TheEfbllowing letter was read to the board:
December- 28,, 195,1
To the Town Board of the
Town of Queensburyt
At the request of your Supervisor and one of,the members of your
Town Board I have examined the resolutions passed by your Board' on the
27th day of October, 1951 for the purchase of three 1951 trucks, two
of which I understand have been delivered, and the third one -r a 1951
Coleman 4 wheel drive truck 3 ton Model L-1, 72-which has not as yet been
delivered; alsc5,, the resolution providing for the trade in. of five old
trucks-, Models from 1932 to 1947, which are presumed to have been de.
livered to the Carswell Truck 8c' Tractor Co. Inc. , and one of which
trucks is now being used by the town with the permission of Mr. Cars-
well.
The proposition now is the nondelivery of the four wheel drive
truck which was to have been delivered on November 15th and- now it is
proposed to be delivered on January 15th. `As Vunderstand it, there has
bLeen a proposition submitted to your Board for the cancellation of the
contract for the purchase of the Coleman four wheel drive truck and the
purcha &- of another truck in its place which can be delivered at once,.

In that event it would be necessary for your town board to advertise ,
for bids on the purchase of this new proposed truck which would take the
required number of days, and then it 'will be up to the town board as to
the kind of truck they will purchase, and there would' be no assurance
that the town board would purchase the truck which Mr. Carswell now has
ready for delivery. In` such an event it would be a real puzzle to straight-
en out your resolution which has provided specifically for the purchase
of this Coleman 4 wheel drive truck and the trade-in allowance, and while
I know it could be worked out, it would be somewhat of a difficult prop-
osltion.
Therefore, it is my opinion that if there is any reasonable assur-
ance-. that the Coleman four wheel drive truck.will be delivered on January
15th,, that it is much better for the town board and'all`concerned to wait
that length of time rather than to attempt to buy a new truck and cancel
the old contract.
Yours very truly,.
