RESOLUTION AUTHORIZING ACCEPTANCE OF GRANT FUNDS
IN CONNECTION WITH WARREN COUNTY SOIL AND WATER
CONSERVATION DISTRICT STORMWATER IMPROVEMENT
PROGRAM- HIGHWAY GARAGE AND SUNNYSIDE NORTH
DRAINAGE PROJECTS AND ESTABLISHING ESTIMATED REVENUES

WHEREAS, the New York State Department of Environmental Conservation (DEC)
administers the Water Quality Improvement Project (WQIP) Program for projects that directly
address documented water quality impairments, and
WHEREAS, the Warren County Soil & Water Conservation District(WCSWCD) applied
for and was awarded a DEC Grant (Contract #C00514GG) for water quality improvement
projects and activities as generally set forth in a November 18, 2019 letter from WCSWCD to the
Town Supervisor presented at this meeting, and
WHEREAS, by Resolution No.: 82,2016, the Queensbury Town Board authorized the
Highway Garage Capital Project(Project)and establishment of the Highway Garage Capital Project
Fund#208, and
WHEREAS, by Resolution No.: 362,2019, the Town Board authorized drainage easements
from certain property owners for the purposes of installation of permeable paver infrastructure to
help improve drainage on Sunnyside North Road(Project), and
WHEREAS, these Projects were included as Projects within the WCSWCD's Grant
application and the Projects were allocated $27,000 for installation of stormwater improvement
structures installed during the new Town Highway Garage construction and installation of
permeable pavers near 60 Sunnyside North Road, and
WHEREAS, the Town's contribution to the Grant is $10,000 of a documented in-kind
match of personnel time and equipment records which helps fulfill part of the Grant's match
requirement and allows for a greater leveraging of State funds,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts up to $27,000 in Grant
funding toward the Highway Garage Capital Project and Sunnyside Road Drainage Project as
delineated in the preambles of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board further establishes estimated revenues as follows:
• Increase Expenses in Account No.: 208-1620-2899 Capital Construction by
$15,000;
• Increases Expenses in Account No.: 001-8540-4400 Drainage Misc. Contractual
by $12,000;
• Increase Revenues in State Aid, Conservation Program Account No.: 218-0000-
53910 by $15,000;
• Increase Revenues in State Aid, Conservation Program Account No.: 001-0000-
53910 by$12,000; and
BE IT FURTHER,

RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer
to amend the 2019 Town Budget, make any adjustments, budget amendments, transfers or prepare
any documentation necessary to establish such appropriations and estimated revenues and
effectuate all terms of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any needed Agreement between the Town and the Warren County Soil and Water
Conservation District and/or any other needed documentation and the Town Supervisor, Town
Counsel and/or Town Budget Officer to take such other and further action necessary to effectuate
the terms of this Resolution.

Dear John,
I am drafting this letter to you in regards to funding for stormwater management projects within the
Champlain Basin of the Town of Queensbury. In late 2017 the District was awarded a NYSDEC grant to address
stormwater in several areas of the county. These funds are from a NYS Department of Environmental
Conservation Water Quality Improvement Program grant(Contract Number:C00514GG)that the District
obtained for water quality improvement projects and activities.
After discussing this grant with the town today,we were notified that an agreement for work was not in place.
I apologize for that oversight. This grant allows the District to reimburse the Town of Queensbury up to and
including the sum of$27,000 for the installation of a stormwater improvement project at the Town of
Queensbury Highway Garage and the installation of permeable pavers on section of Sunnyside North Road.
To support the grant,the Town of Queensbury agrees to provide copies of personnel time and equipment
records expended on this project for match funds up to$10,000,which will be used by the District towards
satisfying the match requirement of the grant. It is necessary that the Town of Queensbury agrees to follow its
purchasing policy in regards to procurement of materials and is strongly encouraged to seek out MWBE
vendors. The District is willing to assist with this effort.
Project#1—The District will reimburse the town up to$15,000 for stormwater improvement structures
installed during the new highway garage construction. Match for this project is scheduled to come from the
planned installation of additional stormwater structures as discussed in the highway garage meeting on
10/25/2019 with the town,Chazen and C.T. Male.
Project#2—The District will reimburse the town up to$12,000 for the installation of permeable pavers near
60 Sunnyside North Road.The highway department will provide the District personnel time and equipment
records for the installation of the project to be used as match funds on the grant.
If one project does not meet the allocated funding cap,and the other project exceeds the cap,the funds may
be directed towards the other project.

AND ENGAGEMENT OF C.T. MALE ASSOCIATES TO PROVIDE
PROFESSIONAL SERVICES RELATED TO FEASIBILITY STUDY

WHEREAS, the Queensbury Town Board wishes to evaluate the feasibility of the
construction of a new Town Highway Garage, and
WHEREAS, the Town Board therefore wishes to establish a Capital Project for such
Project and establish and fund the Revenue and Expense Accounts for the Capital Project in a
total amount of$50,000, and
WHEREAS, the Town Board wishes to engage the engineering and design services of C.T.
Male Associates to assist the Town with evaluating such Project for an amount not to exceed the
amount of $13,900 as delineated in C.T. Male Associates' proposal dated February 3, 2016 and
presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the
establishment of the Highway Garage Capital Project and the establishment of a Capital Project
Fund to be known as the Highway Garage Capital Project Fund #208 which Fund will establish
funding for expenses associated with this Project, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that funding for such
Capital Project shall be by a transfer of$50,000 from Capital Reserve Fund #64 to transfer to
Highway Garage Capital Project Fund #208, and
BE IT FURTHER,
RESOLVED that the Town Board further authorizes and directs the Town Budget Officer
to take all action necessary to establish the following accounts for such appropriations and
revenues as necessary:
• 001-9950-9030-0064 Transfer to Capital Project - $50,000
• 208-0000-55031 Interfund Revenue - $50,000
• 208-1620-2899 Capital Construction- $50,000
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to amend the 2016 Town Budget, make any adjustments, budget amendments, transfers
or prepare any documentation necessary to establish such appropriations and estimated revenues,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs engagement of C.T. Male
Associates to evaluate the feasibility of the construction of a new Town Highway Garage for an
amount not to exceed the amount of$13,900 as delineated in C.T. Male Associates' proposal dated
February 3, 2016 and presented at this meeting, and

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
sign the Proposal with C.T. Male and any other necessary Agreements or documentation and the
Town Supervisor and/or Town Budget Officer take any and all action necessary to effectuate all
terms of this Resolution,and
BE IT FURTHER,
RESOLVED, that this Resolution is subject to a permissive referendum in accordance with
the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town
Clerk to publish and post such notices and take such other actions as may be required by law.

WHEREAS, the Town Highway Superintendent has advised the Town Board of certain
drainage issues in the vicinity of 59 and 60 Sunnyside North Road in the Town of Queensbury
designated as Tax Map Nos: 279.17-2-32, 279.17-2-33 and 279.17-1-1.1, and
WHEREAS, the Highway Superintendent has evaluated the parcels and has recommended
acquisition of drainage easements from the property owners for the purposes of installation of
permeable paver infrastructure to help improve drainage on Sunnyside North Road, and
WHEREAS, the Town Board agrees that acquisition of such drainage easements from the
property owners, Donna and Kirk Barton and Dream Lake Builders, LLC, will benefit Town
residents and therefore the Board wishes to authorize acceptance of the easements,
NOW, THEREFORE,BE IT
RESOLVED, that the Town Board hereby approves and accepts for Town highway
drainage purposes, easements on portions of parcels owned by:
1. Donna and Kirk Barton for parcel located at 60 Sunnyside North Road, Queensbury
and designated as Tax Map Nos: 279.17-2-32 and 279.17-2-23; and
2. Dream Lake Builders, LLC for parcel located at 59 Sunnyside North Road,
Queensbury and designated as Tax Map No.: 279.17-1-1.1;
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any and all documents necessary to complete this transaction including the easements and
TP-584 forms in form acceptable to Town Counsel and the Town Supervisor, Town Highway
Superintendent, Town Budget Officer and/or Town Counsel to take such other and further action as
may be necessary, including recording of the easements, to effectuate the terms of this Resolution.
