The parties of the second part give and grant to the party of the first part, the right to dump rubbish in the low part of the right- of-way lying between the seven acre parcel and the Ridge Road and to fill the same to a level where trucks and other vehicles may pass over the right-of-way and consent that the party of the first part may take soil and fill from the strip of land, not exceed One hundred fifty(150) feet in width on each side of the 100 foot right-of-way, provided, how- ever, that no fill shall be taken from the north side of the right-of- way within 160 feet of Ridge Road and upon the further condition that �-- where fill is taken on the north side of the road, the `lands of the parties of the second part shall be left level with the right-of-way j and dump, and upon the further condition that the taking of fillfrom the la nds of the pparties of the second part south dbf the right-of-way i shall commence at Ridge 'Road and that such lands shall be left 16 inches above the level of Ridge Road. 3. The party of the first part as ,part of the consideration for such conveyance gives and grants to the parties of the second part, the right to cut and remove from the right-of-way and the seven acre parcel all standing wood and timber *ithin five years from the date of this agreement, excepting that whenever it becomes necessary for the proper operation of the dump and the construction of fire lanes , the party of the first part may, after giving a reasonable notice or notices to the parties of the second part to cut and remove such timber and brush, may cut and remove the same from the right of way and the seven acre parcel notwithstanding the right herein granted to the parties of the second part to cut all standing timber and wood, within five years from the date hereof, from the right of way and the seven acre parcel. 4. The party of the first part agrees to use all reasonable precautions to prevent the spread of fire from the premises on which the dump is to be established to adjoining lands of the parties of the second part and to prevent the dumpin* of garh6ge and other objection- able materials which will cause odor and danger to health. BE IT ]RESOLVED this 4th day of August, `1950, by the Town `Board of the Town`"of Queensbury, Warren County, New York, as follows: 290 Section 1. That,,pvrsuant to the Local Finance Law of the State of New York, the Town of Queensbury, Warren County, New York, for the pur. pose of providing funds for the purchase of a site for a town dump and for the improvement thereof shall issue and sell a� budget note in the amount of $1,200.00 to mature on the lst day of 4ugust, 1951. Section 2. That, except as herein specifically prescribed, said note shall be of the date, terms, form, contents and place of payment and at a rate of interest not exceeding five per centum per annum as may be determined by the Supervisor, consistent, however, with the pro - visions of the Local Finance Law of the State of New York, and shall be executed in the name of the said Town by the Supervisor and the seal of the Town shall be attached thereto. Section 3. That said note shall be sold at private sale by the -- Supervisor at a price not less than par value and accrued interest, if any, and upon the due execution and sale of said note the same shall be delivered to the purchaser upon the payment by him to the Supervisor of the purchase price in cash; and the receipt of the Supervisor shall be a full acquittance to such purchaser who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Queensbury, Warren County, New York, are pledged to the punctual payment of prin- cipal of and interest on said note. Section 5. This resolution shall take effect immediately. The foregoing resolution was duly put to a vote by the Town Board which resulted as follows : H.
