COUNCILMAN ANTHONY METIVIER COUNCILMAN RONALD MONTESI COUNCILMAN JOHN STROUGH COUNCILMAN TIM BREWER RESOLUTIONS RESOLUTION AUTHORIZING HIRING OF CHARLES DYER AS TEMPORARY ANIMAL CONTROL OFFICER RESOLUTION NO. :502, 2008 INTRODUCED BY: Mr, Tim Brewer MOVED FOR ITS ADOPTION SECONDED BY : Mr. Anthony Metivier WHEREAS, Charles Dyer was first hired as a Code Enforcement Officer in the th Town of Queensbury’s Department of Building and Codes on February 7, 2005, and WHEREAS, by Resolution No.: 479,2008, the Queensbury Town Board authorized the hiring of Charles Dyer as a temporary Laborer to work for the Town’s Building and Grounds Department, and WHEREAS, the Town’s full-time Animal Control Officer is currently out of work, and WHEREAS, the Town Board wishes to transfer Charles Dyer from his temporary Laborer position to the Animal Control Officer position on a temporary basis or until such time that the Town’s full-time Animal Control Officer returns to work or until Mr. Dyer is reappointed to the position of Code Enforcement Officer, and WHEREAS, discussions were had with CSEA who agreed to this temporary assignment with the understanding that the position is and remains a bargaining unit position and that dues must be paid by Charles Dyer for the time that he holds the position, and WHEREAS, the Town acknowledges that no permanent reassignment shall take place absent posting consistent with the Collective Bargaining Agreement, 2 SPECIAL TOWN BOARD MEETING 10-27-2008 MTG. #48 NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the hiring of Charles Dyer as the Town’s Animal Control Officer on a temporary basis effective th October 27, 2008 until such time that the full-time Animal Control Officer returns to work or until Mr. Dyer is reappointed to the position of Code Enforcement Officer, and BE IT FURTHER, RESOLVED, that Mr. Dyer shall be paid at the rate of $18.4765 hourly, to be paid from the appropriate payroll account, and Mr. Dyer shall also pay Union dues during such time of his appointment, and BE IT FURTHER, RESOLVED, employee benefits shall continue for Mr. Dyer without break in service or loss of seniority, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or Town Budget Officer to complete any forms and take any action necessary to RESOLUTION AUTHORIZING HIRING OF DAVID HALL TO HANDLE DOG BITE INCIDENTS ON TEMPORARY BASIS RESOLUTION NO. :503, 2008 INTRODUCED BY Mr. John Strough WHO MOVED FOR ITS ADOPTION SECONDED BY : Mr. Anthony Metivier 3 SPECIAL TOWN BOARD MEETING 10-27-2008 MTG. #48 WHEREAS, the Town of Queensbury’s full-time Animal Control Officer is currently out of work, and WHEREAS, the Town Board wishes to hire the Town of Warrensburg’s Animal Control Officer, David Hall, on a temporary basis to handle the Town’s dog bite incidents until such time that the Town’s full-time Animal Control Officer returns to work, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the hiring of David Hall to investigate and pursue reports of dog bites or attacks consistent with th §121 of the Agriculture and Markets Law on a temporary basis effective October 27, 2008 until such time that the full-time Animal Control Officer returns to work or until further action by this Board, and BE IT FURTHER, RESOLVED, that Mr. Hall shall be treated as a Contractor and therefore will not receive benefits and will receive an IRS Form 1099 reflecting all payments made to him, and BE IT FURTHER, RESOLVED, that Mr. Hall shall be paid $50 per incident, such fee to include follow-up and completion of the dog bite case, however, should the matter go to Court, then the Town shall pay Mr. Hall for his time related to the Court action at the rate of $15.15 hourly, plus mileage, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or Draft Zoning Code 4 SPECIAL TOWN BOARD MEETING 10-27-2008 MTG. #48 DISCUSSIONS: EDC ANNUAL UIPDATE Mr. Len Fosbrook-Introduced John Davidson Incoming Chairman of the Board and Jack Daminack Treasurer of the Board and Jennifer Switzer Director of Finance and Empire Zone Specialist Mrs. Switzer-Reviewed for the board the many different stats that are used by EDC to measure economic growth in Warren County. Real Market Full market value, shows a steady increase from 2004 to 2008 as a whole and for each municipality. The commercial and industrial real property full market value has grown as well. Sales tax revenue is important to the Town and the County. Occupancy Tax Revenue in retrospect almost everyone agrees that this was the right decision, we are tourism, we work on making this a four season tourist area. Great Escape Lodge and Country Inn Suites in the Town of Queensbury are two of the businesses that had a direct correlation to the economic growth. Medium home prices we are below the northeast and the US but compared to the Northeast and the US we have a steady growth. Employment figures, non farm employment in Warren County has been a steady increase. Unemployment rate-compared to New York State and the US we have seen some what of a decline but not significantly. Average Annual wages-steady increase We are looking for businesses that bring both jobs and benefits. Per capita income compared to New York State and the US we are not at the same levels but we are seeing the same growth and increase. Population in Warren County-continues to increase at a steady rate. Mr. Fosbrook-Spoke on the project priority list for 2008. 1. South Queensbury Airport Corridor – complete development zone, looking into use of grants for properties that are contaminated about ready to go to RFP for administration to move that forward 2. Revitalization of downtown Glens Falls major project 3. Exit 18 Development Zone – Tribune Media, also the Carey Industrial Park which we are involved with, doing a study to determine what it would take to put sewer infrastructure in there. With a seventy two thousand dollar grant we did do a sewer extension out to Tribune, that also serves the EMS building out there. 4. Spoke on North Creek revitalization 5. Marketing and Business attraction – now that there are shovel ready sites in the Queensbury Industrial Park- 40 acres inclusive 8 sites, Tech Nano Park another 40 acres, 40 acres in the Carey Industrial Park, we are kicking up the marketing program .. we represent all of these properties through two organizations, pigging backing on other major marketing initiatives, a. Center for Economic Growth and b. New York State Economic Development Council representing us at a variety of shows, both nationally and internationally … Developing brochure for the Queensbury Industrial Park Mr. Jack – It is our responsibility to create wealth in the community. Wealth generates taxes, also markets and markets drive businesses and create new businesses and those new businesses create jobs which creates more wealth. Retention is a big part of our business keeping businesses from moving out of the area and helping them grow, an example of this is Tribune Media deal that we put together. Jobs created in the Town of Queensbury between 2004-2007 - 221 jobs in medical device were created 305 jobs in tourism - looking to the future at the Industrial Park we feel we can create a minimum of a 1000 jobs adding all three up we are looking at a combined total of impact of some where’s in the neighborhood of five hundred and sixteen million dollars. Noted that they appreciate the cooperation of the Town on these projects. Discussion held on Luther Forest and its impact on Warren County. Counsel to Luther Forest-Requested that the Town of Queensbury increase its support of EDC. Noted that the Fab Four manufacturing jobs 1400 construction jobs 4300 - construction payroll 210 million - annual payroll of A&B 88 million - Original service jobs 202 million - permanent jobs by 2014 the 1400 jobs an additional 550 jobs 5 SPECIAL TOWN BOARD MEETING 10-27-2008 MTG. #48 by 2014 - Total Fab and Fab related 6500 jobs. The Town of Queensbury is way ahead of other towns in zoning and planning… Board Members wish to reviewed the documents that were submitted. DISCUSSIONS: GREAT ESCAPE SEWER BILL Representative of Great Escape-The Great Escape has historically been billed on water intake as opposed to sewer use, meters have now been installed, the problem we have is that the park has taken all its water from Queensbury they elected not to dig wells. There is a huge disparity, in 2006 they were billed for sixty eight thousand gallons when in fact they used sixty nine hundred gallons, in 2007 they were billed for fifty four million gallons when they used five million gallons, so the total amount of money which we are looking for by way of adjustment is one hundred and seventy four thousand. We are not looking for a check. We would like a credit over a reasonable period of time so that the park can re-cop what is a disparity. In 2008 the Great Escape has paid seven hundred and twenty seven dollars in sales tax, the bed tax from the lodge so far is running at three hundred and forty one thousand dollars. The lodge has contributed in sales tax this year eight hundred and seventy thousand nine hundred and ninety three dollars with two months to go. The total contribution by this company in 2008 so far is one million nine hundred thirty nine one hundred and fifty nine dollars. Councilman Brewer-Why don’t we bill on discharge? Wasterwater Director Shaw-We do not bill anyone on discharge because a second meter to do that is impractical. Great Escape’s problem was that they had master meters, and it took time to get their sub-meters installed where the building were discharging into the sewers. Councilman Brewer-Did we take into consideration the raging river and splash water kingdom when we set up the sewer district? Director Shaw-In the original design we used Great Escape numbers. Supervisor Stec-The more concrete we can get for backup the better we are, where did the revised gallons come from? Representative of Great Escape-Those are taking the last two years on meters and using the percentage of the dischargeable water and the non dischargeable the percentage we were billed on are the percentage we used for calculating this. Supervisor Stec-Question how close the figures were compared to ours? Director Shaw-Very close to being almost to what we would figure it, it is in rounding. Supervisor Stec-Noted the town will be speaking to counsel on what structure we can legally do. Councilman Strough-Questioned if the water used to clean filters at Raging River is that calculated as discharge to sewer? Unknown- Not that I know of, I do not know the answer to that. Councilman Strough-Five percent is not hooked up, where is that five percent? Director Shaw-That five percent is accountable in these numbers. Councilman Strough-Questioned if this park has been compared with other parks having similar patrons regarding water and sewer usage? 6 SPECIAL TOWN BOARD MEETING 10-27-2008 MTG. #48 Director Shaw-No. Supervisor Stec-The only two years we working on is 2006-2007 going forward you are metered. Asked that Director Shaw go through the figures one more time and provide the Town Board with a report giving us his confidence level. Need to then discuss what time period will be used to phase the credit back and work on the third year data as a check. Representative of Great Escape-Hope to see from the Municipality a three year credit usage time line. Board agreed to go forward and contact Town Counsel on this proposal to make sure we have the authority under law, to have a decision before the end of the year. DISCUSSIONS: Councilman Brewer-Spoke to the Board regarding a letter from Craig Brown. Supervisor Stec-The individual’s Attorney has been in contact with the Town. Councilman Strough-Spoke about re-routing the trail (Rush Pond) following the existing path will have to do a cultural study of that area…this would cost approximately thirty four hundred…would like approval to go ahead and have this done before snow flies. Board agreed to the study Councilman Metivier-Regarding letter from John Salvador Supervisor Stec-Town Counsel is reviewing that. Councilman Metivier-Fire Trail on Assembly Point, the only issue is at the end of the trail there is a right of way that is owned by Dennis MacElroy and there are three trees and one of the trees is actually dead and has to be taken down we don’t know whose tree it is. We need to have VanDusen and Steves to go out and survey the corner. They want this for emergency access only. Town Board agreed Councilman Brewer-Stop sign issue in Bedford Close, the Highway Supt. has suggested Revere Road stop sign…will be a resolution next week to set a public hearing. Questioned the Board on limitation of extensions for hooking up to sewer line. Supervisor Stec-We need to put the word out that you will have two to three years and then you must hook up.
