Upon the application of Stephen Amell,filed pursuant to 19 NYCRR 1205 on July 12, 2007,and upon all
other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the alteration of a one-family dwelling, one story in height with a basement,located
at 15 Michaels Drive,Town of Queensbury, County of Warren, State of New York.
Relief is requested from:
19 NYCRR Part 1220, The Residential Code of New York State, Section R305.1 exception 3,which
allows habitable space in basements to have a ceiling that projects to within 7 feet of the finished floor; and
beams,girders,ducts or other obstructions to project to within 6 feet, 8 inches of the finished floor. [The
petitioner requests habitable spaces in a basement with ceiling heights less than allowed.]
19 NYCRR Part 1220, The Residential Code of New York State, Section R314.3,which requires that the
minimum headroom in all parts of the stairway be not less than 6 feet, 8 inches. [The petitioner requests a
stairway headroom less than required.]
FINDINGS OF FACT
1. The basement is being altered and habitable spaces are being created with a patented system developed
by the Owens Corning Corporation in which finished panels are installed on the interior of the foundation
walls and a suspended ceiling is hung from the floor joists above. Due to the elevation of the existing floor
joists,a Code-complying ceiling height can not be achieved in the basement.
2. The finished ceiling height will be 6 feet 8 inches,and the height to the bottom of a beam and duct will be 6
feet 2 inches. The percentage of the area under the beam and duct to the area of the entire altered area is
less than 12 percent.

3. In order to achieve higher ceiling heights, major construction would have to be undertaken to either raise
the floor above or to lower the basement floor.
4. The existing stairs to the basement did not have a landing at the bottom of the run and had a very small
space at the bottom to make the turn due to the location of the foundation wall. The contractor for the
basement alteration removed the first three risers, constructed a square landing, and constructed three new
risers to the basement floor. At the landing turn,the top new riser has inadequate headroom to the double
trimmer joists which frame the floor opening for the original stair.
5. Department of State office policy has been to allow minor variations in ceiling and stair headroom height,
such as is described above.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, safety and security benefit to the occupants of the building, and would be physically
impracticable in light of the fact that raising the first floor or lowering the basement floor would be cost prohibitive.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section
R305.1 exception 3, to permit habitable space in a basement with ceiling heights less than allowed, and Section
R314.3, to permit a stairway headroom less than required, be and are hereby GRANTED with the following
condition:
1. That the alteration shall comply with the Residential Code of New York State in all other respects.
This DECISION is issued under 19 NYCRR 1205.6. Unless obiected to by the petitioner is a writinq received
by the department,the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of this
application.
