1968-05-15 310. ',- MINUTES of a public hearing of the Town of Queensbury Zoning Board of Appeals held at the Town Office Building on May 15, 1968 at 7:30 P.M. There were present: James Keller Charles o. Sicard George Kurosaka Allison B. Ellsworth being a quorum of the Board. James Keller acted as chairman in the absence of John E. Fitzgerald and as Secretary, recorded. The minutes of the public hearing held on April 17, 1968 were read by the Secretary and upon motion duly made by Charles o. Sicard, seconded by George Kurosaka, and carried "--" unanimously, were approved. The notice of publication on Application for a Variance #40 by Grossman Distribution Center was read by Mr. Sicard. Mr. Thomas Grossman was present and reviewed the proposal for the Board. He stated that they wanted to build a three sided storage shed within two feet of the line and that there was no other place that they could erect such a shed "here it would not interfere with the traffic on the lot. Attorney Michael J. O'Connor of the firm of McPhillips, Fitzgerald & Meyer was present representing Mr. and Mrs. Mark Doyle. Mr. O'Connor stated that he did not come in opposition but came to question certain factors so that he could '~ better understand and could better report to his clients. 3 '1. Mr. O'Connor asked several questions of Mr. Grossman as to the ~"'- outside appearance of the proposed shed. Mr. Grossman read a portion of a letter that was sent to the Zoning Board regarding the outsi~e appearance of the building. After discussion, upon motion duly made, seconded and carried unanimously, it was RESOLVED, that in view of the fact that there were no objections from the adjoining property owners and that the Delaware and Hudson Railroad stated that they had no objections to the proposed structure, and that the shape of the ~aid:}parcel is such that a practical difficulty exists in using the land as commercial property for which it is zoned be it ORDERED that Application for a Variance #40 by Grossman Distribution Center be approved as requested. After the conclusion of the public hearing, Application for a Variance #41 by William Gardner for the construction of a ,-. dwelling that did not meet the minimum square footage requirements of the Ordinance was presented to the meeting. Considerable discussion was had with Mr. Harley Andrus and his wife and Mrs. VanWagner who are adjoining property owners concerning this application. They stated that they were appearing in objection to this being granted. The Board pointed out that this was not a public hearing and after discussion, upon motion duly made, seconded and carried unanimously, this matter was set for a public hearing on June 19, 1968 at 7:30 P.M. The next order of business was Application for a Variance #38 by Ackely Tire Company for the construction of an ~~ oversized sign. The application for a variance was sent to the 3 g', Planning Board for their review. After discussion, upon motion .~ duly made, seconded and carried unanimously, this matter was set for a public hearing on June 19, 1968 at 7:30 P.M.
