We as a Town Board and with our Department Managers have put together a 13 page Pandemic Response Plan which we feel responsibly deals with the COVID virus. This plan is being continuously updated and will be posted on the town’s website. I did declare an emergency situation so executive orders will apply. 1.0 PUBLIC HEARING Public Hearing – Proposed Improvements of Queensbury Consolidated Water District Facilities – Ridge Road Water Main Rehabilitation and Lining Project Notice Shown Publication Date: March 13, 2020 CHRIS HARRINGTON, Water Superintendent & Director of Wastewater-Yes, this, like John mentioned, this has been quite the ordeal. Ridge Road, between Quaker and Cronin, we’ve had about twenty main breaks over there in the past twenty years and I think last winter we had about three or four main breaks and it happened in a matter of a couple of weeks. So, of course it’s 3 o’clock in the morning, I look at the road, I’m wondering, when are they going to pave this road? I put a call into New York State DOT and they’re getting ready to rehab the road all of the way to the city line to 149 I believe. So I started working with the state, oh first we engaged Chazen Engineering. They came up with a preliminary design in June to put the water main on the west side of the road but unfortunately what’s on the west side of the road are all of these pretty culturally significant rock walls. Okay, and I think everybody … in their database, I think everyone thinks the same, we’re not going to touch those walls and cause all kinds of mayhem there. So, the next thing I want to do is work in the road, okay, just do a relay. Meaning, take the old pipe out, put the new pipe in, temporary main because there’s a lot of bedrock up there, a lot of bad conditions. I don’t want to go outside of the wickets, if you will. Talk to DOT and DOT says, you can’t do it, they don’t want anything under their paving. We also have a problem Regular Town Board Meeting, 03-23-2020, MTG #12 540 in the northern section where we have gas lines. They had somebody put their gas line on top of the water. Okay, so that’s also a problem. So, after talking to DOT, their rules and regulations under 17NYCCR, we tried to approach the DOT but through a betterment. Okay, so let’s stay on the east side of the road, we’ll go up about three and a half foot of the pole line and we’ll do a part of a betterment. We submitted our plan to DOT in late July, we have a meeting in late August and they pulled the rug from out under us. They said no, you can’t put it there, you’re going to put it on the other side of the poles and you’re going to direct home drill it and that’s the way it’s going to be. We’re like well, we don’t want to direct home drill it and if I go on the other side of the poles, we’re going to be on people’s lawns and then we have to get easements and that means we have to relocate leach fields. I said, that’s going to be a nightmare job. SUPERVISOR STROUGH-Plus there’s, you know shale right there. MR. HARRINGTON-Right. The ground conditions are very, very bad. So, what do I do now? So we are at one, two, three, four options that I don’t feel any of them, you know, DOT is not going to let me do some, the walls aren’t going to let me do some. What are we going to do? I know lining is a big part of rehab. They do a lot of lining on sewers, they’ve been doing it for years, that’s not a … Looking more into it, they do lining in water mains, they’ve been doing it in Canada for about twenty years, several companies do it. We sat with several companies, this particular one and they said that this was a pretty big job to do. So, after going back and forth with Chazen, with some of the other vendors, I thought this was probably the best way to go about it. So, what we’re going to do on Ridge Road from Quaker all the way up to Cronin, we’re going to line the pipe. We’re going to put a type four structure lining in. Okay, and this is done by digging about maybe thirteen pits, putting a liner in, steaming it and then making the connections. Before that, we’re going to put temporary water in. So, what we’re going to do is put temporary water up the sides. Okay, the Queensbury Water Department was planning do that and once the water main is in, the temporary water is in, the contractor will come in, put this lining in, rehab, pave and then we would dissemble the temporary water. So, that’s where we’re at now. Chazen Engineering put an engineering report together, we’re about one point three eight million dollars. This is not cheaper than doing it the way that I wanted to do it but actually it’s the only way that I can really be able to do it. I think everyone here knows about getting easements, it’s a very difficult job, we all know Main Street and that would take quite a bit of time. And also worry about leach fields and I don’t think anybody’s going to be happy about digging up their front lawns to put a water main in their front lawn. We’re also asked tonight that nobody is going, I’ve had a couple of people call up, worried about some things, I am reaching out to them, they have some issues but I think they can be easily clarified. The project should take about six to eight weeks. We’re hoping sometime this summertime to do this but I want to caution you, we’ve tried to send comments to National Grid, we’ve got no comments back. The Department of Health is a little busy right now, got no comments back. And the big one is, Department of Transportation. We sent plans to them about two or three weeks ago, we said we need your comments, we have not heard from them. We gave them a deadline of March st 31 to give the comments and I have a very difficult time to think that they’re going to be back to us, because they’re probably busy too and short staffed and all of that with that kind of thing that’s going on. The engineers were very worried about putting plans out on the street that doesn’t have the Department of Transportation review because they’re afraid to go out and we start working and DOT may have issues with the means and protection of traffic that was put together for the plan. So, I have to talk to the engineer and see what we’re going to do even if we do get permission to bid. So, that’s where we are at. It’s a cutting edge technology that we’re going to use, one point four million dollars and I am hoping that we can get this going… SUPERVISOR STROUGH-And it won’t be ripping up all of Ridge Road, I mean because they just need to do it in parts and then they will be able to line part of it and then move to the next section and so forth. People are worried about their stone walls and things like that. I don’t think they need to worry about the stone walls. Regular Town Board Meeting, 03-23-2020, MTG #12 541 MR. HARRINGTON-Yea, it’s about thirteen pits, they are about six foot by eight foot. We put this, like a resident type of white liner in and then they’ll pull it through. It’s less invasive, no doubt. A lot of time they use this in a lot of urban landscape, you know, downtown so businesses aren’t affected by it. This is also a technique in Canada a lot, I know the City of Rochester used it, they’re pretty happy with it, Monroe County just used it as part of their matrix pipe solutions. New York City DEP has used it, the Port Authority has used it. So, it’s not only been used in Canada quite extensively in Toronto and Montreal, it has been used quite a bit here in New York State. So, I think it’s a tried and true technology over the past twenty years. So yea, hopefully we can do it. DOT has also talked to me, they can delay the paving four more years if necessary. So, it’s not like it’s next year or never so we might have some wiggle room there if we can’t get comments from DOT and the engineering doesn’t feel comfortable about going out to bid. NO PUBLIC COMMENT PUBLIC HEARING CLOSED RESOLUTION AUTHORIZING PROPOSED IMPROVEMENTS OF QUEENSBURY CONSOLIDATED WATER DISTRICT FACILITIES – RIDGE ROAD WATER MAIN REHABILITATION AND LINING PROJECT RESOLUTION NO.: 126, 2020 INTRODUCED BY: Mr. Harrison Freer WHO MOVED ITS ADOPTION SECONDED BY: Mr. Anthony Metivier WHEREAS, the Queensbury Town Board duly established the Town of Queensbury Consolidated Water District (the "District") in accordance with New York Town Law, and WHEREAS, the Town Board wishes to improve the District’s water transmission facilities by rehabilitating certain existing water main along Route 9L/Ridge Road between Route 254/Quaker Road and Cronin Road (Project) in accordance with Town Law §202-b, and WHEREAS, by Resolution No.: 83,2019, the Town Board authorized engagement of The Chazen Companies (Chazen) for professional Design, Bidding and Construction Phase Engineering Services and establishment of the “Ridge Road Water Main Replacement Capital Project Fund #225,” to fund expenses associated with the Project, and WHEREAS, Chazen has prepared an Engineer’s Report issued March 3, 2020 concerning the Project together with an estimate of its cost, a copy of which Engineer’s Report is duly filed in the Queensbury Town Clerk's Office and made available for public inspection and presented at this meeting, and Regular Town Board Meeting, 03-23-2020, MTG #12 542 th WHEREAS, on March 9, 2020, subsequent to the filing of the Map and Plan with the Town Clerk, the Town Board adopted Order No.: 107,2020 (Public Hearing Order) reciting (a) the proposed improvements; (b) the estimated amount proposed to be expended for the improvements; (c) the fact that an Engineer’s Report describing the improvements is on file in the Town Clerk’s Office; and (d) the time and place of a public hearing on the proposed Water District improvements, and WHEREAS, a public hearing on the proposed Water District improvements was duly held on rd Monday, March 23, 2020 and the Town Board has considered the evidence given together with other information, and WHEREAS, as detailed in the Map and Plan, this is a maintenance and repair project involving no substantial changes in an existing structure or facility, and therefore a Type II action under 6 NYCRR Section 617.5(c)(1) of the State Environmental Quality Review Act (SEQRA) regulations and therefore, no further environmental review is required, and WHEREAS, although the Town of Queensbury is a town partially within the Adirondack Park the District does not contain State lands assessed at more than thirty percent (30%) of the total taxable assessed valuation of the District, so permission of the State Comptroller to the proposed expenditure is not required under Town Law §202-b(5), WHEREAS, the cost of the improvements will be paid from various District funds being a combination of serial bonds and/or bond anticipation notes, current fund balance and/or current funds, and WHEREAS, the Town Board wishes to authorize the proposed Water District improvements in accordance with Town Law §202-b, and NOW, THEREFORE, BE IT RESOLVED, that it is the determination of the Queensbury Town Board that: 1. The Notice of Public Hearing was published and posted as required by law and is otherwise sufficient; 2. It is in the public interest to improve the water transmission facilities by rehabilitating certain existing water main along Route 9L/Ridge Road between Route 254/Quaker Road and Cronin Road in the Queensbury Consolidated Water District as described in the Map and Plan on file with the Queensbury Town Clerk, such improvements generally being the rehabilitation by a Class IV structural lining of certain existing water main along Route 9L/Ridge Road between Route 254/Quaker Road and Cronin Road in the Town of Queensbury; and BE IT FURTHER, Regular Town Board Meeting, 03-23-2020, MTG #12 543 RESOLVED, that the Town Board hereby authorizes and approves the improvements to the Queensbury Consolidated Water District as set forth above and in the previously described Map and Plan and construction of the improvements may proceed and service provided subject to the following: 1. the obtaining of any necessary permits or approvals from the New York State Department of Health; and 2. the obtaining of any necessary permits or approvals from the New York State Department of Transportation; 3. the preparation of definite plans, specifications, a careful estimate of the expense and a proposed contract for the execution of the work and adoption thereof by the Town Board; and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes the expenditure for the improvements as set forth above and in the Engineer’s Report, in an amount estimated not to exceed $1,374,000, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor, Water Superintendent, Town Budget Officer and/or Town Counsel to take any and all actions necessary to effectuate the terms of this Resolution. rd Duly adopted this 23 day of March, 2020, by the following vote: AYES : Mr. Metivier, Mr. Freer, Mr. Ferone, Mr. Strough NOES : None ABSENT: Mrs. Switzer AFTER VOTE: MR. HARRINGTON referred to the wipe in his hand that he will be utilizing to clean the microphone per present protocol and made an announcement to the public to not put the wipes in their toilets, they are causing a great deal of issues in the municipal sewer systems. 2.0 PRIVILEGE OF THE FLOOR FOR RESOLUTIONS ONLY (LIMIT 3 MIN) - NO PUBLIC COMMENT 3.0 RESOLUTIONS Councilman Freer recommended a minor change to first page of attachment of resolution 3.4, letter from C.T. Male Associates, should read wind load. Referred to resolution 3.6 and would recommend in the fourth whereas, changing pleased to satisfied. Further noted that he cannot Regular Town Board Meeting, 03-23-2020, MTG #12 544 support the resolution, not comfortable putting all of our eggs in one basket and I believe we need an in-house HR person for the capability on staff. I understand that we are in a crisis mode, and that we need help with our HR and I am glad to see that you added some additional scope. But, from a long term standpoint, I think it’s the town’s best interest to have in-house HR capabilities and I am not aware of any evidence to support your claim that it will be far less expensive to hire Pinnacle. Supervisor Strough noted that we did use Pinnacle for the salary schedule and we were very pleased with them and they came in much lower than they anticipated. We used them with an employee in the Water Department and we were very satisfied. We are using them with an employee situation in the Highway Department. I will pull resolution 4.6 for a roll call vote. professional, onsite human resources services, and WHEREAS, the Town Board reviewed all submitted proposals, and WHEREAS, by Resolution No.: 352,2019, the Town Board authorized engagement of Pinnacle Human Resources, LLC (Pinnacle) for the provision of compensation analysis services and live and web-based sexual and other forms of harassment training services, and WHEREAS, the Town Board has been pleased with Pinnacle’s services provided to date and therefore wishes to engage Pinnacle for the provision of professional, onsite human resources services as generally set forth in Pinnacle’s March 18, 2020 Consulting Agreement presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of Pinnacle Human Resources, LLC (Pinnacle) for the provision of professional, onsite human resources services at the cost of $90 per hour as generally set forth in Pinnacle’s March 18, 2020 Consulting Agreement, for a period of 12 consecutive months or through March 23, 2021 unless the Town provides 30 days advance written notice of cancellation, and BE IT FURTHER, Regular Town Board Meeting, 03-23-2020, MTG #12 545 RESOLVED, that the Town Board further authorizes that such services shall be paid for from such account(s) as may be determined to be appropriate by the Town Supervisor and Town Budget Officer, and the Town BETWEEN TOWN OF QUEENSBURY AND GLENS FALLS COLLABORATIVE RESOLUTION NO.: 130, 2020 INTRODUCED BY: Mr. Harrison Freer WHO MOVED ITS ADOPTION SECONDED BY: Mr. George Ferone WHEREAS, the Town of Queensbury has received a request for membership and funding from the Glens Falls Collaborative regarding the Glens Falls Collaborative’s creation of maps, panels, ads and/or promotion brochures which will in part promote the Town of Queensbury, City of Glens Falls and their businesses and amenities, at various City events in 2020, such funds to be from Warren County occupancy tax revenues received by the Town, and WHEREAS, such events with respective maps and/or brochures will help to attract a significant number of people to the Town of Queensbury, City of Glens Falls and the general community, thereby serving as an economic development tool for tourism in Queensbury and the surrounding area, WHEREAS, by Resolution No.: 484,2007, the Queensbury Town Board provided for the Town’s receipt of occupancy tax revenues from Warren County in accordance with the Local Tourism Promotion and Convention Development Agreement (Agreement) entered into between the Town and Warren County, and Regular Town Board Meeting, 03-23-2020, MTG #12 549 WHEREAS, the Agreement provides that specific expenditure of the funds provided under the Agreement are subject to further Resolution of the Queensbury Town Board, and WHEREAS, the Town Board wishes to provide funding to the Glens Falls Collaborative in the amount of $1,500 for membership in the Glens Falls Collaborative and panel, logo placement and other recognitions on event promotion brochures, ads and/or maps, with occupancy tax revenues received from Warren County, and WHEREAS, a proposed Agreement has been presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves the Agreement between the Town and the Glens Falls Collaborative substantially in the form presented at this meeting and authorizes and directs the Town Supervisor to execute the Agreement, with funding for the Agreement not exceeding the sum of $1,500 and to be provided by occupancy tax revenues the Town receives from Warren County, to be paid for from Account No.: 050-6410-4412, and BE IT FURTHER, RESOLVED that the Town Board authorizes and directs the Town Budget Officer to take all actions necessary to amend the Town Budget and increase appropriations and revenues as necessary as follows:  Revenue Acct No. –050-0000-51113 Occupancy Tax Revenue $1,500;  Expense Acct. COUNCILMAN FREER (WARD II)  Would like to second Tony’s praise of the whole staff and especially your leadership, John. I think it’s going to get worse before it gets better. I think the economy is going to be burdensome for all of us, both personally and in our responsibilities to the town. We need to be thinking about what we can do sooner than later in terms of our budget and helping people and realizing that some of us are in much better financial situation than some of our neighbors and community members and that whole activity is going to be really painful in terms of recovery. COUNCILMAN FERONE (WARD III)  Referred to the two boards that he sits on, both the Town Board and the Glens Falls Hospital Board of Governors where they have been 24/7 and are doing a great job as well. I think this is a great thing and I wanted to bring it up, and that is the hospital has been receiving a lot of donations from people and companies around the area, equipment, personal protective gear, respirators, things of that nature. I received an email from Harbor Freight on Route 9 stating that they were going to make all of their stock available to the hospital. If anyone out there does have these materials and they want to donate to the hospital, you can reach the hospital supply manager, Dave Carnegie at the hospital number, extension 5051. SUPERVISOR STROUGH –  Read statement distributed to employees that applies to everyone: We're in this Together! As you may have heard, the Governor has declared that we should reduce our at-work workers by 75%. However, he also stipulated that we are expected to provide essential services and operations. I have asked Department Managers to look at further reducing their at-work workforce and do so in terms of relieving workers from being at- work for the entire week, next week. For our employees who are asked to remain home, and work from home if possible, we expect you to be ever vigilant and super responsible, in that, you should also, even when not at work, minimize your exposure to this horrible virus. Yes, we have to do essential operations, like getting food, but at the same time we can minimize our exposure by not having company over or visiting others. In other words, not pursuing behaviors and activities that would needlessly expose ourselves and others to this virus. In light of this COVID-19 pandemic, please think about what you’re doing – is it good judgement? Is it expanding my exposure? If it is expanding your exposure, and it is not essential, then don’t do it. Don’t do behaviors that will put your fellow workers at risk upon your return.
