TOWN OFFICIALS CONNIE GOEDERT, CEMETERY SUPERINTENDENT PRESS LOOK TV POST STAR SUPERVISOR STROUGH called meeting to order… PLEDGE OF ALLEGIANCE LED BY COUNCILMAN GEORGE FERONE 1.0 RESOLUTION CALLING FOR QUEENSBURY BOARD OF HEALTH RESOLUTION NO.: 391, 2019 INTRODUCED BY: Mr. George Ferone WHO MOVED FOR ITS ADOPTION SECONDED BY: Mrs. Catherine Atherden RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Regular Session and enters into the Queensbury Board of Health. nd Duly adopted this 2 day of December 2019 by the following vote: AYES: Mr. Metivier, Mrs. Atherden, Mr. Ferone, Mrs. Switzer, Mr. Strough NOES: None ABSENT: None PUBLIC HEARING- SEWAGE DISPOSAL VARIANCE APPLICATION OF MIKE WEBER NOTICE SHOWN PUBLICATION DATE: NOVEMBER 23, 2019 SUPERVISOR STROUGH- Mike Weber has a residence on 519 Route 149. The applicant is asking for four (4) variances and they are as follows: 1. Septic tank to be 3’4” from the property line instead of the required 10’ setback, septic tank to be 5’5” from the foundation instead of the REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 290 required 10’ setback, pump chamber to be 2’5” from the property line instead of the required 10’ setback; and well to be 80’ from the absorption bed instead of the required 100’ setback. However, the applicant is proposing to add a UV filter with a particulate sensor and that will be installed on the existing water system. Okay, and so we have before us, please identify yourself and… ETHAN HALL- Good evening, for your record my name is Ethan Hall; I’m the Principal of Rucinski Hall Architecture. With me tonight is Mike Weber, the owner of the property and the residence… SUPERVISOR STROUGH- Okay, thank you for attending. Would you like to elaborate and describe your system to the Board, please? MR. HALL- The existing system was installed prior to Mr. Weber purchasing the property. Currently, actually, the disposal field is on the adjoining property. He doesn’t own the property that the disposal field itself is on. SUPERVISOR STROUGH- Alright. MR. HALL- He tried to make arrangements with the owner of that property to purchase a piece of it and the guy is not interested in selling it so he needs to put himself into compliance and have his sewage disposal system on his own lot. This is really the only spot. The well drillers, when the well was installed did no favors to anyone who had owned this lot because they sunk the well dead center in the middle of the lot. So, no matter where we put it we can’t make 100 feet because the lot’s not big enough. If you look at the … of the 100 foot setback from the well. So we’ve picked a spot that we feel has the best chance of being away from the well as far as we can make it. It is going to require the installation of the effluent pump chamber and because of the location of the house and the property line; we can’t meet either setback from the foundation or the property line. So those things are kind of out of our control. We have to put the pump chamber and the tank in those locations; so three of the four that we need are dictated by where the existing house is and where the existing property line, and the last one is just, unfortunately, that’s where the well is and we can’t really move that. SUPERVISOR STROUGH- Yeah, George and I were up for a site visit today. Alright, questions from the Board to the applicant? The one thing I noticed in the notes was a septic tank shall be inspected annually. MR. HALL- So when you have a system like this that’s got a UV filter on it, you want to make sure that it’s operating properly and you want to make sure that the tank is operating properly. So, the tank itself doesn’t have to be pumped every year. It just needs to be inspected to make sure that the baffles are working and make sure that the gas baffle isn’t filled up with paper and things like that. SUPERVISOR STROUGH-Okay, and you also…you put a lot of good things in your notes. I’ll give you credit. COUNCILMAN FERONE- Yeah. MR. HALL- Thank you. SUPERVISOR STROUGH- Yeah, when septic tank gets pumped, the septic tank baffles/tees house sewer connection and outlet shall be inspected. Baffles/tees that have deteriorated and no longer perform as designed shall be replaced. Cracked or broker lines must be repaired or replaced. Lots of good stuff there, thank you. MR. HALL- Thank you… SUPERVISOR STROUGH- I have a question for Legal Counsel. REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 291 TOWN COUNSEL, ROBERT HAFNER- Okay. SUPERVISOR STROUGH- So we have in the applications a plan with the notes, two of which I have read to you… TOWN COUNSEL, HAFNER- Yes. SUPERVISOR STROUGH- Do we have to condition our approval, if it comes to that, which I predict it will, that they’re to abide to their sewage disposal system notes as in the septic and site plan design notes? Do we have to add that or is that just part of the application? TOWN COUNSEL, HAFNER- If it is something that the Board thinks is important to be done each year to follow the notes, I think it should be incorporated into the Resolution. SUPERVISOR STROUGH- Alright, can you work on that and… TOWN COUNSEL, HAFNER- Sure, sure, I can add that. COUNCILWOMAN ATHERDEN-…There’s a lot there… TOWN COUNSEL, HAFNER- Well, I’m going to reference the notes. Provided that the…thank you. You show me exactly where it is and I will write the conditions. SUPERVISOR STROUGH- Here’s the septic system notes. The rest of it’s standard. Kind of unique to this are these two but if you just say… TOWN COUNSEL, HAFNER- The sewage disposal system notes as per application…sure. SUPERVISOR STROUGH- Yes. Is that an issue? MR. HALL- No. SUPERVISOR STROUGH- Okay. MR. HALL- As far as our… that’s part… we have spoken to Code Enforcement and that’s part of their conditions, as well… SUPERVISOR STROUGH- Okay. COUNCILWOMAN ATHERDEN- Good. SUPERVISOR STROUGH- Any other questions before I allow the public to speak to this? COUNCILMAN FERONE- No. SUPERVISOR STROUGH- Any member of the public wish to speak to this Resolution for Mike Weber’s application for sanitary sewage disposal variances? Seeing none, can you reiterate how we’re going to amend the application to approve these variances. Are you ready, Bob, or am I going too fast? TOWN COUNSEL, HAFNER- Just one second. SUPERVISOR STROUGH- Because the Board wants me to go fast. COUNCILWOMAN SWITZER- No, I think it’s we want you to go fast, not… TOWN COUNSEL, HAFNER- I’m just going to add at the end of the last resolve, where you approved the application, contingent upon the homeowner complying with the sewage disposal notes provided by the applicant as detailed in the site plan and septic design notes. SUPERVISOR STROUGH- Okay. COUNCILMAN FERONE- That’s good. REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 292 SUPERVISOR STROUGH- Alright, the Board all understands how we’re amending the Resolution. Would anybody like to move this forward for approval? PUBLIC HEARING CLOSED. RESOLUTION APPROVING MIKE WEBER’S APPLICATION FOR SANITARY SEWAGE DISPOSAL VARIANCES RESOLUTION NO.: BOH 51, 2019 INTRODUCED BY: Mr. Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mrs. Jennifer Switzer WHEREAS, Mike Weber (Applicant) filed an application for variances from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install a replacement wastewater treatment system as follows: 1. Septic tank to be 3’4” from the property line instead of the required 10’ setback; 2. Septic tank to be 5’5” from the foundation instead of the required 10’ setback; 3. Pump chamber to be 2’5” from the property line instead of the required 10’ setback; and 4. Well to be 80’ from the absorption bed instead of the required 100’ setback with a UV filter with a particulate sensor to be installed on the existing water system; on property located at 519 State Route 149 in the Town of Queensbury, and WHEREAS, the Town Clerk’s Office published the Notice of Public Hearing in the Town’s official newspaper and the Local Board of Health duly conducted a public hearing concerning the nd variance requests on Monday, December 2, 2019, and WHEREAS, the Town Clerk’s Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED, that REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 293 1. due to the nature of the variances, the Local Board of Health determines that the variances would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy; and 2. the Local Board of Health finds that the granting of the variances is necessary for the reasonable use of the land and are the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the Applicant; and BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves the application of Mike Weber for variances from the Sewage Disposal Ordinance to install a replacement wastewater treatment system as follows: 1. Septic tank to be 3’4” from the property line instead of the required 10’ setback; 2. Septic tank to be 5’5” from the foundation instead of the required 10’ setback; 3. Pump chamber to be 2’5” from the property line instead of the required 10’ setback; and 4. Well to be 80’ from the absorption bed instead of the required 100’ setback with a UV filter with a particulate sensor to be installed on the existing water system; on property located at 519 State Route 149 in the Town of Queensbury and bearing Tax Map No: 278-1-31, contingent upon the homeowner complying with the sewage disposal system notes provided by the Applicant as detailed on the Site Plan and Septic Design Notes. nd Duly adopted this 2 day of December, 2019, by the following vote: AYES: Mrs. Atherden, Mr. Ferone, Mrs. Switzer, Mr. Strough, Mr. Metivier NOES: None ABSENT: None PUBLIC HEARING- SEWAGE DISPOSAL VARIANCE APPLICATION OF WILLIAM AND KATHY BOSY NOTICE SHOWN PUBLICATION DATE: NOVEMBER 23, 2019 SUPERVISOR STROUGH- Kathy Bosy owns a residence at 53 Assembly Point Road and is applying for variances from Chapter 136 Town Code. The six variances are as follows: S eptic tank to be 2’9” from the property line instead of the required 10’ setback; variance two (2), septic tank to be 2’6” REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 294 from the foundation instead of the required 10’ setback; variance three (3), Pump chamber to be 2’7” from the property line instead of the required 10’ setback; pump chamber to be 2’ from the foundation instead of the required 10’ setback; pump line to be 4’10” from the property line instead of the 10’ setback; and the sixth variance, edge of stone for the pressure bed to be 4’ instead of the required 10’ setback. Again, this is at 53 Assembly Point Road and we have a public hearing on this tonight. George and I did a site visit today. Would you please introduce yourself, the applicant or the representatives of the applicant? MACKENZIE PELTON- Hi, I am Mackenzie Pelton with Rucinski Hall Architecture. I did the fieldwork out there for the site. WILLIAM BOSY- I’m William Bosy, owner of 53 Assembly Point. SUPERVISOR STROUGH- Alright, thank you. Is there anything you’d like to describe? Pleas describe the system. MS. PELTON- So based on what was provided from the new owners, was the location of the garage and the addition that they’ll putting forth in the future. So based on agreements with the previous owner, we have located the sewage disposal field in the corner next to the garage, which therefore, … moved over past the …setback line. Based on where the tanks are now, the tanks are too close to the property line, they’re in between the house and the property line, closer down towards the bottom of the basement. So we’re looking to put the pump chamber down there to pump up to the… SUPERVISOR STROUGH- Yeah, most of it is those chambers… adjacent to the building and the property lines because you’ve got to squeeze them... it’s a narrow lot. MS. PELTON- Yes. SUPERVISOR STROUGH- So I see that, I get that. The one question that we had on the site visit is assuring that nobody is going to be parking, because the new bed is being proposed next to the new garage. MS. PELTON- The parking is currently in front of the garage between the road and the garage. SUPERVISOR STROUGH- So, is there going to be a fence or something there that’s going to prevent people from rolling over the bed because you know as well as I do, but the public may not, that you can’t… It’s not recommended to park because of the compression of the, compaction of the soils underneath. It’s not a good idea to park on filtration beds. MS. PELTON- So currently the fence line is right next to where the garage is going to be. It’s …out on the sides, it follows the property line. It will be moved, you know, accordingly with the bed. SUPERVISOR STROUGH- But it will be replaced as shown on the plan? MS. PELTON- Yes. SUPERVISOR STROUGH- Okay, well that answers that, George. Any questions from the Board to the applicant before I open the public hearing? COUNCILWOMAN ATHERDEN- Do we have the same issue here with the system notes for… since it does say not vehicular traffic or parking shall be allowed on any portion of the absorption field or the sewage disposal system. Is this any different? SUPERVISOR STROUGH- No, but… COUNCILWOMAN ATHERDEN- So we should refer to it? SUPERVISOR STROUGH- Why not add this like we did the other one. COUNCILWOMAN ATHERDEN- Yes. REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 295 SUPERVISOR STROUGH- Same thing, same wording. TOWN COUNSEL, HAFNER- Sure. COUNCILMAN FERONE- I still have a question about the garage though. So, looking at the shed and the size of the shed, the garage, I would imagine, is going to be larger than what that shed is there, right? MR. BOSY- Yes, 16x20. Sixteen feet… COUNCILMAN FERONE- So is the shed going to get closer to the property line to your north? MR. BOSY- Can I show you something? COUNCILMAN FERONE- Sure, no, I would appreciate it. Without detail on a garage, it’s hard to envision. MR. BOSY- Yeah, I understand what you’re saying. This shows where the existing shed is now. COUNCILMAN FERONE- Okay, that’s the shed. MR. BOSY- And this is where the garage would be. COUNCILMAN FERONE- Okay. MR. BOSY- Would anyone else like to see? SUPERVISOR STROUGH- I…well, is it any… COUNCILWOMAN ATHERDEN- Down here? SUPERVISOR STROUGH- Same thing, right? MR. BOSY- Yeah pretty much, yes. MS. PELTON- We… and just made it more… COUNCILMAN FERONE- Oh, okay… SUPERVISOR STROUGH- Yeah, it’s just a little bit more obvious. COUNCILMAN FERONE- So this isn’t the shed, this is the shed in here. MR. BOSY- Right. SUPERVISOR STROUGH- So, Kathy with the notes here, that’s all okay? MS. PELTON- Yes, we usually do Ballard posts, we call out for Ballard posts but because that fence was already there… SUPERVISOR STROUGH- Yes. MS. PELTON- We actually had to move it to get the machine in, so they were just going to push it back. SUPERVISOR STROUGH- Yes, I understand. As long as the fence goes back. Okay, any other questions? COUNCILMAN FERONE- No. REGULAR TOWN BOARD MEETING, 12-02-2019, MTG #37 296 SUPERVISOR STROUGH- Any member of the public wish to speak for this application for variance? There is a member of the public, so if you’ll sit down for a minute and I’ll call you back after the public hearing. Yes sir, please come forward. Identify yourself for the record, please. DAVID HARTMAN- My name is David Hartman. I’m at the adjacent property at 51 Assembly Point, directly to the south. I have no concerns of this at all. I mean, it makes sense to me. It’s improving the property and it’s probably improving the current septic system so I’m in favor of it. SUPERVISOR STROUGH- Thank you for coming forward and stating that, it helps, it does. Alright Mr. Hartman, thank you. Anybody else like to speak to this variance application? Seeing none, Bob would you just… TOWN COUNSEL, HAFNER- I put add same language from 1.1. SUPERVISOR STROUGH- Okay. TOWN COUNSEL, HAFNER- I can read it again. I’m going to add it at the last resolve. SUPERVISOR STROUGH- Just for the record. TOWN COUNSEL, HAFNER- No, the third to last resolved, where you approved the application with the variances. The language that we had is at the end of that resolved, contingent upon the homeowners complying with the sewage disposal notes provided by the applicant as detailed on the site plan and septic design notes. SUPERVISOR STROUGH- Alright, everyone understand the amended Resolution? Anybody like to move it forward for approval. DEPUTY TOWN CLERK, MELLON- Close the public hearing.
