MTG#17 RES. 167 BOARD MEMBERS PRESENT Supervisor Michel Brandt Councilman Pliney Tucker Councilman Susan Goetz Councilman Betty Monahan BOARD MEMBERS ABSENT Councilman Nick Caimano TOWN ATTORNEY Paul Dusek PRESS Moreau Press DISCUSSION HELD REGARDING LETTER TO DEC Attorney Dusek-Spoke to the Board regarding changes on letter to Thomas R Monroe, Department of Environmental Conservation. Councilman Monahan-Noted that there are no qualifying clauses in the letter. Supervisor Brandt-At the conference with DEC they are aware of your concerns and also made those concerns known that it had to be qualified. Attorney Dusek-Noted that he rather not put any qualifiers in right now. The Local Law allows us to accept it on our terms so we will be able to specify it when we take it anyway. The agreement with the other Towns will be clarifying that. Noted the critical areas would be where we are taking it from other people. Attorney Dusek noted the following changes to the letter. First paragraph second to last sentence, demolition debris may be accepted for disposal. Noted that, for disposal was not in the previous letter. Third paragraph first sentence, the proposal would be to use the paper sludge and construction and demolition debris as fill. I had originally had in, so that landfill could be brought to proper grade in different areas. Noted he would like to leave the letter as open as he can right now that's our chief purpose, to level, but we may have areas that we just want to fill. Added an additional sentence to end of third paragraph that says, acceptance of materials would benefit the closure process as indicated and also generate revenues that will be applied towards closure costs. Fourth paragraph, with regard to the use of paper sludge; It previously said with regard to the last use of the paper sludge. Stated that because he changed the sentence structure in the previous paragraph noted he had to modify this and added the following sentence, with regard to the use of the paper sludge in the capping process. Stated the changes are minor would like to keep the letter open so we can go in with a fairly broad request. RESOLUTION AMENDING LETTER TO DEC RESOLUTION NO. 167,93 INTRODUCED BY; Mr. Pliney Tucker WHO MOVED FOR ITS ADOPTION SECONDED BY: Mrs. Susan Goetz Supervisor Brandt-I would like a motion to accept those changes. Councilman Tucker-I'll move it. Councilman Goetz-I'll second it. Duly adopted this 2nd day of March, 1993, by the following vote: All Those In Favor: Ayes All Those Opposed: None Absent:Mr. Caimano Councilman Monahan-Noted that the Board ought to consider that all the money that comes in from C & D and paper sludge all be put in the capping fund and a very small amount go into the other account. Supervisor Brandt-Noted he will talk to Jim Coughlin regarding this. Attorney Dusek-The contracts with the other Towns currently requires you to put a percentage in the closure fund and a percentage in the operation equal to that of which your putting in for the community. Asked if Councilman Monahan would like to change the formula? Councilman Monahan-Thinks the Board has to start thinking about this. DISCUSSION HELD Deputy Town Clerk O'Brien-Spoke to the Board regarding the purchase of four (4) Sony transcribers for the Town Clerk's Office. On March 1st, Town Board passed a resolution for the purchase of Model #BM- 146. Received a phone call from Voice Technologies on March 3rd, stating that they have discontinued this model, but will replace it with Sony Model BM-246 at the same price and warranty. It was the consensus of the Board to go along with this change. Workshop held with Helen Otte, Town Assessor. No further action taken. On motion, the meeting was adjourned.
