SUPERVISOR STROUGH-No, it is for up to February 5, 2020 or earlier, depending on when
we get a law together that we’re comfortable with and then we’ll have a public hearing on that to
get some feedback and then we may redevelop it to what we think is good for the public. So this

is February 5, 2020 or earlier. The Warren County Planning Department has considered this
proposal and found that the project would not create any significant inter-municipal or

countywide impacts. And on or about July 23, 2019 the Queensbury Planning Board
considered the proposal and advised that the moratorium should clarify whether the ground-
mounted solar energy systems are commercial or residential and we’re going to be looking at
both I believe.
COUNCILWOMAN ATHERDEN-Yes, it includes both. It’s all ground-mounted so we can be
more specific or I mean more detailed and say commercial and.
TOWN COUNSEL HAFNER-If that’s their concern, that’s what we understood but the thing is
we can add those words in here. Let me find where to add that.
COUNCILWOMAN ATHERDEN-Just including commercial or something like that because
commercial is ground-mounted, it falls into both.
TOWN COUNSEL HAFNER-If you want to clarify what your intention was.
COUNCILWOMAN ATHERDEN-That was a comment from the Planning Board.

TOWN COUNSEL HAFNER-In section 3, we can add after systems in the second line, whether
residential or commercial.
COUNCILWOMAN ATHERDEN-That’s fine.
TOWN COUNSEL HAFNER-Right? That just says I think what your intention was.
COUNCILWOMAN ATHERDEN-Yes.
TOWN COUNSEL HAFNER-And that also meets the top of the Planning Board’s concern
about making it clear. Is that?
SUPERVISOR STROUGH-Yea.
TOWN CLERK BARBER-In the local law right?
TOWN COUNSEL HAFNER-Yes, in the local law, in section 3, the first sentence after ground-
mounted solar energy systems.
SUPERVISOR STROUGH-Well I think the Planning Board was asked if they would support us
going forward with a moratorium to develop the law about ground-mounted solar systems.
COUNCILWOMAN ATHERDEN-Right, yes.
SUPERVISOR STROUGH-And the way it was written, it was kind of awkward. I think they do
support this.
COUNCILWOMAN ATHERDEN-Yes.
SUPERVISOR STROUGH-And the question about commercial or residential.
COUNCILWOMAN ATHERDEN-That’s why it’s going to say whether, it says on there, it says
in the proposed moratorium proposal, it just says ground-mounted solar but we can say whether,
obviously suggesting the language whether commercial or rooftop or ground-mounted.
TOWN COUNSEL HAFNER-A member of the public could have this question and the Zoning
Board of Appeals could have that question.
COUNCILWOMAN ATHERDEN-Yes.
TOWN COUNSEL HAFTNER-So make the question go away so it’s not an issue.
COUNCILWOMAN ATHERDEN-Yes, correct.
SUPERVISOR STROUGH-Okay.
COUNCILWOMAN ATHERDEN-Good.
SUPERVISOR STROUGH-So, last time for anybody out there, anybody like to speak to the
moratorium, proposed moratorium on ground-mounted solar energy systems including
commercial and residential?
MR. WINTERS-I have one more.
SUPERVISOR STROUGH-Alright George.
MR. WINTERS-Is this going to interfere with putting solar on the dumps?
SUPERVISOR STROUGH-I don’t think so because if they’re talking about it now and they’re
still doing and finishing up their evaluation, they are at the point where they haven’t given us

their evaluation. The last I heard and just a few weeks ago, they were looking into connectivity.
In other words, they’re going to communicate with National Grid to see, you know, if substations
are needed. If so, you know, what kind, what type, who would install them, is there any grant
money for them or things like that I am assuming. So, that’s going to take some time. I expect
that we’ll have some kind of a law in place before those ground-mounted solars get to be
discussed. Even though, when they come before us, that’s going to be a six month or a one year
thing anyways. You know, by the time you have the public hearings and you iron out what
everyone’s concerns might be and things like that.
MR. WINTERS-I believe the solar on the dumps and stuff like would be very ideal.
SUPERVISOR STROUGH-Yea, I agree.
MR. WINTERS-Okay, thank you.
SUPERVISOR STROUGH-Thank you. Seeing no further public comments on the matter, I will

RESOLUTION ENACTING LOCAL LAW NO.: 6 OF 2019 TO ESTABLISH
A TEMPORARY MORATORIUM ON INSTALLATION OF GROUND-
MOUNTED SOLAR ENERGY SYSTEMS
RESOLUTION NO.: 265, 2019

WHEREAS, the Queensbury Town Board finds that it is in the public interest to prevent the
premature and inappropriate installation of any ground-mounted solar energy system that would cause
negative impacts to properties and therefore wishes to consider adoption of Local Law No.: 6 of 2019
entitled, "A Local Law to Establish a Temporary Moratorium on Installation of Ground-Mounted Solar Energy
Systems” which Law shall authorize a temporary moratorium on the installation of ground-mounted solar

energy systems located within all Town of Queensbury Zoning Districts through February 5, 2020 or any
earlier date that the Town Board adopts updated regulations relating to installation of ground-mounted solar
energy systems, and
WHEREAS, this legislation is authorized in accordance with New York State Municipal Home Rule
Law §10, and
WHEREAS, on or about July 19, 2019 the Warren County Planning Department considered the
proposal and found that the Project would not create any significant intermunicipal or county-wide impacts,
and
WHEREAS, on or about July 23, 2019, the Queensbury Planning Board considered the proposal
and advised that the moratorium should clarify whether the ground-mounted solar energy systems are

RESOLVED, that the Queensbury Town Board hereby enacts Local Law No.: 6 of 2019 "A Local
Law to Establish a Temporary Moratorium on Installation of Ground-Mounted Solar Energy Systems” which
Law shall authorize a temporary, six (6) month moratorium on the installation of ground-mounted solar energy

Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing with the
Secretary of State.

LOCAL LAW NO. 6 OF 2019
A LOCAL LAW TO ESTABLISH A TEMPORARY MORATORIUM ON
INSTALLATION OF GROUND-MOUNTED SOLAR ENERGY SYSTEMS
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF QUEENSBURY AS FOLLOWS:
SECTION 1. Subject and Authority
The Town of Queensbury hereby enacts a temporary six (6) month moratorium on the
installation of any ground-mounted solar energy system within all Town Zoning Districts. This Local
Law is adopted in accordance with Municipal Home Rule Law §10 and shall be as follows:
SECTION 2. Purpose
The solar industry has grown in recent years due to increased calls to reap the economic
and environmental advantages of renewable energy, the federal and state tax benefits and solar
industry innovation. There are no current solar energy system regulations in the Queensbury Town
Code. The Town Board is concerned about the possible increase in demand and the potential
impacts of ground-mounted solar energy systems and believes it is necessary to establish a Local
Law enacting a temporary six (6) month moratorium on installation of any ground-mounted solar
energy system in order to protect public health, safety and welfare. Recognizing this need, the
Town believes that such six (6) month moratorium is necessary to allow the Town Board time to

study these issues in order to establish appropriate ground-mounted solar system regulations. This
moratorium does not include roof-mounted solar systems.
SECTION 3. Moratorium
The Town of Queensbury hereby imposes a moratorium on the installation of ground-mounted
solar energy systems, whether residential or commercial, located in all Town of Queensbury Zoning Districts

until February 5, 2020 or any earlier date that the Town Board adopts regulations relating to installation of
ground-mounted solar energy systems. This moratorium shall not apply to ground-mounted solar energy
systems installed in the Town of Queensbury prior to the effective date of this Local Law.
SECTION 4. Extensions
This moratorium may be extended for such additional periods as the Town Board may determine
to be necessary to protect the public health, safety and welfare of the citizens of the Town of Queensbury.
SECTION 5. Termination

This moratorium shall be terminated earlier than February 5, 2020 upon enactment of any local
legislation which adopts regulations relating to ground-mounted solar energy systems.
SECTION 6. Effective Period
This Local Law shall take effect immediately upon filing in the Office of the New York Secretary
of State as provided in Municipal Home Rule Law §27 or as otherwise provided by law.

WHEREAS, in accordance with New York State Town Law §64(2), the Queensbury Town Board may
authorize the sale of items which are no longer needed by the Town or obsolete, and
WHEREAS, the Town’s Budget Officer requested that Town Departments advise of any surplus items
in their respective Departments and the Town Budget Officer did receive lists of items from various
Departments which are considered to be surplus, and
WHEREAS, the Budget Officer advised the various Town Departments of the surplus items and did
not receive any requests from the Departments for such surplus items and therefore has requested Town Board
authorization to sell the surplus items by using the auction company GovDeals to dispose of such surplus

RESOLUTION AUTHORIZING RELEASE OF ESCROW FUNDS TO
TRA-TOM DEVELOPMENT, INC., IN CONNECTION WITH
DEDICATION OF CROSS COURT AND RICHMOND HILL DRIVE IN
BARRINGER HEIGHTS SUBDIVISION

WHEREAS, by Resolution No.: 364,2008 the Queensbury Town Board authorized the
dedication of Cross Court and Richmond Hill Drive (Roads) in the Barringer Heights Subdivision,
and
WHEREAS, at the time of dedication, the Developer, Tra-Tom Development, Inc., provided
the Town with $125,000 cash escrow to ensure placement of the top coat on the roads consistent with
the Town Highway Superintendent’s requirements along with an additional $25,000 cash escrow for
the Town to hold so that the Highway Superintendent could use such funds toward drainage costs that
may arise in the development, such sums to be held in escrow in accordance with the terms of an
Escrow Agreement, and
WHEREAS, as required by the Escrow Agreement, the Town deposited the funds in an
interest bearing account, and
WHEREAS, at the Town Highway Superintendent’s recommendation, by Resolution No.:
468,2018 the Town Board authorized the return of the $25,000 cash escrow plus any earned interest
that had been held toward drainage costs to Tra-Tom Development, Inc., and
WHEREAS, by Memorandum dated July 24, 2019, the Highway Superintendent has advised that the
Roads have met the specifications set by the Town Highway Department and therefore, has recommended that
the Town Board authorize the release of the $125,000 held by the Town in accordance with the Escrow
Agreement, and
WHEREAS, the Town Board wishes to therefore authorize the refund of such funds to Tra-Tom
Development, Inc. as required by the Escrow Agreement,
NOW, THEREFORE, BE IT
RESOLVED, that, consistent with the Escrow Agreement, the Queensbury Town Board hereby
authorizes the Town Budget Officer as Escrow Agent to return the funds that have been held in escrow to

published an advertisement for bids for the Truck, and

WHEREAS, on July 11, 2019 the Purchasing Agent received bid information for the Truck from

the New York State Pro Vehicle Market Place and on July 9, 2019, the Purchasing Agent duly received
and opened all bids received by the Town for the Truck, and
WHEREAS, the Water Superintendent and Purchasing Agent reviewed such bids and have
recommended that the Town Board authorize the bid award to the lowest, responsible bidder, the New
York State Office of General Services Procurement Program Group 40451, Award 22898, for a 2019
Ford F-150 Short Box 4WD Pick-up Truck for an amount not to exceed $24,321.06 from Metro Ford
Sales, Inc., and
WHEREAS, the Water Superintendent has also requested authorization to purchase needed
ancillary equipment for the Truck to make it Water Department ready for a total amount not to exceed
$1,500,

RESOLVED, that the Queensbury Town Board hereby accepts and awards the lowest, responsible

TO QUEENSBURY PLANNING BOARD AND REQUESTING
PLANNING BOARD TO SEEK LEAD AGENCY STATUS

WHEREAS, Apex Capital, LLC submitted a zoning change application to the Queensbury Town
Clerk’s Office on July 11, 2019 to allow for the expansion of the West Mountain Ski Area parking lot, and
WHEREAS, Apex Capital, LLC has also submitted to the Town a site plan review application for the
expansion of the West Mountain Ski Area parking lot, construction of a zip line attraction, and approval of an
existing mountain biking venue, and
WHEREAS, the applications have been reviewed by the Town Planning Staff and deemed complete
for purposes of review, and
WHEREAS, applications for zoning changes and site plan review are subject to Warren County
Planning Department review in accordance with §239-m of NYS General Municipal Law, and
WHEREAS, applications for zoning changes that include projects requiring site plan review may be
forwarded to the Town Planning Board for recommendations in accordance with §179-15-040 of the Town
Zoning Ordinance, and

WHEREAS, following such recommendations, the Queensbury Town Board will review the
application and take such other action as it shall deem necessary and proper, and
WHEREAS, prior to making a decision about whether to approve the zoning change, it is necessary to
conduct a review under the New York State Environmental Quality Review Act (SEQRA), for potential
environmental effects, and
WHEREAS, the projects proposed with the zoning change application are also subject to SEQRA
review and the Planning Board has the necessary knowledge and experience to conduct any necessary SEQRA
review and evaluate the potential environmental impacts for both the proposed zoning change and the proposed
project,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Clerk to
forward Apex Capital, LLC’s application received by the Town Clerk’s Office on July 11, 2019 to the
Queensbury Planning Board for SEQRA review, report and recommendation, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby consents to the Planning Board acting as Lead Agency for
any needed SEQRA review of this project, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute any
necessary documents and the Town’s Department of Community Development to notify, if and when
appropriate, any other Involved Agencies of the Town Board’s consent to the Planning Board serving as Lead
Agency for SEQRA Review of the project and the Town Supervisor, Town Clerk and/or Department of
Community Development to take any other necessary actions to effectuate the terms of this Resolution.

WHEREAS, the Fund for Lake George is a not-for-profit, privately funded organization dedicated
to the protection of Lake George, its water quality and the overall health of the Lake George Watershed,

WHEREAS, the Fund for Lake George has awarded certain grant funding related to projects to
help protect Lake George’s water quality, and
WHEREAS, the Queensbury Town Board is considering establishing a North Queensbury/Rockhurst
Community Sewer District (Project), and
WHEREAS, the Fund for Lake George wishes to grant $25,000 to the Town toward such Project,
and
WHEREAS, the Town wishes to accept such Grant funds to be used toward the costs of engineering
studies and/or the preparation of a Map, Plan and Report,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts up to $25,000 in Grant funding from
The Fund for Lake George toward establishment of a North Queensbury/Rockhurst Community Sewer District
to be used toward the cost of engineering studies and/or preparation of a Map, Plan and Report, and
BE IT FURTHER,
RESOLVED, that the Town Board further establishes estimated revenues and expenses as follows:
Increase Revenue in Other Economic Assistance Account No.: 001-0000-51989 by
$25,000; and
Increase Expenses in Engineering Account No.: 001-1440-4720-0038 by $25,000;
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend
the 2019 Town Budget, make any adjustments, budget amendments, transfers or prepare any documentation
necessary to establish such appropriations and estimated revenues and effectuate all terms of this Resolution,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any
needed Agreement between the Town and The Fund for Lake George and/or any other needed documentation
and the Town Supervisor, Town Counsel and/or Town Budget Officer to take such other and further action
necessary to effectuate the terms of this Resolution.

WHO MOVED ITS ADOPTION

WHEREAS, the Fund for Lake George is a not-for-profit, privately funded organization dedicated
to the protection of Lake George, its water quality and the overall health of the Lake George Watershed,
and
WHEREAS, the Fund for Lake George has awarded certain grant funding related to projects to
help protect Lake George’s water quality, and
WHEREAS, the Queensbury Town Board established the North Queensbury Wastewater Disposal
District No. 1 – Dunham’s Bay to serve 71 properties in the Dunham’s Bay area of the Town (Project), and
WHEREAS, the Fund for Lake George wishes to grant $30,000 to the Town toward such Project
for septic system upgrades, and
WHEREAS, the Town wishes to accept such Grant funds to be used toward the costs of such septic
system upgrades,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts up to $30,000 in Grant funding from
The Fund for Lake George toward septic system upgrades in the North Queensbury Wastewater Disposal
District No. 1 – Dunham’s Bay, and
BE IT FURTHER,
RESOLVED, that the Town Board further establishes estimated revenues and expenses as follows:
Increase Revenue in Other Economic Assistance Account No.: 053-0000-51989 by
$30,000; and
Increase Expenses in Misc. Contractual Account No.: 053-8130-4400 by $30,000;
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend
the 2019 Town Budget, make any adjustments, budget amendments, transfers or prepare any documentation
necessary to establish such appropriations and estimated revenues and effectuate all terms of this Resolution,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any
needed Agreement between the Town and The Fund for Lake George and/or any other needed documentation
and the Town Supervisor, Town Counsel and/or Town Budget Officer to take such other and further action
necessary to effectuate the terms of this Resolution.

5.0 PRIVILEGE OF THE FLOOR (LIMIT – 4 MINUTES)
MR. WINTERS spoke regarding the new traffic lights in front of the Queensbury School Buildings
and feels that it’s really working well.
SUPERVISOR STROUGH noted that the school is happy with it and most of the general public has
been positive.
MR. WINTERS spoke regarding two lights on Main Street that are not working.
SUPERVISOR STROUGH noted that he will make a visit and follow-up on it.
MR. WINTERS referred to the new STAR program changes and recommended that she attend a
Town Board meeting to explain it in detail.

SUPERVISOR STROUGH agreed to have our Assessor, Teri Ross attend the next Town Board
meeting.
MR. WINTERS noted concern about the STAR changes affecting the seniors. Would like to thank
our State Representatives who allowed this and voted themselves a sixty-three (63) percent raise that
we’ll be paying for every day.

COUNCILMAN METIVIER (WARD I) - NOTHING TO REPORT
COUNCILWOMAN ATHERDEN (WARD II)
Announced the next meeting for the Climate Smart Community will be held Wednesday,

August 14 at 10:30 in the Supervisor’s Conference Room.
COUNCILWOMAN SWITZER (WARD IV)
I would like to give a shout out to our Water Superintendent Chris Harrington for a job
well done with the completion of the repainting of the five (5) water tanks. It was done
within eleven months; it did not include the winter season and we did not have to go out
and borrow the money. This all came from our fund balance, which sometimes we get
criticized for. So this all came from funding and careful planning and a little bit of out of
the box thinking. I don’t think we do enough to recognize all of those behind us in the
scenes and Chris is one of those people who does a lot and keeps our drinking water safe
and keeps it at obviously a very reasonable price for all of us and so I wanted to thank
him for his work and his department as well.
SUPERVISOR STROUGH - Report to Community and Board
Met with Steve Joiner; he has the ground-mounted solar on Haviland Road which he owns
outright so he wanted to clear up some misinformation.
Met with Stu Allen who came to the office to discuss the Glen Lake Management Plan.
We met with Department of Transportation, National Grid and Chris Harrington to discuss
about replacing the waterline on Ridge Road between Quaker Road and Cronin Road.
Attended Ribbon Cutting for Glen’s Tree Cutting.

Review topics held on the July 22 workshop.
Met with the Queensbury Senior Citizens Administration to discuss a possible pavilion.
Attended information meeting at the Hidden Lake Girl Scout Camp on Luzerne Road in Lake
Luzerne.
A WISP questions and answer session was held at the town.
Rockhurst Community Septic Meeting was held.
Spoke to DEC Representative, Koan Tang about the Lake Plan and Lake George Basin.
Spoke with Connie Goedert, Cemetery Superintendent about a site visit to Ogden Cemetery
that the Town has agreed to take ownership.
Spoke to Jeff Speich from DEC about grant funding. Jeff does outreach to communities and
they have grants that offer trees for tributaries, tree bank restoration, curb and community tree
pruning, arch management. I thought he would be best to sit down with Parks and Recreation
and some members of the Planning Board to explain what is available.
Attended the Lake George Land Conservancy’s President’s Reception and read thank you
note from them for the town’s contribution and support.
Attended the Warren County Safe and Quality Bicycle Organization, an advisory committee
for the County.
Spoke to New York State DEC to discuss the Rush Pond beaver dam issue.
Drafted a letter to the County requesting lowering the speed limit on Bay Road. If the Town
Board agrees and feels it’s worthy, I will send along to the County.

Met with the Highway Department to discuss personnel issues, the highway garage proposal,
upgrading culverts, the radar speed signs and a request received about the Town taking
ownership of the Top of the World private drive.
Spoke with Chris Harrington regarding hiring professional help for guidance as we renew our
lease agreements for the wireless transmitters for the water towers.
Spoke to Chris Belden, Warren County Planner regarding grant monies to help develop a
comprehensive integrated master plan for Lake George Basin.
Spoke to West Signs to update the School signs to recognize the Queensbury Baseball State
Championship of 2018.

Attended the Lake George Land Conservancy’s 20 Gala at the Inn at Erlowest.

Attended the 100 Anniversary of New Way Lunch.
Received invite from Oneida-Herkimer Solid Waste Authority to tour their new food to

energy facility in Utica, New York Monday September 9 from 11 to 1 o’clock and I will
forward this on to the Board.
