1.0DRAFT ZONING CODE
Supervisor Stec-We are looking to go back to working off the Planning Ordinance
Review Committee’s recommended document.
Councilman Montesi-Requested a list of the items that PORC did not review.
Supervisor Stec-Need to work on the Commercial Corridors that were proposed …want
to honor the Comprehensive Land Use Plan.
Sr. Planner Baker-listed the following open items:

Shore line set backs in the LC and Neighborhood and Residential
Districts
?
Road frontage requirements in Rural Residential Zoning Dist.

On commercial zones – to remain consistent with the adopted
Comp. Plan in Article III Use Table, the Board took out a lot of the
residential uses as permitted in the commercial districts; my
feeling is that they need to go back in.
Councilman Strough-Asked what part of the Comp Plan says that housing is supposed to
be in Commercial Districts on Route 9 and Quaker Road did not believe it was in it.
Supervisor Stec-If it doesn’t we are all in agreement that we can live without residential.
Sr. Planner Baker-I think what will happen is that market will dictate the uses. Make sure
the code says residential is allowed only as a component as mixed use and not sole use.
Councilman Strough-On Main Street in the Comp Plan is that the first floor will be
retained and upper floors will be variable depending on market. My concern is that we try
and maintain the commercial as commercial zones because it is better for the community.
Supervisor Stec-Stu checked the Comp Plan and John is right and we all agree we like it.
We are looking for an adopted code and at a later date a guide tool for the adopted code.
DISCUSSION – SUBDIVISION REGS. ARTICLE 11
Board agreed to pull Article 11 out and doing Article 11/Chapter 183 review together we
will not have it in two locations.
Sr. Planner Baker-Keep it in right now but when we change the subdivision regs. then we
pull Article 11 Article 11 will be a component of Chapter 183.

changed to Route 9 East side
North District-From Montray northern terminus (Sweet Basils) Adirondack look on both
sides and Montray south to the City Line mixture
SECTION THREE NARRATIVE - Narrative ok.
DISCUSSION: DIX AVENUE - BOULEVARD AND RIVER STREET -
Councilman Strough- When referring to Main Street Zoning Dix Avenue should be
included in that description.
Correction- page 5 it says “from Exit 19 Aviation Road the North Side of Aviation Road
we have the Aviation Mall” that needs to be changed to the South side of Aviation Road
is the Mall. The next paragraph to say the North side we have a moderate …
Transient Merchants- Recommendation D4- Regulate the outdoor display of merchandise
on landscaped areas within twenty five feet of the edge of the paved surfaces of Route 9
and paved surfaces of 254.
VI. DESIGN GUIDELINES
Correction- Page 10 VI: Change title from Design Guidelines to Design Standards.
Correction- Page 18: Sign Ordinance: Change height of signs from 25 feet to 20 feet.
Change to state: all exterior sign lighting shall be down cast or internal.
SIGNAGE
Correction- Page 18: Change “K” to 20% and change 6 to 2
Correction- Page 20: Delete C & M Zones
Correction- Page 20: A) Freestanding Signs- Down grade from 50 to 45 and a fifteen
foot setback and offer 60 square feet instead of 64 square feet.
Correction- Page 22 D2E Add Language “up to a limit of 200”- Reads as follows:
“Linear setback distances of greater than 100 linear feet from the front property line shall
be permitted an additional 10 square feet of sign area for each 10 additional feet of
setback distance up to a limit of 200”.
Correction- Page 22 D2E: Delete the percentage reference
Correction- Page 23 (f) Change to read “Roadside stands in all zones shall be permitted
one sign:
Correction- Page 23 4(a) Change to: “No freestanding sign shall exceed a height greater
than 20 feet.
Correction- Page 24 (b) Change to: “The height of such signs shall be measured from
grade level (delete- or entry level of the building or structure, whichever is lower, and
shall include supporting structures)

TABLE 5- PARKING REQUIREMENTS
Correction- Page 34 Business Service- 1 per 300 square feet
Correction- Page 34 Delete: Enclosed Shopping Mall
Correction- Page 34 Food Service: 1 per 4 seats plus 1 per 2 employees, whichever is
greater or if a tavern is present is also present, the requirements shall be the greater of the
two uses (delete “restaurant” from table)
Correction- Page 34 Delete “Gasoline Station” (also delete from use table)
Correction- Page 34 Golf Driving Range- add parking requirements-1 per stall and 1 per
employee
Correction- Page 34 Hotel- add parking requirements- 1 per room and 1 per employee
Correction- Page 34 Library- add parking requirements- ITE standards
Correction- Page 34 Limousine Service- add parking requirements- 1per company
vehicle and 1 per employee
It was the decision of the Board to return to this section once they receive the new ITE
Standards
Correction- Page 36 E. Bicycles Facilities- Change to: Any use required to have 10 or
more parking spaces shall supply one bicycle rack per 10 spaces.
Page 36- Pedestrian Accommodations add language as suggested by the Comprehensive
Land Use Plan.
SUPERVISOR STEC- We will meet again on Wednesday, December 10, 2008 to discuss
Main Street.
