WHEREAS, by Resolution No. 380,2018, the Queensbury Town Board adopted Local
Law 2 of 2018 entitled “Septic Inspection Upon Property Transfer” which is now set forth at
Queensbury Town Code Chapter 137 (Chapter 137), and
WHEREAS, by Resolution No. 176,2019, the Town Board adopted Local Law 5 of 2019
to make a minor modification to Chapter 137 to add an additional exemption, and
WHEREAS, Chapter 137 requires inspection of Onsite Wastewater Treatment Systems
(OWTS) prior to the sale of certain real property, and
WHEREAS, by letter and application dated September 26, 2019, Loretta Landry, the
former owner of property located at 53 Assembly Point Road directly on the shore of Lake George
(Applicant), advised that in March, 2019 she entered into a contract to sell such property and in
accordance with Chapter 137 scheduled a wastewater treatment system inspection and delivered a
$2,000 escrow deposit to the Town, and
WHEREAS, Chapter 137 provides that such escrow deposit will be forfeited to the Town
in the event that any needed septic repairs/installations are not completed within the time provided
as established by Chapter 137, and
WHEREAS, the Applicant has advised that during the process of replacing the on-site
wastewater treatment system, it was discovered that a new wastewater system will require several
variances and additional time is required and therefore the Applicant has requested that the Town
Board accordingly grant her additional time to obtain variances for and installation of a new
replacement wastewater system meeting Town standards and extend the date on which her $2,000
escrow deposit shall be automatically forfeited to the Town,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board, as the Town’s Local Board of Health, hereby

authorizes and grants Loretta Landry additional time or until November 30, 2019 to submit an
application, obtain variances for and complete installation of a new replacement wastewater
system at 53 Assembly Point Road as set forth in Chapter 137, Subsection 137-4(C)(3), and to
extend the date on which her $2,000 escrow deposit shall be automatically forfeited to the Town

until such date of November 30, 2019 as delineated in this Resolution, and authorizes and directs
the Town Supervisor, Director of Building and Codes Enforcement and/or Town Budget Officer

authorized by Town Code Chapter 136 to issue variances from the Town’s On-Site Sewage Disposal
Ordinance, and
WHEREAS, Frank and Erin Steinbach (Applicants) have applied to the Local Board of Health
for variances from Chapter 136 to install a replacement wastewater treatment system as follows:
1. Absorption field to be 70’ from the well instead of the required 100’ setback;
2. Absorption field to be 3’ from the west property line instead of the required 10’
setback; and
3. Absorption field to be 3’ from the south property line instead of the 10’ required

WHEREAS, by Resolution No.: 15,2017, the Queensbury Town Board authorized
establishment of Traffic Signal Capital Project Fund #215 providing for the installation and
upgrading of Town traffic signals in the Town of Queensbury, and
WHEREAS, the Town Board wishes to engage the engineering services of Barton &
Loguidice, P.C., (B&L) related to the design of traffic signals at the intersections of Bay and
Quaker Roads and Glenwood Avenue and Quaker Road (Project) for an amount not to exceed
$20,977 as delineated in a copy of B&L’s September 9, 2019 letter proposal presented at this meeting,
and
WHEREAS, the Town Board wishes to authorize such Project, with funding to be from
Capital Reserve #64, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Capital Reserve #64 subject to permissive
referendum,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
Barton & Loguidice, P.C. for the provision of engineering services related to the design of traffic
signals at the intersections of Bay and Quaker Roads and Glenwood Avenue and Quaker Road
(Project) for an amount not to exceed $20,977 as delineated in a copy of B&L’s September 9, 2019
letter proposal presented at this meeting, to be paid from Capital Project Fund #215, and

actions necessary to amend the Town Budget and effectuate the transfer from Reserve No.: 64 in the

WHEREAS, by previous Resolution(s), the Queensbury Town Board authorized the Director
of Building and Codes Enforcement’s (Director) engagement of the monthly lawn mowing and/or
one-time property clean-up services of Cheap Pete’s Lawn Care for certain properties in the Town of
Queensbury in a state of serious neglect, and
WHEREAS, the Director has advised the Town Board of two (2) such similar, additional
properties located at:
1. 11 Newcomb Street – needs one-time mowing services plus a one-time clean-up as
there is additional neglect of the property in that there is exterior trash; and
2. 210 Sunnyside Road - needs one-time mowing services; and
WHEREAS, the Director therefore recommends that the Town Board authorize one-time
mowing and clean-up services at the 11 Newcomb Street property and one-time mowing services at
the 210 Sunnyside Road property, and
WHEREAS, the Town Board has concluded that the condition of the properties creates a
public health hazard due to concerns regarding fire and the harboring of ticks and other vermin in the
tall grass and/or in the vicinity of the trash, and
WHEREAS, the Director reports that he has attempted to contact the owners of record by
certified letter and/or posting of the properties and reports that his efforts have been to no avail and
he has been unable to reach anyone or to obtain any resolution of the situation, and
WHEREAS, in accordance with Town Law §64 (5-a), the Town Board may require the
owners of land to cut, trim or remove from the land owned by them, brush, grass, rubbish or weeds
or to spray poisonous shrubs or weeds on such land, and upon default, may cause such grass, brush,
rubbish or weeds to be cut, trimmed or removed and such poisonous shrubs or weeds to be sprayed
by the Town and the total expense of such cutting, trimming, removal or spraying may be assessed
by the Town Board on the real property on which such grass, rubbish, weeds or poisonous shrubs or
weeds were found and the expense so assessed shall constitute a lien and charge on the real property
on which it is levied until paid or otherwise satisfied or discharged and shall be collected in the same
manner and at the same time as other Town charges,
WHEREAS, the Director obtained quotes for the one-time mowing and/or clean-up of the
properties, and

WHEREAS, Cheap Pete’s Lawn Care submitted quotes for the properties as follows: 1) 11
Newcomb Street: one-time mowing services in the amount of $60 and one-time clean up services,
i.e., the removal of the outside trash, for the amount of $60; and 2) 210 Sunnyside Road – one-
time mowing services in the amount of $60, and
WHEREAS, the Director recommends that the Town Board engage such services,
NOW, THEREFORE, BE IT,
RESOLVED, that the Queensbury Town Board directs that final notices shall be sent by U.S.
mail to the Property Owners of Record for the properties described in the preambles of this Resolution
requiring that they mow the lawn and/or clean-up and/or remove the garbage on their properties as
set forth above within 10 days and failing to do so, the Town will cause such action to be taken and
the cost thereof will be assessed by the Town Board on the real properties and the assessments shall
constitute a lien and charge on the real properties until paid or otherwise satisfied or discharged and
shall be collected in the same manner and at the same time as other Town charges, and
BE IT FURTHER,
RESOLVED, that the Town Board further approves of and authorizes the Director of Building
and Codes Enforcement’s engagement of Cheap Pete’s Lawn Care for services at the following
properties: 1) 11 Newcomb Street: one-time mowing services in the amount of $60 and one-time
clean up services, i.e., the removal of the outside trash, for the amount of $60; and 2) 210
Sunnyside Road – one-time mowing services in the amount of $60; in accordance with Cheap
Pete’s Lawn Care’s quotes substantially in the form presented at this meeting upon Cheap Pete’s
Lawn Care submitting proper invoices to the Town outlining the dates on which the properties
were mowed and/or cleaned-up, to be paid for from Account No.: 001-3620-4400, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to amend
the Town Budget and transfer $180 from Contingency Account No.: 001-1990-4400 to Account No.:
001-3620-4400 and take any other and all actions necessary to provide for such payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Director of Building and
Codes Enforcement to inform the Town Assessor and/or Town Receiver of Taxes and Assessments
of the total expenses of such cutting, trimming, removal, spraying of or trash removal on the properties
so that the expenses can be properly assessed and constituted as liens and charges on the real

be held in the City of Glens Falls with the Town splitting the estimated $1,500 total expenses for the
Celebration equally with the City of Glens Falls, or up to $750,

RESOLVED, that the Queensbury Town Board hereby authorizes funding toward a 2020
Earth Day Celebration in the City of Glens Falls with the Town splitting the estimated $1,500 total

tax-exempt and paid for from the 2020 Town Budget from such Town account(s) as will be deemed

WHEREAS, by prior Resolution the Queensbury Town Board provided for the Town’s
receipt of occupancy tax revenues from Warren County in accordance with the Local Tourism
Promotion and Convention Development Agreement (Agreement) entered into between the Town
and Warren County, and
WHEREAS, the Agreement provides that specific expenditure of the funds provided under
the Agreement are subject to further Resolution of the Town Board, and
WHEREAS, the Lakes to Locks Passage, Inc., a 501c3 not-for-profit corporation, has
established the Town of Queensbury as a Waypoint Community along the Lakes to Locks Passage
and has submitted a request to the Town to assist in funding the development of regional marketing
initiatives of the Byway to national and international audiences through a partnership with National
Geographic and therefore promoting of Queensbury’s events, activities and history thereby providing
an economic boon to the Town, and
WHEREAS, the Town Board wishes to provide funding to Lakes to Locks Passage, Inc., in
the amount of $500 with occupancy tax revenues received from Warren County and accordingly enter
into an agreement with Lakes to Locks Passage, Inc., for the year 2019 for the promotion of events to
Town and area residents, and
WHEREAS, a proposed Agreement has been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves the Agreement between the
Town and the Lakes to Locks Passage, Inc., substantially in the form presented at this meeting and
authorizes and directs the Town Supervisor to execute the Agreement, with funding for the
Agreement not exceeding the sum of $500 and to be provided by occupancy tax revenues the Town
receives from Warren County, to be paid for from Account No.: 050-6410-4412, and

RESOLVED, that the Town Board authorizes and directs an increase of appropriations in
Occupancy Tax Account No.: 050-6410-4412 by $500 and increase the revenue coded 050-0000-

WHEREAS, the New York State Department of Transportation (NYSDOT) and New York
State Energy Research and Development Authority (NYSERDA) issued Program Opportunity
Notice (PON) #3833 in April 2019 requesting innovative proposals to improve the efficiency of
New York’s transportation system while reducing energy consumption and greenhouse gas
emissions, and
WHEREAS, in August 2019, the Town of Queensbury and the Adirondack/Glens Falls
Transportation Council (A/GFTC) submitted a Concept Paper to NYSDOT and NYSERDA
proposing to identify the feasibility and applicability of Adaptive Signal Control Technologies
(ASCT) within the Aviation/Quaker Road Corridor from Exit 19 east to Lower Warren Street, and
WHEREA, in September 2019, NYSERDA notified the Town that the Concept Paper was
favorably reviewed and the Town was invited to submit a Full Proposal by November 4, 2019, and
WHEREAS, the estimated total cost of the project is Eighty Thousand Dollars ($80,000)
with the Full Proposal requesting grant funding of Sixty Thousand Dollars ($60,000), and

WHEREAS, the required twenty-five percent (25%) cost share of the project will be
Twenty Thousand Dollars ($20,000), to be provided through in-kind staff services of the Town’s
Senior Planner, A/GFTC staff and other project partners, and
WHEREAS, NYSDOT and NYSERDA require the applicant to attest that they are
authorized to commit their organization to the proposal submitted, and
WHEREAS, the Senior Planner has requested Town Board authorization to prepare and
submit the Full Proposal with a Town commitment to the proposal,

RESOLVED, that the Queensbury Town Board hereby authorizes, directs and ratifies the
submission of the Full Proposal for funding to NYSDOT and NYSERDA for the Queensbury
ASCT Feasibility Study, and

WHEREAS, by Resolution No.: 122,2015, the Queensbury Town Board authorized a
Merchant Application and Agreement with ETS (Agreement), which provided for a payment system
whereby the general public can view water and sewer bills and/or make water and sewer bill payments
online via credit cards, and
WHEREAS, ETS was acquired by Elavon/US Bank (Elavon) in 2018 and services have
continued since that time in accordance with the Agreement, and
WHEREAS, the Town’s Receiver of Taxes and Assessments (Tax Receiver) has advised of
an ongoing issue with Elavon whereby the amounts retained by Elavon each month are incorrect and
the Tax Receiver has had a difficult time reaching a resolution of this issue with Elavon, and
WHEREAS, the Tax Receiver has therefore recommended that the Town Board terminate its
Agreement as a discrepancy in the Town’s accounts cannot be tolerated, and
WHEREAS, the Town Board concurs with the Tax Receiver’s recommendation to terminate
the Agreement,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the termination
of its Merchant Application and Agreement with Elavon/US Bank (Elavon) as delineated in this
Resolution effective October 31, 2019, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town’s Receiver of
Taxes and Assessments and/or Town Counsel to forward to Elavon a certified copy of this Resolution
along with a letter informing Elavon that the Town is not permitted to retain excess funds or allow
Town monies to remain unpaid and any discrepancies must be immediately reconciled, and
accordingly, the Town has decided to terminate the Agreement and request that Elavon generate and
deliver to the Town the proper Agreement termination document, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Tax

Superintendent, the Town Board wishes to establish a full-time Groundskeeper position in the
Cemetery Department in accordance with a job description for such a position previously adopted by
the Warren County Department of Personnel and Civil Service, and
WHEREAS, the Town Board and the Town’s Unit of the Civil Service Employees
Association, Inc., (CSEA) have agreed that this new position shall be an hourly position on a Tuesday
through Saturday schedule and to be included in the Town’s CSEA Bargaining Unit at the hourly rate
of pay identical to that of the MEO position delineated in the Town’s current Agreement with the
CSEA, and
WHEREAS, the Cemetery Superintendent posted availability for the position, reviewed
resumes and has made a hiring recommendation to the Town Board to hire Raymond Wood,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby establishes the hourly, full-time
Groundskeeper position working on a Tuesday through Saturday schedule in the Cemetery
Department in accordance with the Groundskeeper job description for such a position previously
adopted by the Warren County Department of Personnel and Civil Service, such position to be
included in the Town’s CSEA Bargaining Unit and added to the Union Contract at the next Contract
opening, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the hiring of Raymond Wood as a
full-time Groundskeeper in the Town’s Cemetery Department, subject to Mr. Wood’s successful
passing of a pre-employment physical as required by Town Policy and successful completion of a
twenty-six (26) week probationary period, and contingent upon the Town successfully completing
background checks as reasonably necessary to judge fitness for the duties for which hired and drug
and/or alcohol screening, and

Communities pledge and by Resolution No.: 136,2019 authorized in part the Climate Smart
Communities Capital Project and Climate Smart Communities Capital Project Fund No.: 226, and
WHEREAS, the New York State Environmental Protection Fund provides a source of
funds dedicated to environmental projects, including programs such as the Municipal Waste
Reduction and Recycling (MWRR) State Assistance Grant program to help municipalities meet
environmental goals and mandates and allows the New York State Department of Environmental
Conservation (DEC) to provide MWRR funding to local governments for waste reduction and
recycling projects, and

WHEREAS, the Town Justices have recommended that the Town Board hire Peter Bachem
and Mark Ramsey, and

RESOLVED, that the Town Board further authorizes payment in the amount of $27.46 per
service fee to Mr. Bachem and/or Mr. Ramsey for service of any paper required by Town Court or
any Town of Queensbury Department as also set forth in Resolution No.: 465,2019, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town
Justices, Court Clerks and/or Town Budget Officer to complete any necessary forms and take any
actions necessary to effectuate this Resolution.

Spoke regarding the passing of Jim Berry a great man who lived in the Town. He worked for
the County Department of Public Works and was a Ski Instructor at West Mountain for 54
years. He will be deeply missed by everyone who knew him.

October is Breast Cancer Awareness Month
There may be an opportunity for the Town to work with the Queensbury School District. The
seniors at Queensbury High School asked about EV Stations at the School District. They
have received a Grant of Waste Reduction and are working on that. I think it would be a great
opportunity for us to work with them. If there is a way that National Grid or NYSERDA
would allow us to work with the School District maybe some of those EV Stations could be
placed there.
