198.2007 RESOLUTION SETTING DATE BY WHICH NORTH QUEENSBURY VOLUNTEER FIRE COMPANY, INC. MUST SUBMIT ASSESSMENT AND SERVICE AWARD INFORMATION TO TOWN CLERK REGARDING POSSIBLE CREATION OF FIRE DISTRICT RESOLUTION NO.: 198, 2007 INTRODUCED BY: Mr. Richard Sanford WHO MOVED ITS ADOPTION SECONDED BY: Mr. Daniel Stec WHEREAS, the North Queensbury Fire Co. (hereinafter the “Fire Co.”) has requested that the Town Board consider the establishment of a North Queensbury Fire District, pursuant to Town Law Section 170(2), and WHEREAS, Town Law Section 170(2) requires that a Notice of Public Hearing shall be given in the manner provided for in Town Law Section 171(2)(a), and WHEREAS, Town Law Section 171(2)(a) requires that a Notice of Public Hearing with regard to the possible establishment of a fire district state the estimated rate per thousand dollars of assessed valuation, based on the aggregate assessed valuation of taxable real property of the proposed district shown in the latest computed final assessment roll, projected to be assessed, levied and collected for purposes of the proposed district for the fiscal year of its operation, and if the fire district would become the sponsor of a service award program, so specify and contain a statement of the estimated annual cost of the service award program to the fire district, and requires that, prior to publication of the Notice, a detailed explanation of how the estimated rate of assessment for the proposed district was computed shall be filed for public inspection with the Town Clerk, and WHEREAS, the Town Board desires to hold a Public Hearing on this matter, and address this issue, NOW, THEREFORE, BE IT RESOLVED, that if the Fire Co. desires the Town Board to hold a Public Hearing on the Board’s own motion, pursuant to Town Law Section 170(2), then the Fire Co. must provide the th above referenced assessment and service award information to the Town Clerk by May 4, 2007, failing which the Town Board will not set a Public Hearing on its own motion, and will only schedule a Public Hearing if presented with a petition meeting the requirements of Town Law Section 171(1) and the above referenced assessment and service award information. th Duly adopted this 16 day of April, 2007, by the following vote: AYES : Mr. Stec, Mr. Boor, Mr. Sanford, Mr. Strough, Mr. Brewer NOES : None ABSENT: None
