1968-10-23 ~ b. MINUTES of the public hearing of the Town of Queensbury Zoning Board of Appeals held at the Town Office Building on October 23, 1968, at 8:00 P.M. There were present: John Fitzgerald James Keller George Kurosaka Charles Sicard Allison Ellsworth being all the members of the board. John Fitzgerald, the Chairman, presided and James Keller, the Secretary, recorded. The minutes of the public hearing held on October 16, 1968, were read by the Secretary and upon motion duly made by Charles Sicard, seconded by George Kurosaka, carried unanimously were approved with corrections. '-- Application for a Variance #62 by Harold S. Veeder-Shore Colony involving Mr. Veeder's ability to sell non-conforming lots in a sub-division created prior to zoning. Proof of publication of the notice for public hearing was presented. The question of this variance had been submitted to the Town Attorney, who is out of town at this time. Mr. Wayne Judge, representing Mr. Veeder, stated that he received a copy of a telegram set to Mr. John Fitzgerald requesting an adjournment for 30 days by Mr. Adamo. Mr. Adamo stated that he sent the telegram because he and other members of Assembly Point had received no notice of the variance, but tried to assemble as many members as possible to attend the hearing this evening. Mr. Ferguson stated that to the best of his knowledge all people within 500 feet of the property in question had been notified. Mr. Arthur Turnball asked for a clarification of the Variance applied for by Mr. Miller and the Variance applied - 1 - to '1. for by Mr. Veeder, since there seemed to be some confusion as to which Variance was to be presented at this meeting. Mr. Adamo then presented the following letters: by Dorothy S. Black, dated October 19, 1968, in opposition to the Application of Mr. Veeder; Francis, W. McGinley dated October 22, 1968, in opposi- tion to the application; George P. Wasserman dated October 14, 1968 in opposition; Robert C. Hodgkins dated October 20, 1968, also in opposition to this application. Mr. Adamo also submitted a petition with approximately 75 signatures in opposition to this Variance. Also, present were members of the Assembly Point Associa- tion who were in opposition to this Variance, and wished to have their names included in the opposition to the Variance by George Miller, as follows: Lyle Morton, Raymond Komp, Anna Komp, Isabel Elsey, Ruth Fratus, Jessie Weiman, Edith Ham, Guy Ham, Philip '~ Weiman. This Variance was then adjourned until the November 20th meeting of the Zoning Board of Appeals. Application for a Variance #63 by Robert Moran for a swimming pool to be placed in their side yard on the north side of Sunnyside Road, Glens Falls, R3 Zone was then presented. Proof of publication of the notice for public hearing was pre- sented. Mrs. Moran testified that the pool was first constructed on July 1, 1968. She then went on to describe the pool and stated the rear lot is presently used for trailer sales, along with power lines and septic tank located on this site. The Planning Board disapproved this application stating there was not sufficient evidence shown on the Plot Plan. Theee was no one present in op- position to the Variance. After discussion, upon motion duly made, seconded and carried unanimously, it was - 2 - - ~ <6. RESOLVED that due to the existing conditions of the said land, namely the location of the existing septic tank and power line in the rear yard, which tend to deprive the applicant of reasonable use of his land, Applica- tion for a Variance #63 be approved as applied for. Next Application for a Variance #60 by Richard Gratton for a swimming pool in the side yard on Dix Avenue, R4 Zone. Proof of publication of notice for public hearing was presented. Owner was unaware of the permit required when construction began on July 24, 1968. Mr. Gratton stated that a side pool would be no bother to his neighbors. Mr. Gratton presented two letters from neighbors in favor of this application. These letters were signed Mr. John F. Smith and Mr. Discenza, the property owners on either side of Mr. Gratton's property. After discussion duly made, seconded and carried unanimously, it was RESOLVED that Application for a Variance #60 by Richard Gratton being that it is not injurious to the neighborhood or otherwise detremental to the public welfare, be approved as applied for. Application for a Variance #59 by Vernon Burkhardt to locate a garage less than 30 feet from the property line in Cleverdale, New York, was presented. Proof of publication of nòtice for public hearing was presented. Mr. Burkhardt stated that the rock excavation in building this garage would be a problem. After discussion, upon motion duly made, seconded and carried unanimously, it was RESOLVED that due to physical characteristics of the lot and other physical conditions, the strict application of the ordin- ance would cause the owner hardship in the use of the land, Application for a Variance #59 be approved as submitted. - 3 - to Cf. Application for a Variance #61 was presented by Mr. James Minnick, Agent for Mr. John Minogue, Northland Beverages, to build an addition to an existing building closer than 30 feet from the rear property line on Ridge & Bay Roads. Proof of publication of notice for public hearing was presented. The building is set back a great deal from the road because of set back restrictions and R-O-W on Quaker Road. Mr. William Taft, a neighboring landowner, was present in favor of the application and stated that he had no objection being that the swamp land behind said property would have little or no use. After discussion, upon motion duly made, seconded and carried unanimously, it was RESOLVED that since no objection was presented at the public hearing7 and that it is in general harmony with the surrounding area, Applieation for a Variance #61 be approved. J Application for a Variance #64 by Mr. Harry L. Robinson was presented. Proof of publication of notice for public hearing was presented. Mr. Louis Feigenbaum was present for Mr. Rofuinson, who could not attend. The application is for a proposed building to be used as a reta~l store and transfer point for retail goods on Quaker Road and Lafayette Street. The owner of the adjoining property, containing tanks, had no objection. The Planning Board approved this application being it is in harmony with the character of the area. After discussion, upon motion duly made, seconded and carried unanimously, it was RESOLVED that Application for a Variance #64 being it is in harmony with the general character of the area, be approved. New business was then put before the board. - 4 - Application for a Special Permit #6 by Mr. Martin to create a camping ground in an R2 Zone, on the Farmer-to-Market Road. There would be a total of 80 camp trailers. This applica- tion would be submitted to the Planning Board for decision, and public hearing would be set for November 20, 1968. Application for a Variance # 61for Agnes Rosell and Elizabeth La Point to permit them to proceed with plans dating from 1954 to construct motel units over a store and shop block on Main Street, West Glens Falls. This application would be referred to the Planning Board and scheduled for a public hearing. An Application for a Variance # 68by Stephen Lapham, Grant Avenue, to remodel a barn on Glenwood Avenue for the sale of books. The site is in a C3 Zone.
