Dear Mr. Burke,
This office has reviewed the additional Architectural Plans, completed by Aharonian & Associates, for the
proposed Dunkin'Donuts to be located on Aviation Rd, Queensbury (T). The submitted plans have
adequately addressed a number of issues indicated in this office's September 26, 2008 correspondence,
and therefore, this office finds that the application to operate a Food Service Establishment to be
acceptable, pending the satisfactory completion of a pre-operational inspection by a representative
of this office, and under the following conditions:
• As stated in this office's September 26, 2008 correspondence, the type and concentration of your
intended sanitizer must be verified prior to its use.
• You must verify your intended method for insect intrusion from the drive-thru window.
• If the basement storage area is to be used for food or food preparation products, it must be
properly finished.
• You must ensure you have an contract with an acceptable hauler to periodically clean the interior
grease-trap. You must monitor the grease trap to ensure the unit remains properly functioning, and
that no back-up of sewage be allowed into the facility.
• You must ensure a written statement of compliance is submitted from your design professional,
which verifies the proper installation of all equipment in accordance with the approved plans. You
must obtain a Certificate of Occupancy from the local Building Department or Code Enforcement
Office.
As a reminder, this office must conduct a pre-operational inspection prior to the facility receiving a Permit
to Operate. Furthermore, New York State Sanitary Code, Subpart 14-1.190 requires a current
permit to be issued by the permit-issuing authority prior to operation of the facility. Once the
project is competed, please contact this office to schedule a pre-operational inspection.

Dear Mr. Burke,
This office is in receipt of an Application for a Permit to Operate, a Notice of Intent to Construct, Enlarge
or Convert a Facility, a Food Service Preparation Guide, interior Architectural Plans, and numerous
ancillary documents, received in this office September 18, 2008, for the proposed construction within the
Mobil Mart, located at 474 Aviation Rd, Queensbury (T) of a Dunkin'Donuts. In reviewing the
documents submitted, this office finds the application for a Food Service Establishment to be incomplete,
and request the following information be provided:
Food Service Establishment Preparation Guide
• On Page 19, you indicate the intended use of a Kay Chemical sanitizing system, although no
chemical type is indicated. You must ensure any chemical sanitizes be used in accordance with
Subpart 14-1.112 of the New York State Sanitary Code (NYSSC), and that no toxic residue is left
on the surfaces. If this sanitizer is a quaternary ammonia-based compound, you must ensure
compliance with section 4-501.114 of the U.S.Food and Drug Administration Food Code (2005).
• On Page 20, the interior finish schedule was not properly completed. Architectural Plans
submitted with your application also failed to adequately detail interior finishes, in particular the
food preparation area ceiling, indicated on sheet D3 as "specified by Dunkin Donuts".
• Also on Page 20, you indicate "N/A" when asked if air curtains will be installed at the facility.
Please clarify your intended method for excluding insects from the facility at the drive-thru
window.
Interior Architectural Plans/Technical Specifications Sheets
• No equipment manufacturer technical specification sheets, or equipment schedule detailing the
proposed equipment, was included with the submission. Please provide the information for all
equipment intended for installation at the facility.
• No finish detail was provided for the basement storage area, except for flooring. If this area is to
be used for the storage of any food or food preparation supplies, you must indicate the proposed
finishes for all surfaces, including the ceiling material.

• As a reminder, once completed, you must obtain a Certificate of Occupancy from the local
Building Department or Code Enforcement Office. Please contact that office for further
information and ensure that once approved, a copy of the Certificate of Occupancy/Compliance is
forwarded to this office for filing. This office will not issue any Permit to Operate without
proof of a current, valid Certificate of Occupancy or Certificate of Compliance.
• Finally, not indicated on your floor plan, basic CPR equipment must be maintained at the facility.
A brochure detailing your requirements has been included for your review.
This office must conduct a pre-operational inspection prior to the facility receiving a Permit to Operate.
Furthermore, New York State Sanitary Code, Subpart 14-1.190 requires a current permit to be
issued by the permit-issuing authority prior to operation of the facility. This office must receive the
