COMPENSATION THIRD PARTY CLAIMS MANAGEMENT

WHEREAS, by Resolution, No.: 208.2000, the Queensbury Town Board authorized the
Town to assume liability for the Town’s remaining workers’ compensation claims incurred while it was
participating in the Warren County Self-Insurance Program and authorized engagement of Cool Risk
Management Services (Cool) to provide third party claims management services for the Town’s

workers’ compensation claims predating January 1, 2000 that were originally filed with and managed
by the Warren County Self-Insurance Program, and
WHEREAS, Cool has advised the Town that as a result of changes in insurance regulations,
Cool can no longer serve as the Town’s Third Party Administrator (TPA), and
WHEREAS, by Resolution No.: 236,2018, the Town Board authorized renewal of the Town
of Queensbury's Workers’ Compensation Policies with the Public Employer Risk Management
Association, Inc., (PERMA), and
WHEREAS, PERMA has now offered to also serve as the Town’s TPA and administer the
Town’s third party claims through PERMA’s partner Sedgwick, and
WHEREAS, the Town Board therefore wishes to engage the services of PERMA to provide
third party claims management services for these workers’ compensation claims, and
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
the Public Employer Risk Management Association, Inc., (PERMA) to serve as the Town’s Third
Party Administrator (TPA) and provide third party claims management services for the Town’s

workers’ compensation claims predating January 1, 2000 through PERMA’s partner Sedgwick, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute any documentation necessary and the Town Supervisor and/or Town Budget Officer to take
any other actions necessary to effectuate the terms of this Resolution.

WHEREAS, by Resolution No.: 218, 2014, the Queensbury Town Board authorized and
awarded the Town of Queensbury's Workers' Compensation Policies to the Public Employer Risk
Management Association, Inc., ("PERMA"), and
WHEREAS, by Resolution Nos: 195,2015 and 225,2016, the Town Board authorized its
renewal of the Town's Workers' Compensation Policies to PERMA and by Resolution No.:
171,2017, the Town Board again authorized its renewal for July 1, 2017—June 30, 2018, and
WHEREAS, the Town requested and received three (3) quotes for renewal of the Town's
Workers' Compensation Policies for the term of July 1, 2018 — June 30, 2020 and the most
favorable quote is from PERMA, and
WHEREAS, the Town Board wishes to therefore renew such Policies with PERMA for
July 1, 2018 — June 30, 2020 as set forth in PERMA's Quote dated June 7, 2018 and presented at
this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the renewal of the Town
of Queensbury's Workers' Compensation Policies with the Public Employer Risk Management

Association, Inc., ("PERMA") for July 1, 2018 — June 30, 2020 as set forth in PERMA's Quote
dated June 7, 2018 and presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
sign any needed Agreement and/or any other documentation and the Town Supervisor, Budget
Officer and/or Purchasing Agent to take all actions necessary to effectuate the terms of this
Resolution.

JANUARY 1ST, 2000 AND ENGAGEMENT OF COOL RISK
MANAGEMENT TO PROVIDE THIRD-PARTY CLAIMS MANAGEMENT

WHEREAS, on January 1S`, 2000, the Town of Queensbury changed workers compensation
insurance plans and is no longer a participant in the Warren County Self-Insurance Program
(Warren County), and
WHEREAS, Warren County has been administering and paying obligations on old workers'
compensation claims since January 1st, 2000, and
WHEREAS, the Town of Queensbury wishes to assume future liability for the Town's
workers compensation claims incurred while participating in the Warren County Self-Insurance
Program less the remaining balance of the Town's Contributed Reserve with Warren County, and
WHEREAS, the Queensbury Town Board therefore wishes to engage the services of Cool
Risk Management Services (Cool) to provide third-party claims management services for these
workers' compensation claims, and
WHEREAS, as delineated in Cool's April 25`h, 2000 proposal, Cool has offered to provide
these services for an amount to be calculated and payable as follows:
Initial Claims: 23 @ $350 =$8,050 $5,000 payable in advance for Year 2000
$3,050 payable January 2001
Claims Open May 1, 2001 @$350 each Payable in May 2001
Claims Open May 2, 2002 @ $300 each Payable in May 2002
Thereafter claims will be administered with no additional administrative fees until all are
closed;
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes the Town
of Queensbury to assume liability for the Town's remaining workers' compensation claims incurred
while participating in the Warren County Self-Insurance Program, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs engagement of the
services of Cool Risk Management Services to provide third-party claims management services for
the Town's workers' compensation claims predating January 1 S`, 2000 that were originally filed
with and managed by the Warren County Self-Insurance Program, such services to be paid at the
rates set forth above and as presented in Cool's April 25th, 2000 proposal presented at this meeting,

BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor
and/or Town Comptroller to execute any documentation necessary in connection with this
Resolution and further authorizes and directs the Town Comptroller to handle all actions described
in this Resolution and take such other administrative responsibilities and actions necessary to
effectuate the terms of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Town Comptroller and/or Town Counsel to notify Warren County Self Insurance of this Resolution
and apply for reimbursement of the remaining balance of the Town's Contributed Reserve together
with an accounting therefor.
