There was an obvious penetration for a factory built chimney from an installed gas / wood fireplace. Job was being done by the Fireplace Company. My conclusion is that both Simpson Dura Vent standards and NYS Building Code requires this opening top be fire stopped - I suggested cutting (2) metal firestops in half, fitting them into the space and then sealing the mating point with hi temp sealant.
