091.92 RESOLUTION WAIVING VARIANCE APPLICATION FEES RESOLUTION NO.:91, 92 INTRODUCED BY: Mr. Pliney Tucker WHO MOVED ITS ADOPTION SECONDED BY: Mr. Michel Brandt WHEREAS, the Town Board of the Town of Queensbury, by previous resolution, determined that Section 179-77 of the Town of Queensbury Zoning Ordinance, which makes lots in subdivisions approved by the Planning Board and filed with the Warren County Clerk's Office non-conforming on the basis of area and results in non-issuance of building permits, should not be enforced against any subdivision lot in any subdivision approved by the Planning Board since 1982 as it was not enforced previously, and WHEREAS, the Town Board of the Town of Queensbury realizes that some developers may still wish to seek variances from this particular clause in the Zoning Ordinance, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury, after careful consideration, has determined that it would be appropriate for the Town of Queensbury to waive any Town fees that are normally assessed for variance applications in connection with variances from the area requirements of the Zoning Ordinance for those subdivisions which were approved by the Planning Board after 1982 and before October 1, 1988, and BE IT FURTHER, RESOLVED, that this waiver of fees shall apply to all variances applied for since January 1, 1992 and for those after the date of this resolution until such time as the Town Board has modified Section 179-77, which modification is anticipated to occur over the next few weeks, and BE IT FURTHER, RESOLVED, that anyone desiring a refund for variance fees already paid must complete a Town voucher, together with a copy of the variance application, and submit the same to the Town Board of the Town of Queensbury for consideration and approval.
