ETHAN HALL- Good evening, for your record my name is Ethan Hall; I’m the Principal of
Rucinski Hall Architecture. With me tonight is Mike Weber, the owner of the property and the
residence…
SUPERVISOR STROUGH- Okay, thank you for attending. Would you like to elaborate and
describe your system to the Board, please?
MR. HALL- The existing system was installed prior to Mr. Weber purchasing the property.
Currently, actually, the disposal field is on the adjoining property. He doesn’t own the property
that the disposal field itself is on.
SUPERVISOR STROUGH- Alright.
MR. HALL- He tried to make arrangements with the owner of that property to purchase a piece
of it and the guy is not interested in selling it so he needs to put himself into compliance and
have his sewage disposal system on his own lot. This is really the only spot. The well drillers,
when the well was installed did no favors to anyone who had owned this lot because they sunk
the well dead center in the middle of the lot. So, no matter where we put it we can’t make 100
feet because the lot’s not big enough. If you look at the … of the 100 foot setback from the well.
So we’ve picked a spot that we feel has the best chance of being away from the well as far as we
can make it. It is going to require the installation of the effluent pump chamber and because of
the location of the house and the property line; we can’t meet either setback from the foundation
or the property line. So those things are kind of out of our control. We have to put the pump
chamber and the tank in those locations; so three of the four that we need are dictated by where
the existing house is and where the existing property line, and the last one is just, unfortunately,
that’s where the well is and we can’t really move that.
SUPERVISOR STROUGH- Yeah, George and I were up for a site visit today. Alright, questions
from the Board to the applicant? The one thing I noticed in the notes was a septic tank shall be
inspected annually.
MR. HALL- So when you have a system like this that’s got a UV filter on it, you want to make
sure that it’s operating properly and you want to make sure that the tank is operating properly.
So, the tank itself doesn’t have to be pumped every year. It just needs to be inspected to make
sure that the baffles are working and make sure that the gas baffle isn’t filled up with paper and
things like that.
SUPERVISOR STROUGH-Okay, and you also…you put a lot of good things in your notes. I’ll
give you credit.
COUNCILMAN FERONE- Yeah.
MR. HALL- Thank you.
SUPERVISOR STROUGH- Yeah, when septic tank gets pumped, the septic tank baffles/tees
house sewer connection and outlet shall be inspected. Baffles/tees that have deteriorated and no
longer perform as designed shall be replaced. Cracked or broker lines must be repaired or
replaced. Lots of good stuff there, thank you.

SUPERVISOR STROUGH- Do we have to condition our approval, if it comes to that, which I
predict it will, that they’re to abide to their sewage disposal system notes as in the septic and site
plan design notes? Do we have to add that or is that just part of the application?
TOWN COUNSEL, HAFNER- If it is something that the Board thinks is important to be done
each year to follow the notes, I think it should be incorporated into the Resolution.
SUPERVISOR STROUGH- Alright, can you work on that and…

MACKENZIE PELTON- Hi, I am Mackenzie Pelton with Rucinski Hall Architecture. I did the
fieldwork out there for the site.
WILLIAM BOSY- I’m William Bosy, owner of 53 Assembly Point.
SUPERVISOR STROUGH- Alright, thank you. Is there anything you’d like to describe? Pleas
describe the system.
MS. PELTON- So based on what was provided from the new owners, was the location of the
garage and the addition that they’ll putting forth in the future. So based on agreements with the
previous owner, we have located the sewage disposal field in the corner next to the garage, which
therefore, … moved over past the …setback line. Based on where the tanks are now, the tanks are
too close to the property line, they’re in between the house and the property line, closer down
towards the bottom of the basement. So we’re looking to put the pump chamber down there to
pump up to the…
SUPERVISOR STROUGH- Yeah, most of it is those chambers… adjacent to the building and the
property lines because you’ve got to squeeze them... it’s a narrow lot.
MS. PELTON- Yes.
SUPERVISOR STROUGH- So I see that, I get that. The one question that we had on the site visit is
assuring that nobody is going to be parking, because the new bed is being proposed next to the new
garage.
MS. PELTON- The parking is currently in front of the garage between the road and the garage.
SUPERVISOR STROUGH- So, is there going to be a fence or something there that’s going to
prevent people from rolling over the bed because you know as well as I do, but the public may not,
that you can’t… It’s not recommended to park because of the compression of the, compaction of the
soils underneath. It’s not a good idea to park on filtration beds.
MS. PELTON- So currently the fence line is right next to where the garage is going to be. It’s …out
on the sides, it follows the property line. It will be moved, you know, accordingly with the bed.
SUPERVISOR STROUGH- But it will be replaced as shown on the plan?
MS. PELTON- Yes.
SUPERVISOR STROUGH- Okay, well that answers that, George. Any questions from the Board to
the applicant before I open the public hearing?
COUNCILWOMAN ATHERDEN- Do we have the same issue here with the system notes for…
since it does say not vehicular traffic or parking shall be allowed on any portion of the absorption
field or the sewage disposal system. Is this any different?
SUPERVISOR STROUGH- No, but…
COUNCILWOMAN ATHERDEN- So we should refer to it?
SUPERVISOR STROUGH- Why not add this like we did the other one.

MR. BOSY- Can I show you something?
COUNCILMAN FERONE- Sure, no, I would appreciate it. Without detail on a garage, it’s hard to
envision.
MR. BOSY- Yeah, I understand what you’re saying. This shows where the existing shed is now.

RESOLUTION GRANTING LORETTA LANDRY AN EXTENSION OF
TIME FOR SEPTIC SYSTEM REPLACEMENT AT 53 ASSEMBLY POINT
ROAD AND REINSTATING ESCROW DEPOSIT

WHEREAS, by Resolution No. 380,2018, the Queensbury Town Board adopted Local
Law 2 of 2018 entitled “Septic Inspection Upon Property Transfer” which is set forth at Town
Code Chapter 137 and by Resolution No. 176,2019, adopted Local Law 5 of 2019 to make a minor
modification to Chapter 137 to add an additional exemption, and
WHEREAS, Chapter 137 requires inspection of Onsite Wastewater Treatment Systems
(OWTS) prior to the sale of certain real property, and
WHEREAS, by letter and application dated September 26, 2019, Loretta Landry, the
former owner of property located at 53 Assembly Point Road directly on the shore of Lake George
(Applicant), advised that in March, 2019 she entered into a contract to sell such property (to
William and Kathy Bosy) and in accordance with Chapter 137 scheduled a wastewater treatment
system inspection and delivered a $2,000 escrow deposit to the Town, and
WHEREAS, Chapter 137 provides that such escrow deposit will be forfeited to the Town
in the event that any needed septic repairs/installations are not completed within the time provided
as established by Chapter 137, and
WHEREAS, the Applicant advised that during the process of replacing the on-site
wastewater treatment system, it was discovered that a new wastewater system would require
several variances and additional time was required and therefore the Applicant requested that the
Town Board accordingly grant her additional time to obtain variances for and installation of a new
replacement wastewater system meeting Town standards and extend the date on which her $2,000
escrow deposit shall be automatically forfeited to the Town, and
WHEREAS, by Resolution No.: BOH 36, 2019, the Town Board authorized and granted

the Applicant additional time or until November 30, 2019 to submit an application, obtain
variances for and complete installation of a new replacement wastewater system at 53 Assembly
Point Road, and
WHEREAS, William and Kathy Bosy, the new owners of the Applicant’s property, have
applied for variances from the Sewage Disposal Ordinance to install a replacement wastewater
treatment system on the property and such new system may not be completed for several weeks or
months, and
WHEREAS, the Applicant has required an extension of time to allow for installation of the
new replacement wastewater system at 53 Assembly Point Road and an extension of the date on
which her $2,000 escrow deposit will be automatically forfeited to the Town, and

Subsection 137-4(C)(3), and to extend the date on which Ms. Landry’s $2,000 escrow deposit shall

Resolution, and authorizes and directs the Town Supervisor, Director of Building and Codes

WHEREAS, the New York State Department of Environmental Conservation (DEC)
administers the Water Quality Improvement Project (WQIP) Program for projects that directly
address documented water quality impairments, and
WHEREAS, the Warren County Soil & Water Conservation District (WCSWCD) applied
for and was awarded a DEC Grant (Contract #C00514GG) for water quality improvement projects
and activities as generally set forth in a November 18, 2019 letter from WCSWCD to the Town
Supervisor presented at this meeting, and
WHEREAS, by Resolution No.: 82,2016, the Queensbury Town Board authorized the
Highway Garage Capital Project (Project) and establishment of the Highway Garage Capital Project
Fund #208, and
WHEREAS, by Resolution No.: 362,2019, the Town Board authorized drainage easements
from certain property owners for the purposes of installation of permeable paver infrastructure to help
improve drainage on Sunnyside North Road (Project), and
WHEREAS, these Projects were included as Projects within the WCSWCD’s Grant
application and the Projects were allocated $27,000 for installation of stormwater improvement
structures installed during the new Town Highway Garage construction and installation of
permeable pavers near 60 Sunnyside North Road, and

WHEREAS, the Town’s contribution to the Grant is $10,000 of a documented in-kind
match of personnel time and equipment records which helps fulfill part of the Grant’s match
requirement and allows for a greater leveraging of State funds,

RESOLVED, that the Queensbury Town Board hereby accepts up to $27,000 in Grant
funding toward the Highway Garage Capital Project and Sunnyside Road Drainage Project as
delineated in the preambles of this Resolution, and

WHEREAS, a proposed Agreement has been presented at this meeting,

Town and the Adirondack Folk School substantially in the form presented at this meeting and
authorizes and directs the Town Supervisor to execute the Agreement, with funding for the
Agreement not exceeding the sum of $5,000 and to be provided by occupancy tax revenues the Town

EMERGENCY SQUAD, INC.’S PROPOSAL TO PURCHASE
AMBULANCE AND USE TAX-EXEMPT FINANCING FOR SUCH

WHEREAS, in accordance with New York State Public Health Law Article 30, the Town of
Queensbury and the West Glens Falls Emergency Squad, Inc. (Squad) have entered into an
Agreement for general emergency ambulance services within the Town, which Agreement sets forth
a number of terms and conditions, including a condition that the Squad will not purchase or enter into
any binding contract to purchase any piece of apparatus, equipment, vehicles, real property, or make
any improvements that would require the Squad to acquire a loan or mortgage without prior approval
of the Queensbury Town Board, and
WHEREAS, the Squad has advised the Town Board that it wishes to trade-in its 2010
ambulance 710 and purchase a 2019 Chevy K-3500 Chassis Ambulance with a Demers MXP-150
Conversion Box at a purchase price not to exceed $186,998, and
WHEREAS, the trade-in value of the ambulance being replaced will be $10,000, bringing
the new ambulance’s purchase price down to $176,998, and
WHEREAS, the Ambulance will be owned and used by the Squad to provide general
emergency ambulance services to the Town and maintained at the Squad’s building located at 86
Luzerne Road in the Town of Queensbury, New York, and
WHEREAS, the Squad plans on paying for the proposed, new Ambulance by using:
1. $ 30,000 – cash down payment from its current budget; and
2. $146,998 maximum amount of tax-exempt financing having a 72 month term with the

WHEREAS, the Queensbury Town Board wishes to establish an extension to the Town’s
Route 9 Sanitary Sewer District (hereinafter the “District”) to be known as the Route 9 Sanitary Sewer
District Extension No. 3 (hereinafter the “Sewer District Extension”), and
WHEREAS, a Map, Plan and Report has been prepared by Lansing Engineering, engineers
licensed by the State of New York regarding the proposed Sewer District Extension to permanently
serve an existing apartment development known as Robert Gardens North on one (1) parcel bearing
tax map identification no.: 296.17-1-41 and located at 220 Weeks Road as more specifically set forth
and described in the Map, Plan and Report, and
WHEREAS, the Map, Plan and Report has been accepted and approved by the Town and has
been filed in the Queensbury Town Clerk's Office and is available for public inspection, and
WHEREAS, the Map, Plan and Report delineates the boundaries of the proposed Sewer
District Extension, a general plan of the proposed sewer system, a report of the proposed sewer system
and method of operation, and
WHEREAS, the Town Board wishes to establish the proposed Sewer District Extension in
accordance with Town Law Article 12-A and plan to later consolidate the Sewer District Extension
with the Queensbury Technical Park Sewer District in accordance with General Municipal Law
Article 17-A, and
WHEREAS, Part I of a Short Environmental Assessment Form has been prepared and
presented at this meeting and the Town’s Engineer indicates it is an unlisted action and the action will
undergo an uncoordinated review,
NOW, THEREFORE, IT IS
ORDERED:
1. The Queensbury Town Board shall hold a public hearing to consider establishment of the
proposed Extension No. 3 to the Route 9 Sanitary Sewer District described in this Resolution to be
known as the Route 9 Sanitary Sewer District Extension No. 3.
2. The boundaries of the proposed extension and benefitted areas of the Route 9 Sanitary

Sewer District include tax map parcel no.: 296.17-1-41, having the following metes and bounds
description:
All that certain sewer district extension situate in the Town of Queensbury, County of Warren,
State of New York lying along the northerly line of Weeks Road, being further bounded and
described as follows:
Beginning at the point of intersection of the common division line between tax map parcel
(T.M.P.) 296.17-1-41 to the East and T.M.P. 296.69-1-34 to the West with the northerly line
of Weeks Road, thence from said point of beginning in a northerly direction along said
common division line and the easterly lines of T.M.P.’s 296.69-1-32, 27, 22 and the easterly
line of Queens Way, 875± feet to a point in the southerly line of T.M.P. 296.13-1-20, thence
in a easterly direction along said southerly line, 656± feet to the point of intersection with the
westerly line of T.M.P. 296.13-1-17.1, thence in a southerly direction along said westerly line
and along the westerly line of T.M.P. 296.17-1-42, 870± feet to a point in the northerly line
of Weeks Road, thence along said northerly line 863± feet to the point of beginning.
Intending to describe tax map parcel 296.17-1-41
and as more specifically set forth and described in the Map, Plan and Report.
3. The property owner will construct a new gravity sanitary sewer system throughout the
existing Robert Gardens North apartment complex. The proposed sewer will replace the existing
onsite wastewater system (multiple septic tanks and seepage pits nearing the end of their service life)
which will be disconnected from the buildings and will be properly abandoned and/or disposed of.
The 8” sewer network will connect to the existing 8” municipal gravity sewer main located along the
north side of Weeks Road at two locations. All connections will be as directed by the Town
Wastewater Department. All such infrastructure to be installed will be owned and maintained by the
property owner. Approximately 150’ of 8” Sanitary Sewer and two 4’ diameter precast manholes
will be dedicated. Plans and details for this new connection are shown on the Map, Plan and Report.
Flows from this proposed Extension will be transported and discharged to the City of Glens Falls
Wastewater Treatment Plant which has the capacity to provide the Town of Queensbury with the
capacity necessary for this Sewer District Extension.
4. The cost of installation of sewer laterals shall be the responsibility of the property owner.
Legal, engineering and construction costs to form the Sewer District Extension are to be paid by the
property owner and members of the Sewer District will not be responsible for these costs. The
improvements shall be constructed and installed in full accordance with the Town of Queensbury's
specifications, ordinances or local laws, any State laws or regulations, in accordance with approved
plans and specifications and under competent engineering supervision.
5. The maximum amount proposed to be expended to form the Sewer District Extension is

approximately $316,399 which would be borne entirely by the property owner. This estimate includes
the property owner’s capital cost of construction (approximately $279,000), as well as the capital buy-
in fees estimated in the total amount of $35,550 as outlined in the Map, Plan and Report. The current
operation and maintenance use fee in the district is $5.50 per 1,000 gallons of metered water usage
resulting in an estimated sewer user charge of $30,112.50 per year. In addition, the estimated benefit
tax would be $9,729.27 per year. The property within the Extension will be taxed and/or assessed
user fees for the operation and maintenance charges. All user fees and taxes will be based upon the
same formulas as are used in the Route 9 Sanitary Sewer District, as amended from time to time.
6. All capital costs of the project will be paid for by the property owner and must be paid in
full prior to connection. There will be no financing cost or tax increase in the Sewer District Extension
or in the existing Route 9 Sanitary Sewer District. The operation and maintenance cost for the
property in the proposed Sewer District Extension is estimated to be $39,841.77 per year. There is
only one property in the Sewer District Extension so it is the typical property. It is not a one or two
family home.
7. The Map, Plan and Report describing the improvements and area involved and a detailed
explanation of the fees and costs is on file with the Queensbury Town Clerk and is available for public
inspection.
8. The Town Board shall meet and hold a public hearing at the Queensbury Activities Center,

742 Bay Road, Queensbury at 7:00 p.m., on Monday, December 16, 2019 to consider the Sewer
District Extension and to hear all persons interested in the proposal and to take such other and further
action as may be required or authorized by law.
9. The Town Board hereby authorizes and directs the Queensbury Town Clerk to duly
publish and post this Order not less than ten (10) days nor more than twenty (20) days before the
public hearing date, as required by Town Law §209-d, and complete or arrange for the securing of
two (2) Affidavits of Publication of Notice and two (2) Affidavits of Posting of Notice of the Public
Hearing required hereby and to file a certified copy of this Order with the State Comptroller on or
about the date of publication. Pursuant to Town Law section 209-f, the permission of the State
Comptroller is not required.
10. The Town Board hereby declares that this action is an unlisted action pursuant to 6
NYCRR 617 et. seq., and will perform uncoordinated review of this Project. The Town’s Engineer
indicates that there is no other involved agency.

COUNCILMAN METIVIER (WARD I)- In the spirit of giving, the Kindness Closet is
officially open to the South Glens Falls community on Saturday morning at 9:00AM.
SUPERVISOR STROUGH-
Spoke regarding the LGA and various projects. It’s a great organization; they do a
lot of great things for Lake George.
Received a memo from the Department of Taxation and Finance explaining that
the Office of Real Property Tax Services will be sending notifications
electronically as they are trying to reduce paper usage.
Received a letter from the Warren County Soil and Water naming Steve Lovering,
Director of Parks and Recreation Department, Conservationist of the year for
2019. This award is given annually by the district to recognize an individual or
organization for outstanding work in the field of natural resources conservations.
Also received a letter from Lou Buck thanking the Town for meeting with him
regarding vehicles speeding on Gurney Lane.
Reviewed the most recent Dog Control Officer Inspection report. The report
indicated the dog control officer services were rated satisfactory, which is good; it
doesn’t get any better than satisfactory. Thanked the SPCA of Upstate New York,
they are doing a wonderful job for the Town.
