WHEREAS, by Resolution No. 380,2018, the Queensbury Town Board adopted Local
Law 2 of 2018 entitled “Septic Inspection Upon Property Transfer” which is now set forth at
Queensbury Town Code Chapter 137 (Chapter 137) and by Resolution No. 176,2019, adopted
Local Law 5 of 2019 to make a minor modification to Chapter 137, and
WHEREAS, Chapter 137 requires inspection of Onsite Wastewater Treatment Systems
(OWTS) prior to the sale of certain real property, and

WHEREAS, in February 2019, Don Bernard of 20 Brayton LLC (Applicant) purchased
property located at 20 Brayton Road directly on the shore of Lake George with the intention of
demolishing and removing the existing structure and substandard wastewater treatment system,
and delivered a $2,000 escrow deposit to the Town, and
WHEREAS, Chapter 137 provides that such escrow deposit will be forfeited to the Town
in the event that any removal of the structure and substandard wastewater treatment system are not
completed within the time provided as established by Chapter 137, and
WHEREAS, the Applicant was not able to complete the demolition and removal of the
structure and substandard wastewater treatment system within the timeframe provided, and
WHEREAS, by application dated October 1, 2019, Applicant advised that the home on the
property is unoccupied, all utilities are disconnected, the existing septic system has been pumped,
the septic design is completed and a new home design will be submitted within the next few weeks
and therefore, the Applicant requested that the Town Board grant him additional time to remove
the structure and substandard wastewater treatment system and to extend the date on which the
$2,000 escrow deposit shall be automatically forfeited to the Town, and
WHEREAS, by Resolution No.: BOH 41,2019, the Town Board, as the Town’s Local

Board of Health, authorized and granted Applicant such additional time or until April 1, 2020 to
obtain a demolition permit and certificate of compliance from the Town’s Building and Codes
Enforcement Office, and
WHEREAS, by application dated March 31, 2020, Applicant advised that he was
scheduled to appear before the Town’s Zoning Board of Appeals in March concerning revisions
to his plans but due to the COVID-19 Pandemic, the ZBA meeting was postponed with no new
date and therefore, the Applicant has requested that the Town Board grant him an additional time
period of one (1) year to remove the structure and substandard wastewater treatment system and
to extend the date on which the $2,000 escrow deposit shall be automatically forfeited to the Town,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board, as the Town’s Local Board of Health, hereby

PERSONAL LEAVE DUE TO COVID-19 PANDEMIC AND RATIFYING
MEMORANDUM OF AGREEMENT BETWEEN THE TOWN AND THE TOWN’S UNIT
OF THE CIVIL SERVICE EMPLOYEES ASSOCIATION, INC. (CSEA)

WHEREAS, the Town of Queensbury (Town) has entered into an Agreement with the Town
of Queensbury Unit of the Civil Service Employees Association, Inc. (CSEA) regarding employment
of the Town’s CSEA members, and
WHEREAS, by Resolution Nos: 123,2020 and 133,2020, the Town Board authorized
adoption of its COVID-19 Pandemic Response Plan and Revised Plan, and
WHEREAS, as a result of requirements placed on the Town due to the COVID-19 Pandemic,
CSEA employees may not be able to use their personal leave by their respective anniversary dates
and therefore the Town Board wishes to adopt a policy to provide all Town employees with additional
flexibility regarding the use of personal leave, and
WHEREAS, the Town and the CSEA entered into a Memorandum of Agreement and the
Memorandum of Agreement is presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that as a result of requirements placed on the Town due to the COVID-19
Pandemic, the Queensbury Town Board hereby authorizes a modification to the Town’s personal
leave policy to provide all Town employees with additional flexibility regarding the use of personal
leave as follows:
PERSONAL LEAVE. If, because of the duration of the state of emergency and
constraints born by national, state and/or local plans or orders that arose as an
effort to curtail the spread of COVID-19, Town employees are unable to utilize
their personal leave allocations before their respective anniversary due dates,
such employees will be given the option of either adding those unused personal
days to their next anniversary date or receive payment for them at the

employee’s current rate of pay. The employee must notify the Accounting
Department, in writing, as to which option the employee elects one week prior to
the employee’s anniversary date. If an employee fails to make such election, the

WHEREAS, general emergency ambulance services are provided to the Town of Queensbury
by the Bay Ridge Rescue Squad, Inc., North Queensbury Rescue Squad, Inc., and West Glens Falls
Emergency Squad, Inc., (Squads) in accordance with agreements between each Rescue Squad and
the Town, and
WHEREAS, the Town’s agreements with the Squads expired on December 31, 2019, and
WHEREAS, in such Agreements the Town and Squads agreed that the terms and provisions
of the existing agreements may continue during the interim period pending execution of new
agreements which was anticipated to occur sometime during the first several weeks of 2020, and

WHEREAS, by Resolution No.: 23,2020, the Town Board authorized payment vouchers

constituting 1/12 of the respective 2019 Contract Amount(s) for January, February and March to
the Squads under their current respective Agreements, which payments constituted advance payments
on the new general emergency ambulance services 2020 Agreement(s), and
WHEREAS, the Squads may face cash flow shortages before the new agreements can be
executed and therefore the Town Board wishes to again authorize advance payments under the current
Agreements, which if new agreements are entered into will constitute advance payments on the 2020
agreements to the Squads, such advances to be deducted from contract payments to be paid if and
after the 2020 contracts are ratified,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the Town Supervisor to

approve payment of 1/12 of the respective 2019 Contract Amount(s) each month during 2020, if
necessary, for operations and paid staffing to the Bay Ridge Rescue Squad, Inc., North Queensbury
Rescue Squad, Inc., and West Glens Falls Emergency Squad, Inc., (Squads) under the current
Agreements, which payments will constitute advance payments on the new general emergency
ambulance services 2020 Agreement(s) if such agreements are entered into, and

RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and
Town Budget Officer to make the necessary arrangements to make such payments which are

Town to assume liability for the Town’s remaining workers’ compensation claims incurred while it
was participating in the Warren County Self-Insurance Program and authorized engagement of Cool
Risk Management Services (Cool) to provide third party claims management services for the Town’s

managed by the Warren County Self-Insurance Program, and
WHEREAS, Cool has advised the Town that as a result of changes in insurance regulations,
Cool can no longer serve as the Town’s Third Party Administrator (TPA), and
WHEREAS, by Resolution No.: 236,2018, the Town Board authorized renewal of the Town
of Queensbury's Workers’ Compensation Policies with the Public Employer Risk Management
Association, Inc., (PERMA), and
WHEREAS, PERMA has now offered to also serve as the Town’s TPA and administer the
Town’s third party claims through PERMA’s partner Sedgwick, and
WHEREAS, the Town Board therefore wishes to engage the services of PERMA to provide
third party claims management services for these workers’ compensation claims, and
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
the Public Employer Risk Management Association, Inc., (PERMA) to serve as the Town’s Third

known as the Recreation Reserve No. 61 (Fund No. 61) and Capital Reserve No. 64 (Fund No. 64)
for future capital projects, and
WHEREAS, by Resolution No.: 102,2004, the Queensbury Town Board authorized
establishment of the Hovey Pond Park Improvement Project and the Hovey Pond Capital Project
Fund No.: 146, and

WHEREAS, by Resolution 138,2019, the Town Board authorized expenditures for specific
Town Parks and Recreation Department capital improvements and certain maintenance projects
including a Capital Project at Hovey Pond Park (Project), and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and
the requirements set forth in Town’s bid documents and specifications, and
WHEREAS, by Resolution No.: 413,2019, the Town Board authorized and directed the Town
Purchasing Agent to publish an advertisement for bids for the purchase and installation of a Poured-
in-Place (PIP) safety subsurface for the play area for the Hovey Pond Capital Project as described in
bid documents/specifications prepared by the Director and/or Town Purchasing Agent, in the official
newspaper for the Town of Queensbury and/or through the New York State Office of General
Services Procurement Program, and

WHEREAS, the Purchasing Agent published such advertisement for bids and on March 10,
2020, duly received and opened all bids, and
WHEREAS, the Purchasing Agent and the Parks and Recreation Director (Director) have
recommended that the Town Board authorize the bid award to the lowest responsible bidder,
Playsites Plus Surfaces, Inc. (PPS) for a total bid amount not to exceed $91,125, and
WHEREAS, Director has advised that there may be times when Change Orders may
become necessary for such Project and therefore has requested authorization to approve and sign
certain Change Orders up to a five-percent (5%) contingency ($4,500) for Change Orders that he
deems necessary or appropriate, and
WHEREAS, by Memorandum dated December 12, 2019, the Director advised the Town
Board that he anticipated that an approximately $58,000 budget increase for the Poured-in-Place
(PIP) safety subsurface for the play area for the Project would be needed, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Reserves #61 and #64 subject to permissive
referendum,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the
purchase and installation of a Poured-in-Place (PIP) safety subsurface for the play area for the Hovey
Pond Capital Project (Project) from the lowest responsible bidder, Playsites Plus Surfaces, Inc.
(PPS) for a total bid amount not to exceed $91,125, and

RESOLVED, that the Town Board further authorizes the Parks and Recreation Director
to approve and sign Change Orders pertaining to such Project up to a five-percent (5%)
contingency or in the total amount not exceeding $4,500 that he deems necessary or appropriate,

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that payments for such
Project up to the total of $95,625 shall be from the Hovey Pond Capital Construction Account No.:
146-7110-2899, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes:
1. a transfer from Reserve No.: 61 in the amount of $30,000; and
2. a transfer from Reserve No.: 64 in the amount of $28,000;
in additional funds to fund such Project, such respective fund amounts to be placed into the Hovey
Pond Capital Construction Account No.: 146-7110-2899 and the Town Board further directs that in
the event there are funds remaining in such Funds after completion of the Project or in the event that
the Project is not undertaken, the moneys in such Funds shall be returned to the Reserve(s), and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Board Officer
to increase appropriations and estimated revenues, amend the Budget and take all actions as may
be necessary to fund such Projects as authorized, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any needed Agreement between the Town and PPS and/or any other needed documents
related to the bid award and Project in form acceptable to the Town Supervisor, Parks and
Recreation Director, Town Budget Officer and/or Town Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Purchasing Agent, Parks and Recreation Director, Town Budget Officer and/or Town Counsel to
take any and all action necessary to effectuate the terms of this Resolution, and

RESOLVED, that this Resolution is subject to a permissive referendum in accordance with
the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town

her twenty-six (26) probationary period and therefore the Town Clerk has recommended that the

WHEREAS, by Resolution No.: 123,2020, the Town Board authorized adoption of its
COVID-19 Pandemic Response Plan (Plan) and by Resolution No.: 133,2020, authorized and
ratified adoption of the Plan as further revised, and
WHEREAS, by Resolution No.: 385,2019, the Town Board awarded bids for utility
infrastructure/HVAC improvements at Queensbury Town Hall and the Queensbury Activities Center
(Project), and
WHEREAS, this Project includes the replacement of the Town’s outdated, high-
maintenance, poor-efficiency heating, ventilation and air conditioning (HVAC) equipment and
system with a much more reliable and efficient HVAC equipment and system in both its core
buildings, Town Office and Activities Center, and
WHEREAS, the Town of Queensbury’s central office buildings, referred to as Town Office
and Activities Center, are the Town’s core buildings that currently house multiple Town offices
that serve multiple public services, such as, the Town’s Supervisor’s Office, Town Clerk’s Office,
Building & Codes Enforcement, Planning & Zoning Enforcement, Fire Marshall’s Office, IT
servers, Assessor’s Office, Building & Grounds Office, storage place for equipment, records,
documents and archives, and
WHEREAS, any interruption in the Town’s ability to establish and control certain
environmental conditions regulated by the HVAC systems in its core buildings, might jeopardize
the welfare of its employees, IT system, records, archives, and other documents, and
WHEREAS, in accordance with Governor Cuomo’s Guidance on Essential Services Under
the New York State on PAUSE Executive Order 202.6, effective March 22, an “Essential
Business,” means: #9. Construction, including, among others, for essential infrastructure or for
emergency repair and safety proposes, and
WHEREAS, in accordance with Governor Cuomo’s Guidance on Essential Services Under
the New York State on PAUSE Executive Order 202.6, effective March 22, an “Essential
Business,” means: #11. Essential Services Necessary to Maintain the Safety, Sanitation and

and directives for maintaining a clean and safe work environment as issued by the Department of
Health, the Centers for Disease Control, and relevant others, which includes, among other
safeguards, a strong urge to maintain social distance to the extent possible,

WHEREAS, by Resolution No.: 123,2020, the Town Board authorized adoption of its
COVID-19 Pandemic Response Plan (Plan) and by Resolution No.: 133,2020, authorized and
ratified adoption of the Plan as further revised, and
WHEREAS, by Resolution No.: 414,2019, the Town Board awarded bids for construction of
the new Town Highway Garage Capital Construction Project (Project), and
WHEREAS, the Project, already under construction, will provide protection and safe haven
for multiple millions of dollars of highway vehicles and equipment, and provide a facility for
continuance of maintenance necessary to assure safe operations and public safety, and
WHEREAS, the Project is already under construction and any further delay will jeopardize
the Highway Department’s ability to provide for public safety and vehicle and equipment
protections, and
WHEREAS, the Project has necessitated to relocation of its salt and sand piles and those
sand and salt mounds need to be returned to service prior to next season’s snow and ice events and
any further delay might impact the Highway Department’s ability to relocate and access its sand
and salt to provide for safer roads and public safety, and

WHEREAS, Project completion is projected to take a minimum of six (6) months and
further delays might jeopardize the Highway Department’s ability to protect its equipment,
maintain safe road and assure public safety, and

that were providing some of the Highway Department’s equipment protection from the elements,
and
WHEREAS, in accordance with Governor Cuomo’s Guidance on Essential Services Under
the New York State on PAUSE Executive Order 202.6, effective March 22, an “Essential
Business,” means: #2. Essential Infrastructure, Including, among others, public water and
wastewater and transportation infrastructure such as garages, and
WHEREAS, in accordance with Governor Cuomo’s Guidance on Essential Services Under

commercial visibility, and
WHEREAS, road construction is essential and dependent on reliable vehicles and
equipment, and
WHEREAS, the Town of Queensbury and its contractors must provide compliance plans
and demonstrate compliance with New York State’s guidance and directives for maintaining a
clean and safe work environment as issued by the Department of Health, the Centers for Disease
Control, and relevant others, which includes, among other safeguards, a strong urge to maintain
social distance to the extent possible, and
WHEREAS, in summary, to properly address public safety needs, the Town needs a site
prepared to deal with ice and snow events and have its Highway Department site in order prior to
November and this site is designed to provide orderly operations for the Town’s Highway
Department and in order to achieve that, the Town needs completion of a building for truck &
plow storage and the completion of a salt barn and a site organized to accommodate all that and a
sand pile, and therefore, it is imperative that ongoing construction of the above continues - a
minimum six (6) month project - and the current site that has been significantly disrupted (storage
shelters, sand piles, salt shed, etc. have been or will be removed) and so halting this project at this
time would seriously jeopardize public safety,

WHEREAS, the United States is facing a pandemic related to Coronavirus Disease 2019
(COVID-19) and there was a need for the Town of Queensbury to adopt a COVID-19 Pandemic
Response Plan (Plan) to deal with this emergency situation, and
WHEREAS, by Resolution No.: 123,2020, the Town Board authorized adoption of its Plan
and authorized the Town Supervisor to make modifications as he determined necessary as further
information became known, with the Town Board to later have the ability to approve or disapprove
an updated, revised Plan, and
WHEREAS, by Resolution No.: 133,2020, the Town Board authorized and ratified
REGULAR TOWN BOARD MEETING, 04-06-2020, MTG#13 576
adoption of the COVID-19 Pandemic Response Plan (Plan) as further revised, and
WHEREAS, certain modifications have been made since the Plan was adopted and revised
and the Town Board wishes to consider the Plan as further revised and presented at this meeting,

RESOLVED, that the Queensbury Town Board hereby authorizes and ratifies adoption of the
COVID-19 Pandemic Response Plan (Plan) as revised and substantially in the form presented at

Spoke regarding the vacancy of Ward Four Councilperson. We have six letters of
interest. We should set a cutoff date for anyone else who would like to apply.
Recommended setting up schedule and process for this matter.
Spoke regarding short-term rentals and the enforcement of these on websites. There is a
short-term rental draft law being prepared. We are trying to address concerns from
citizens. There will be more to follow. It is our understanding right now that for
Queensbury there is no incentive to try to prevent people from short-term rentals.
Sees tough times ahead for our economy. We will have to be diligent in moving that
forward.
Encouraged people to follow the new rules. When in public wear a mask.
COUNCILMAN FERONE (WARD III)
Spoke regarding short-term rentals. Questioned if there should be guidelines in the
policy if the Governor has a State of Emergency again, on whether or not we should
prevent short-term rentals from occurring.
Reminded citizens to fill out the 2020 Census. You can go online and do the 2020
Census. It will help our Town, County our Region.

Spoke regarding daily reports received from Ryan Moore, County Administrator
regarding number of cases of Coronavirus in Warren County.
Greater Glens Falls Transportation Council is suspending operations during COVID-19.
However, if you are aware of any individual requiring critical transport to non-emergency
appointments or essential employment you may call them at (518) 792-1085. Monday -
Friday 8:30 a.m. and 4:30 p.m.
Thanked everyone involved in developing the COVID-19 Response Plan
The Town of Queensbury Parks & Recreation wants to remind people to use social
distancing when using the Town of Queensbury hiking trails during COVID-19. The
athletic courts are used for solo use only.
Dee Park, from Warren County Office of the Aging wanted to announce that this
Thursday, Friday, Saturday the Office for Aging Staff were able to prepare and package
and freeze 4,200 frozen meals. They just received 300 more for a grand total 4,500.
Thanks to the generosity of Scotty’s Restaurant, Adirondack Pub and Brewery and
Moose Tooth Grill in Lake George, we have extra capacity to store these meals. There is
enough meals for each of our 500 plus clients in Warren and Hamilton Counties in the
event that we need to alter delivery schedule to minimize in person contact during
COVID-19.
Lake George Park Commission Dave Wick has announced that they will be delaying its
mandatory Boat Inspection Program until June 1, 2020.
Spoke regarding COVID-19 Response Plan noted in the plan there is a list of all the
contractors working on the HVAC System.
Schulz verses Queensbury the Town presided in this matter.
Water Superintendent/Wastewater Director, Chris Harrington ask residents not to flush
the flushable wipes throw them away. It will be a disaster for your on-site septic system.
They are a disaster for the pumps in the Municipal System.
Spring yard pickup has been suspended until further notice.
