1995-12-11 SPECIAL TOWN BOARD MEETING DECEMBER 11, 1995 4:10 p.m. MTG. #66 630-637 TOWN BOARD MEMBERS PRESENT Supervisor Fred Champagne Councilman Betty Monahan Councilman Theodore Turner Councilman Connie Goedert Councilman Carol Pulver Supervisor Fred Champagne-Opened the meeting. DISCUSSION 2.1 HUDSON POINTE REZONING Alan Oppenheim present Discussion held regarding neighborhood concern on buffers and landscaping...neighbors have requested a 75' buffer on Corinth Road and on the East side another 75' on the NC zone with screening and leaving 17,893 square feet on that lot and they have to join that lot with the other lot... (map used) ... discussed that the neighborhood commercial zone is to blend in with the neighborhood, architecturally and site development wise and landscaping should blend with the PUD itself...discussed having signage drafted into the buffer zone... Supervisor raised concern over 75' buffer on Corinth Road for a commercial zone, suggested 50' buffer on Corinth Road side.. .Mr. & Mrs. Brown discussed their back yard backing up to a buffer zone which is fifty fooL.concerned over having the horses close to a possible day care center...Mr. Oppenheim noted that he felt that the day care would be in Hudson Pointe, but noted if it was in that area fencing would be looked into....suggested a screening plan (trees) in that area (easterly edge) that everyone can live with...discussion was held regarding ingress and egress from Corinth Road it was the opinion of the board not to have any access from Corinth Road on to the NC zone...Executive Director Martin spoke to the Board about Access Management. Town Board agreed to bring this to another workshop with a fifty foot buffer zone on Corinth Road and seventy five foot buffer zone on the easterly side and have Mr. Oppenheim bring in a screening plan to scale...and notify the residents of the workshop...proposed date January 8th... 2.2 FIRE AND EMS CONTRACTS Discussion held regarding 1996 Fire and EMS contracts...Discussion held regarding mutual aid, Councilman Goedert-we are obligated to do mutual aid if you gain financially according to Lee Burns, noted that Lake George Emergency and W.G.F. Emergency are the only agencies that are certified ALS by themselves. Bay Ridge and No. Qsby. are certified ALS through Ares, (Adirondack Regional Emergency Services) when they sign a contract through Ares they sign a contract for mutual aid. The question is will the State law override that contract because the State says you only have to do mutual aid if you get a financial gain. ..If we are not going to bill the Town of Queensbury residents that there needs to be a paragraph in the contract that allows Bay Ridge only bill outside Warren County. Attorney noted that the way it is now written will allow Bay Ridge to enter into a contract with Fort Ann, Whitehall foreinstance and provide a service the same way they provide a service for the Town of Queensbury. Board requested that this be put in every rescue contract..and that the contracts be brought back to the Town Board for approvaL.. Supervisor Champagne stated that we will study 3rd. party payments in the future. Discussion held regarding stabilization funds whether they should be held by the fire companies or the Town, Councilman Turner suggested that the Board look at this and we are going to have a one year contract and then a three year contract, let's evaluate it over this one year contract and have a conclusive answer the next time around. Board agreed...Discussion held regarding five year plan, Supervisor Champagne, we need something in writing that we can act on. Councilman Goedert -noted she did not want the companies obligated to what is on the 5 year plan...Councilman Monahan-noted that there would be changes made each year with the list....Councilman Goedert-suggested that there be a committee formed with members of the Town Board and along with an officer of each agency and talk about their plans. Councilman Pulver- noted she felt it should be done within the companies themselves, it has to be the company that decides what they need to purchase...consensus of the Board to add the 5 year plan to the contract...Attorney Dusek, reviewed with the Board the final contracts that will be going to public hearing. RESOLUTION NO.: 630.95 INTRODUCED BY:Mrs. Betty Monahan WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, there has been duly established in the Town of Queensbury a Fire Protection District known as the Town of Queensbury Fire Protection District embracing the entire territory of said Town, and WHEREAS, the Town Board of the Town of Queensbury has previously arranged to provide fire protection therein by an agreement expiring December 31, 1995 with the Bay Ridge Volunteer Fire Company, Inc., and WHEREAS, the said Town Board is desirous of entering into a new agreement with the said Fire Company for 1996, and WHEREAS, ~184 of Town Law requires a public hearing upon the contract provisions for such fire protection, and WHEREAS, the said agreement is presented at this meeting, NOW, THEREFORE BE IT RESOLVED, that a public hearing be had with reference to the proposed agreement for the furnishing of fire protection for the Town of Queensbury Fire Protection District on December 27th 1995 at the Queensbury Activities Center, Town of Queensbury, 742 Bay Road, Queensbury, New York, at 7:00 p.rn., and that notice of such hearing be published in the Post-Star Newspaper, once at least 10 days prior to the said hearing, and that such notice shall specify the time when and the place where said hearing will be held and describe in general terms the proposed agreement and be in the form presented at this meeting, and BE IT FURTHER, RESOLVED, that copies of the proposed agreement be kept and maintained in the Town Clerk's Office and be made available for inspection by any interested party. Duly adopted this 11th day of December, 1995, by the following vote: AYES Mrs. Pulver, Mrs. Monahan, Mr. Turner, Mr. Champagne NOES None ABSENT: None ABSTAIN: Mrs. Goedert 2.4 MONUMENT RESTORATION President of the Adirondack Civil War Round Table Chris Heidorf - spoke to the Town Board regarding the restoration of the Soldiers' Monument ...listed the names of those on the restoration committee (pamphlet on file) spoke of the historical significance of the monument, the historical background, the previous conservation history dating back to 1872 its current condition: 1. paint pealing 2. small cracks at base 3. joints in the base stones need repointing 4. lettering on the stone tablets has fallen off 5. The officer's sword is missing 6. the sandstone portions are friable and fragile 7. portions of stone near the cannons has spalled 8. surface staining is apparent on the main shaft... Restoration objectives 1. remove paint from monument surfaces 2. replace deteriorated stone tablets on the east and west faces with bronze tablets 3. replace stone eagle with bronze replica 4. repair cracks at base 5. repoint all open joints 6. replace missing officers sword 7. treat and seal all sandstone surfaces. Projected costs sixty to eighty five thousand dollars with conservation study to run as high as ten thousand...also spoke to the board about a potential perpetual fund being established... Sandy Hill donation of $10,000 Evergreen Bank $1,000 Glens Falls Foundation also working on upcoming events...Glens Falls 20,000 plus 10,000 in Hud Grant funds and Post Star giving free publicity for restoration project and asking Queensbury for $20,000 ...(photos shown) Discussion held regarding the ownership being that of the Town, questioned was raised if the monument could be jointly owned by the City of Glens Falls, this will be researched.. .discussed bid specifications and liability Insurance... 2.3 BUILDING MAINTENANCE MECHANIC Discussed new position building maintenance mechanic at 11.50 per hour...have resolution ready for the next meeting.
