(Terracon) conducted an asbestos survey of the building located at 682 Glen Street in Queensbury, Warren County, New York. The purpose of this survey was to sample and identify suspect asbestos-containing materials (ACM) and provide information regarding the identity, location, condition and approximate quantities of ACM in interior and exterior building components. The survey was performed on January 11, 2017 by an EPA Asbestos Hazard Emergency Response Act (AHERA) accredited and state of New York certified asbestos inspector in accordance with our Master Services Agreement dated June 29, 2007, Work Order Authorization dated December 1, 2016, and the sampling protocols established in United States Environmental Protection Agency (USEPA) 40 Code of Federal Regulations (CFR) Part 763 Subpart E 763, known as AHERA. Terracon collected a total of 75 samples from 22 homogenous areas of suspect ACM. Samples were delivered to an accredited laboratory for analysis by Polarized Light Microscopy (PLM) and Transmission Electron Microscopy (TEM). 1.1 Project Objective We understand this asbestos survey was requested due to the planned demolition of the existing building to satisfy requirements of the USEPA 40 CFR Part 61, Subpart M, the National Emission Standards for Hazardous Air Pollutants (NESHAP) regulation. 1.2 Reliance This report is for the exclusive use of O'Reilly Auto Enterprises, LLC for the project being discussed. Asbestos Survey lierracon 682 Glen Street • Queensbury, New York January 25, 2017 • Terracon Project No. J2177002 2.0 BUILDING DESCRIPTION The existing site building is located at 682 Glen Street in Queensbury, Warren County, New York, and was reportedly constructed in 1968. The building is an approximately 2,500 square-foot former Friendly's restaurant that was converted to FX3 (Fit Food Fast) restaurant in 2014. The building is long and narrow, constructed with an asphalt-shingled sloped roof with end gables, a central roof cupola, and brick and wood exterior trim iconic of Friendly's restaurants. The building is constructed with a wood and concrete block exterior walls. The attic space is used for storage and contains fiberglass batted insulation; heating, ventilation, and air conditioning (HVAC) ductwork; and is partially finished with unpainted drywall that has exposed joint compound and tape. The interior of the restaurant is finished with ceramic tile floors, finished drywall walls, and various suspended ceiling tiles. The building is heated with a natural gas fired HVAC unit located within a fenced enclosure on the northern exterior of the building. At the time of the survey, the FX3 restaurant was in operation.As such, destructive sampling was limited and ceramic bathroom floor and wall tiles, and dining area wall tiles were not sampled/damaged at the request of the current business owner. 3.0 FIELD ACTIVITIES The survey was conducted by Mr. John Ellis, an EPA AHERA-accredited and state of New York certified asbestos inspector (Inspector Certification No. 12-10380). A copy of Mr. Ellis's asbestos inspector certification is attached as Appendix D. The survey was conducted in general accordance with the sample collection protocols established in USEPA 40 CFR Part 763 Subpart E 763.86, AHERA. A summary of survey activities is provided below. 3.1 Visual Assessment Survey activities were initiated with visual observation of the accessible interior and exterior areas of the building to identify homogeneous areas of suspect ACM. A homogeneous area (HA) consists of building materials that appear similar throughout in terms of color and texture with consideration given to the date of application. Interior assessment was conducted in visually accessible areas of the building. Building materials identified as concrete, glass, wood, metal or rubber were not considered suspect ACM. Terracon lifted floor coverings in several areas, where possible, and did not observe additional floor coverings/layers except where noted in this report; however, as Terracon could not assess beneath all floor coverings in all areas, there may be isolated areas of additional suspect material present beneath existing flooring. Due to the occupied status of the building at the time of the survey, and per the current business owner's request, newer ceramic floor and wall tiles (installed in 2014) were not damaged or sampled during the assessment. Additional sampling and analysis of these suspect ACMs is recommended once the building has been vacated and prior to demolition. 3.2 Physical Assessment A physical assessment of each homogeneous area of suspect ACM was conducted to assess the friability and condition of the materials. A friable material is defined by the USEPA as a material which can be crumbled, pulverized or reduced to powder by hand pressure when dry. Friability was assessed by physically touching suspect materials. 3.3 Sample Collection Based on results of the visual observation, bulk samples of suspect ACM were collected in general accordance with USEPA AHERA sampling protocols. Samples of suspect materials were collected from randomly selected locations in each homogeneous area. Bulk samples were collected using wet methods as applicable to reduce the potential for fiber release. Samples were placed in sealable containers and labeled with unique sample numbers using an indelible marker. The selection of sample locations and frequency of sampling were based on Terracon's observations and the assumption that like materials in the same area are homogeneous in content. Terracon collected a total of 75 bulk samples from 22 homogeneous areas of suspect ACM. A summary of suspect ACM samples collected during the survey is included as Appendix B. Select photographs are attached in Appendix E. 3.4 Sample Analysis Bulk samples were submitted under chain of custody to EMSL Analytical, Inc. (EMSL) of Cinnaminson, New Jersey for analysis by PLM via the New York State ELAP Methods 198.1 (NY friable) and 198.4 (NY non-friable). Non-friable organically bound (NOB) sample materials were additionally analyzed via Transmission Electron Microscopy (TEM) for a conclusive result. The percentage of asbestos, where applicable, was determined by microscopic visual estimation. EMSL is accredited under the National Voluntary Laboratory Accreditation Program (NVLAP) accreditation number 101048-0. The laboratory analytical data report is attached in Appendix C. 4.0 REGULATORY OVERVIEW The asbestos NESHAP (40 CFR Part 61, Subpart M) regulates asbestos fiber emissions and asbestos waste disposal practices. The asbestos NESHAP regulation also requires the identification and classification of existing ACM according to friability prior to demolition or renovation activity. All friable ACM is considered regulated asbestos-containing material (RACM). The asbestos NESHAP regulation classifies ACM as either RACM, Category I non-friable ACM or Category II non-friable ACM. RACM includes all friable ACM, along with Category I and Category II non-friable ACM that has become friable, will be or has been subjected to sanding, grinding, cutting or abrading, or ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder in the course of renovation or demolition activity. Category I non-friable ACM are exclusively asbestos-containing packings, gaskets, resilient floor coverings, resilient floor covering mastics and asphalt roofing products that contain more than 1% asbestos. Category II non-friable ACM are all other non-friable materials other than Category I non-friable ACM that contain more than 1% asbestos. Asbestos activities are regulated by the New York State Department of Labor (NYSDOL) under the New York Regulations Industrial Code Rule 56 (12 NYCRR Part 56), which enforces NESHAP. The owner or operator must provide New York State Asbestos Control Bureau with written notification at least 10 calendar days prior to demolition of a facility structure and prior to the commencement of asbestos abatement activities that will disturb RACM in amounts greater than or equal to 160 square feet or 260 linear feet. NYSDOL enforces the Occupational Safety and Health Administration (OSHA) standards at 29 CFR 1910.1001 and 29 CFR 1926.1101, which regulates employee exposure to asbestos. The OSHA standard requires that employee exposure to airborne asbestos fibers be maintained at or below 0.1 fibers per cubic centimeter of air (0.1 f/cc) as an eight hour time weighted average (TWA) and not exceed 1.0 fibers per cubic centimeter of air(1.0 f/cc) over a 30 minute time period known as an excursion limit (EL). The TWA and EL are known as OSHA's permissible exposure limits (PELs). Given that demolition activities may crush or pulverize the identified non-friable ACMs (category I and II), and the applicability of OSHA asbestos regulations, Terracon recommends they be removed prior to demolition by a qualified, licensed asbestos abatement contractor in accordance with a project design prepared by a licensed asbestos project designer. Licensed asbestos abatement contractors should be contacted to obtain competitive bids for removal of the identified ACMs. At your request, Terracon can provide a proposal for developing asbestos abatement specifications (project design) and for performing abatement observation and air monitoring. Please note limitations and additional recommendations below in Section 6.0, Limitations/General Comments. The less than 1% asbestos material identified is affixed to the drywall and would also likely be removed with the drywall and joint compound as asbestos waste. It should be noted that these estimates are strictly Terracon's opinion of abatement costs, and may not reflect actual abatement bids or final costs. 6.0 LIMITATIONS/GENERAL COMMENTS Terracon lifted floor coverings in several areas, where possible, and did not observe additional floor coverings/layers except where noted in this report; however, as Terracon could not assess beneath all floor coverings in all areas, there may be isolated areas of additional suspect material present beneath existing flooring. Due to the occupied status of the building at the time of the survey, and per the current business owner's request, newer ceramic floor and wall tiles (installed in 2014) were not damaged or sampled during the assessment. These finishes may contain grout and thin-set or adhesive with asbestos regardless of the date of application. Additional sampling and analysis of these suspect ACMs is recommended once the building has been vacated and prior to demolition. This asbestos survey was conducted in a manner consistent with the level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions in the same locale. The results,findings, conclusions and recommendations expressed in this report are based on conditions observed during our survey of the building. The information contained in this report is relevant to the date on which this survey was performed, and should not be relied upon to represent conditions at a later date.
