MINUTES of the public hearing of the Zoning Board of
ApPeals of the Town of Queensbury held on March 17, 1971,
at 7: 35 p.m.

There were present:
John Fit~gerald
Charles Sicard
Gordon Streeter
being the members of the board, excepting Charles Hutton
and George Kurosaka who were absent for this meeting.
On a motion by Charles Sicard, seconded by Gordon
Streeter, the minutes of the previous meeting were approved
as read.
In the matter of public hearings, the chairman, Mr.
Fitzgerald, read the proof of publication for application
for variance #186 by SEWARD FAMILY RESTAURANT FOR A SIGN
LESS THAN THE 50' REQUIRED SET-BACK LINE ON THE PROPERTY
SITUATED AT THE CORNER OF GLENWOOD AVENUE AND BAY. ROAD,
TOWN OF QUEENSBURY.
If the sign is set back 50 feet, as required, the sign
will be inside of the customer Parking lot, creating a
hazard for traffic entering or leaving fhe parking lot.
Also there would be no visibility from the north and limited
visibility from the south for this additional information
required sign.
Mr. Fitzgerald, also acting as secretary, read the
fact into the minutes that the public hearing notices
have been published and the affædavit sent to the newspaPers.

-- The Board studied the plot plan and Mr. Fitzgerald
pointed out the fact that there is an existing sign on the
property. He asked if this change had been submitted to
the Plânning Board. He reported that the County Planning
Board had reviewed the request and suggested a minimum
setback of 12 feet from the R.O.W. because of the possibility
of future construction on the Bay Road.
The Warren County Planning Board recommended the
same r~qmirement for the same reason.
Appearing on behalf of the application was Mr. Robert
Platt for Signs of ~rogress. Mr. Gimeno who manages the
Seward Family Restaurant also aPPeared.
Mr. Platt, "We asked on the sketch to go back 9 ft.
from Bay Road but we will certainly change it to 12 ft.
We set this for 9 feet before we heard from the ~lanning
Board. To put it back 50 feet would place it in the
area where people are driving in and would interfere with
traffic."
Mr. Streeter, "One good thing about the existing sign
is it is in front of the tree and I am always aware of
making the turn......Location of the Present sign does not
interfere with vision to the north on Bay Road....."
Mr. Sicard, "Have you measured the distance between
the tree and the road?"
Mr. Platt, "No."

Mr. Sicard, "Have you considered backing it uP to the
tree?"
Mr. Platt, "No. If we build a planter around it,
People will seethe planter first.....The tree is not going
to be there much longer."
Mr. LiaPes, "The highway suPerintendent met with the
Planning Board and because of possible property acquision,
suggested 12 feet instead of 9.
It would be approximately
25feet from the center of the line."
Mr. Platt, "The sign is at least 5 feet high."
Mr. Fitzgerald, "Is the size conforming?"
Mr. Platt, "Yes, with interior illumination. We would
keeP it simple."
Mr~ Fitzgeràld, "That is why I asked if it will be a
conforming sign so that there will be a limit to the ad-
vertising."
Mr. Sicard, "Do you plan on extending the Parking lot?"
Mr. Gimeno, "Yes."
There were no objections and no other questions or
appearances.
The Board:
RESOLVED: Application for variance #186 py Seward
Family Restaurant is approved according to the plan
presented predicated on the grounds that it is within
the reasonable use of the land and is the minimum
variance to accomplish this purpose. As applied for,
sign will not be less than a minimum of 12 feet from
the Present Bay Road R.O.W.
There being no other business to come before the
meeting, on a motion made by Mr. Sicard, seconded by Mr.
Streeter, the meeting was adjourned.
