Please review the general and special conditions included in the permit; these are intended to minimize any environmental disturbance associated with the authorized activity. The Article 15 approval was issued under a special delegation agreement with the Department of Environmental Conservation who normally issues these approvals. This eliminates the need for separate application forms and fees which would otherwise apply to this project. Please note that it is the responsibility of the permittee and the permittee's agent to comply with all permit conditions. Further, the permit is valid only for the activity expressly authorized. Work beyond the scope of the permit shall be considered as work without a permit. The notice enclosed with the permit must be displayed in a conspicuous place near the project site during the entire period of construction and must be suitable protected from the elements. Any failure to comply with the terms of the permit may be treated as a violation of the Environmental Conservation Law. Questions regarding this permit should be directed to the undersigned. FEE REDETERMINATION Our review of this dock complex revealed that it exceeds the width of 40', the limit on width for a single dock. As such, it is considered to be two docks and must be registered as such. Accordingly, we have issued a tentative determination to increase regulatory user fees by$50 per year and have adjusted your account record to reflect the additional dock. You have a period of thirty (30)days from the date of this letter to make written request for reconsideration of this determination should you feel it is incorrect. Any request for reconsideration must, at a minimum, be accompanied by.an explanation of why a reduction in the amount of the regulatory fee imposed is appropriate, a statement of what the revised regulatory fee should be, and appropriate documentary evidence to support the claim. The Commission shall not consider any request for redetermination if a person fails to make the request within the 30 day time period provided herein.
