2004-01-28 SP MTG6 298 SPECIAL TOWN BOARD 01-28-2004 MTG.#6 SPECIAL TOWN BOARD MEETING Mtg. # 6 January 28, 2004 Res. 97-99 6:00 P.M. TOWN BOARD MEMBERS PRESENT SUPERVISOR DANIEL STEC COUNCILMAN ROGER BOOR COUNCILMAN THEODORE TURNER COUNCILMAN JOHN STROUGH COUNCILMAN TIM BREWER TOWN COUNSEL BOB HAFNER BUDGET OFFICER JENNIFER SWITZER Supervisor Stec-Requested that Ward One Councilman Roger Boor brief the Board on a rezoning proposal. Councilman Boor- Speaking before Supervisor Stec any myself, Mr. Rick Meath and Tom Jarrett his engineer discussed the Gurney Lane Property rezoning to Office Professional, noted no plan is in place. Looking at a proposal of two to three office buildings with a rare possibility of multi family housing in the area that is currently a sand pit. Noted that his family members who are either on the board or in some way have a say in the corporation that is proposing this, they would prefer not to have housing. It was originally called to be Professional Office there were some residents locally that were not happy with that and we changed the zoning for the new zoning regulations. They are here again hoping to go office professional. You have Westmount on one side you have the County building on the other you have got Great Escape on the other, really what is the best use of that property? With the knowledge that probably that bridge is going to expand some day and they will have to take some of that property, I think it is probably the best way to go. He was requesting that should the Board agree to this zoning change in principal that he would ask that we have it done by staff. Councilman Brewer-Questioned why the Town staff would do the application and not that applicant? Councilman Boor-If it isn’t in by Monday, then he has to wait another quarter and he asked Chris Round if he would put the thing together. Chris agreed in as much as this is what we recommend that property to be in the beginning. Supervisor Stec-Noted that we do not have to have every rezoning brought to us by an applicant. Councilman Brewer-If he does not have a project why is there a rush? Supervisor Stec-Because probably there will be a project. Councilman Brewer-Let him do it. Councilman Strough-I think we have to slow down a little bit there is more than one parcel, there are two that I can think of right now. Councilman 299 SPECIAL TOWN BOARD 01-28-2004 MTG.#6 Boor-He is also more than willing to do what we want to have him do for the bike trail, he is willing to put a header there for the bike trail on Warren County property so we would not be responsible for it. Supervisor Stec-I guess what I am hearing from Tim is, I think, Tim needs to gain some assurance from Chris Round that what we are talking about it not abnormal. Councilman Strough-Here is another reason why we should wait and take a better look at this one thing, I have already talked to Chris Round because on the Planning Board we have run into problems with professional office zoning allowing multi family residential. A lot of places where we have professional office we really do not want that option. I mentioned to Chris Round why don’t we design a professional office zoning that may allow residential but it would be a special use permit, Chris seemed to be favorable to that as a philosophy. The property in question the Meath Property you are not really favoring the idea of residential there but you would like to see professional offices there because of its location to exit twenty. It is a transition type zoning from commercial to residential anyway. There is another piece of property owned by the Hayes that is adjacent to the Northway on the East side of Dixon that might be better suited as professional offices. Maybe we ought to have Chris take a look and rewrite professional office zoning and then we might have a better fit for the Meath property and Hayes Property. Noted he will be staying out the discussion on the Meath property. Councilman Boor-The only thing I will add is, I like what you are saying, I think it is a great idea but you run a risk that they say ok, fine we will not go office professional and they put the fifteen houses there. They are ready to do that, they have that ready to go. Councilman Strough-The Meath’s have been eager to get that rezoned for two or three years. Councilman Turner-They have been denied before. Councilman Strough-I think the Meath’s would be in favor of the type of professional office …zoning that we are talking about. Could someone contact the Meath’s and see if the three months would be a problem? If we rezone this professional office, would that be a problem? I bet you the Meaths will not have a problem with that. Supervisor Stec-It is worth a phone call. Noted he want to reduce the residential growth in the Town and this would be a good use. Councilman Brewer-I did not say we didn’t rezone, there is an element that he talked about residential so if we are going to do this professional office lets do a professional office. I do not think because Monday is the dead line is a reason to go and do this. Whether there is a project or not I do not think it is proper for our staff to be submitting these applications to us. Supervisor Stec-What if we say we want to do that? Councilman Boor-I wanted to do it all along, I thought it was not a appropriate for residential. Supervisor Stec-I do not want residential in there, I want to change the zoning. Councilman Brewer-To rezone it to would allow residential, multi family residential, so if that is what you are trying to get away from why do you want to do this in a hurray. Supervisor Stec-Requested that we come back to this later… I will close in saying that our three month and our quarterly deadline that is for applications coming to us, so if we want initiate on our 300 SPECIAL TOWN BOARD 01-28-2004 MTG.#6 own we can initiate it next week. If the Town is doing it we do not have to worry about the dead line. Councilman Brewer-That is a fair statement. Supervisor Stec-So we can tell them not to worry about the dead line and we will talk about this later. Councilman Boor-Will notify the Meaths. Supervisor Stec-Received a message from Chip Mellon today that he wants to be placed on an agenda about the tanker. I would like to send a letter to all fire companies to hold off on any vehicles for now until we have a chance to meet with all of you as a group. Agreed to by the Board.
