Dear Mr.Catlin,
This Is in response to your letter dated May 23,2012 regarding the recently issued
Matthews Class A Marina permit.
The Lake Geroge Park Commission administers Article 43 of the Environmental
Conservation Law and rules and regulations issued pursuant thereto.Among the regulations
are provisions which establish permit requirements and standards for the construction and
operation of marinas on Lake George.
The regulations require that all marinas provide parking,restrooms and garbage
disposal to their customers.The foundation for these rules was to ensure that marinas do
not produce negative impacts on surrounding neighborhoods or the Lake.
The Matthews marina application was the subject of review at the Commission's
February and March 22,2012 meetings.The application proposed to allow customers
access to restrooms at the Castaway Marina.However,during their deliberations the
Commission determined that this remote access ‘would not meet regulatory requirements and
approved the application contingent upon the installation of an on-site toilet,Resolution
#2012-20 is enclosed for your information
The Town of Queensbury has review authority over the installtion of port-a-johns.

WHEREAS.the applicant has applied for @ permit to operate a Class A Marina offering up to
two seasonal berthing spaces;and
WHEREAS the Lake George Park Commission has reviewed the application,supporting
documents,comments received and other information which appears in the
record;and
WHEREAS.the Commission has made a determination that the project is an Unlisted action
pursuant to the State Environmental Quality Review Act 6NYCRR 617-8 and,as
Dead Agency for the purposes of the State Environmental Quality Review Act,has
made a determination that the project will have no significant impact on the
environment;and
WHEREAS.the action is considered to be a Major project pursuant to 6 NYCRR 645-5.3 and
public notice has been published and distributed as required;and
WHEREAS the applicant has demonstrated that the facility complies with the Class A Marina
requirements of 6 NYCRR 646-1.2;and
WHEREAS the Commission finds that the project will have no adverse impact on the health,
safety or welfare of the public,the environment or the resources of the Park;will
not alter the essential character of the area in which it is proposed;will not lead to
congestion in the Park and will not have an undue visual,cultural or audible
impact on the neighborhood or the Park.
NOW THEREFORE BE IT RESOLVED
The Lake George Park Commission hereby resolves to approve the above
application,with the following condition:
A portable toilet,visually screened from neighbors and the lake,must be provided
on the site between May 1 and October 31 for customers of the marina.

Dear Sir:
This letter is in response to a Park Commission Permit #5234-1245234-4-12
Issued to Mr.John Matthews,for a class A Marina on property adjacent to our
home,at 5 Grey Ledges Drive,Dunham,s Bay Lake George,NY.
We attended the Town of Queensbury's Planning Board Meeting in January
2012 where this project was presented.It was our understanding at theconclusionofthemeetingthattheapprovaloftheprojectincludedgarbage
service,pump-out and bathroom facilities to be provided to the renters at Mr.
Matthews's business at Castaway Marina on the lake not on site.
We are extremely disappointed and upset with the Park Commission decision
to allow/require a port-a-potty be placed on the property.This port-a-potty is
very close to our home.|believe the Town of Queensbury would never have
agreed to this project if they were aware of what the Park Commission's
decision was going to be.
With the exception of the Marina at the end of the bay,Dunham's bay is aresidentialneighborhoodwithamajorityofoldersmallhouses.Allowing or
requiring an outdoor bathroom in this tight residential neighborhood is
unreasonable and certainly negatively impacts the character of the
neighborhood.
We are officially registering a complaint in the hope that the Park Commission
will investigate and recognize that this decision is unfair and has a negativeimpactontheabuttersandotherresidentsonDunham's Bay.
