerning the matter. I would like to mention that I received a letter from Mark
Lebowitz, which states the Library's position concerning this. It was just faxed to me, it is addressed to the
Town Board and so I'd like to read it. It says, you have requested that the Crandall Library Board of
Trustees clarify a question which has arisen with respect to the proposed Crandall Public Library District
legislation. I have been asked to respond on behalf of the Board. Specifically, a concern has been
expressed regarding the possibility that, under some circumstances, the portion of the annual library budget
to be raised by local municipal appropriations could be increased without the necessity of first obtaining
voter approval of such increase. In preparing the legislation, it was the intent of the Library Board to
require voter approval of any change in the total sums to be raised annually from the three involved
municipalities. In reviewing the language of the legislation as enacted into law, it is the opinion of the
Library Board and myself that the legislation accomplishes the intent of the Board by requiring voter
approval of any change in that portion of the annual library budget which is to be raised from municipal
appropnatlOns. I hope this is responsive to your inquiry. (letter on file) In reference to my memo to the
Town Board regarding my opinion, you'll note it's lengthy but if you look at the bottom of the page, there's
an underlined version, a quick opinion for you. It basically says, it is my opinion that the position of the
Library Trustees concerning the proposed District's inability to increase the amount of appropriations to be
raised by taxes without further voter approval is reasonable and supported by the legislation. So I'm
agreeing with what Mark is saying, they can not increase appropriations, the amount of money to be raised
from municipalities unless they go back to the voters. (Memo on file)
Town Board held discussion and agreed with Attorney Dusek's opinion.
Town Board held discussion regarding proposed work for Peggy Ann Road and the following resolution
was proposed:
RESOLUTION RETAINING SERVICES OF VANDUSEN & STEVES

RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes the Town
Supervisor to arrange for the retaining of the services of Mr. Leon Steves to perform surveying services in
connection with the relocation of that part of Peggy Ann Road in the vicinity of it's intersection of
Wintergreen, and
BE IT FURTHER
RESOLVED, that the expenses to be incurred in connection with the surveying work shall not
exceed $5,000.00 and shall be payable from the general fund contingency account.
Duly adopted this 28th, day of October, 1992, by the following vote:
Ayes: Mr. Tucker, Mrs. Goetz, Mrs. Monahan, Mr. Caimano,
Mr. Brandt

Absent: None

Parks and Recreation
Planning, Zoning and Codes Enforcement
No further action was taken.
