Sleight Justice of the Peace Meredith S. Bentley Justice of the Peace Curtis Lampson Councilman Raymond Walkup Councilman The board convened at 7:30 P.M. 211 There were also present fifteen people from the various fire companies of the Town. The Clerk read the notice of the public hearing. Proof of publ, ing the notice of public hearing was filed. The Supervisor asked if anyone present was opposed to entering into the contracts with the various fire companies of the Town, and no one appeared opposing the entering into such contracts and those present appeared to be in favor thereof. The following resolution was introduced and adopted. �" - actea`Bnt1. y:-1ceewRlo# ».,N seconded by Mr. Sleight, Justice of the Peace: WHEREAS, there has been duly established in this town a fire pro- tection district known as the Town of Queensbury Fire Protection District embracing all the territory in said town as is more fully described in Resolution dated August 28, 1948 establishing said district; and WHEREAS it is proposed that a contract be entered into, with each of the following fire companies: North Queensbury Volunteer Fire Com- pany, Incorporated, Queensbury Central Volunteer Company, Inc. , West Glens Falls Volunteer Fire Co. not Inc. , South Queensbury Volunteer Fire Company Incorporated and Bay-Ridge Volunteer Fire Company, Inc. , for the furnishing of fire protection to said district, and WHEREAS due notice has been given of a public hearing to be held at the Town Clerk's office i n said town on the 5th day of July, 1949, at 7:30 P.M. , to consider such contracts , the notice duly specifying".the time and place of the hearing as aforesaid and giving in general terms the proposed contract; and all persons interested and appearing having been heard, it is hereby RESOLVED that the town board contract with each of said fire com- panies for fire protection to said district, a copy of said contract is hereto annexed; and it is further 1 RESOLVED that said contracts be executed on behalf of this Town Board. Duly adopted by the following vote: 1 Ayes - Mr. Walkup, Mr. Bentley, Mr. Lampson, Mr. Sleight, Mr. Harris Noes- none The following is'-ja copy` df"the terms and conditions pf,_such contract: 1 Y , I WITNESSETH: WHEREAS there has been duly established in said Town a fire protection district embracing all of the territory of said Town of Queensbury, and WHEREAS, the town board of the Town of Queensbury after public hearing held pursuant to Sec. 184 of the Town Law, duly passes a reso- lution authorizing the Town Board of said Town to execute a contract on behalf of said fire protection district with the party of the second part for fire protection in said district upon the terms and provisions herein .set forth;' and WHEREAS, this contract has also been duly authorized by the off- icials of the party of the second part. NOW, THEREFORE, for and in consideration of the covenants and j agreements herein contained, the party of the first part does by this contract engage the party of the second part to furnish fire protection to the said district as herein provided, and the party of the second part agrees to furnish said fire protection in the following manner, to wit: 1. The party of the second part shall at all times during the period of this contract maintain at least one piece of equipment, motorized and equipped for C-2 rate, cell houses for year around service, i I 1 and be prepared for and be subject to call for attendance upon any fire occurring In the chartered area of the party of the second part when notified by an alarm or telephone call from any person within the said chartered area of the party of the second part, and they shall respond and attend upon the fire without delay with all its equipment that maybe necessary and suitable for the control and extinguishing of such fire, and the saving of life and property. And when needed and called by a member of the Town Board or any official of any other fire company within the fire protection district of the Town of Queensbury,, they shall respond with all equipment and use all its resources to ex- tinguish and control the fire and to save life and property of all or any within the Town of Queensbury; that, when said party of the second I part is called and attending the fire outside of its chartered area the proper officers of the fire company within its chartered area where the fire occurs are to have full charge and control of eliminating and ex- tinguishing the fire, or any work or procedure that may be necessary in connection with the same, and the party of the second part is not to be charged with any neglect or liability because of the taking of orders or following the directions of the officer in charge of such fire, or impassable roads or other conditions that may make it unreasonable to transfer fire fighting apparatus. 2. The party of the first part agrees to pay to the party of the second part the sum of Two Thousand .Dollars ($2000.00) annually for furnishing fire protection as herein provided for said fire protect- ion district. Payment to be made, $1,0,00.00 on the 1st day of February . .following the execution and delivery of this agreement, provided six months has elapsed, if mot, then six months from delivery and accept- ance of this agreement, and $1,000.00 one year from the date of said agreement, and the same amounts on same dates each year during this contract, and no part of said amount is to be deducted if the party of the second part uses reasonable diligence and coopation .in .extinguish- ing and controlling any fire as above set forth. This contract shall be for a period of five years from date here- of. Both parties hereto covenant and agree that they will use their j best efforts at all times in cooperating to control and extinguish any fire doing damage in the said fire protection district, .and this agree- ment is not to be cancelled, revoked or terminated by either party within five years unless it is proved that one party of the other has been wilfully negligent and neglectful in reference to the terms pro- vided for herein, after due hearings and deliberations. I It is further agreed between the parties, hereto that if the party of the second part shall fail to fulfill and perform the conditions of this contract for a period of three months from its date, then the town board may allot and pay to one or more of the fire companies of said town for furnishing fire protection to the chartered area of the party of the second part, all or any part of the money due, or to be- come due, under this contract for the period for which such service is rendered. This agreement is binding upon the respective parties, their suc- cessors and assigns.
