MINUTES of the public hearing of the Zoning Board of Appeals
held on September 19, 1973 at 7:32 p.m.

There were present:
John Fitzgerald, Chairman
Charles Sicard
George Kurosaka
Richard Sanderspree
being the members of the Board, excepting Charles Hutton, Secretary,
who was absent for this meeting. On a motion by Mr. Sicard, seconded
by Mr. Sanderspree, the minutes of the August meeting were approved
as read.
In the first matter of old business, William H. Taft, #297,
Mr. Fitzgerald announced that the application had been withdrawn.
Because of Mr. Fitzgerald's absence at the August meeting, Mr.
Kurosaka's disqualification (interest in Cale Development), and
Mr. Hutton's absence at this meeting, a quorum was not present for
any action to be taken on variance #320, Cale, Glens Falls, Inc.
A special meeting will be held at a later date.
In the first matter of new business because there were no
appearances for Lawrence and Margaret L. Waite, the hearing for
application for variance #321 was held over until later in the
meeting.
Hr. Fitzgerald then established proof of publication for appli-
cation for Special Permit #45, GOODWIN, SIMS AND I~RVEY TO PLACE A
PRIVATE YACHT CLUB ON THE PROPERTY SITUATED AT SEELYE ROAD, and
advised that this would be postponed until the next meeting until
the Planning Board (at their request) could accumulate more detail
before making a recommendation. ~œ. Kurosaka disqualified himself
as having a conflict of interest in the application. Dr. Michalka,

l~ who owns the land, is Mr. Kurosaka' s client.

Mr. Fitzgerald permitted people appearing that night to voice
their objections to the application. They were:
Linda Brown, Mrs. John Paul Brown and Clifford Witham. It was
decided that ~w. Liapes would re-advertise the notice and all interested
people would be notified for the next hearing. The Planning Board
was concerned for traffic hazard on Seelye Road, adequate sewage
facilities, and another marina in that area of the lake.
Proof of publication was established for application for
variance #322 JOHN R. GIRARD/GEORGE LA MORA TO CONVERT AN EXISTING
BUILDING FOR LIGHT INDUSTRIAL USE ON THE PROPERTY SITUATED AT CORINTH
ROAD, R D #2t TOWN OF QUEENSBURY.
Appearing on his own behalf was John Girard who explained to the
Board that the building already exists. He submitted photographs for
the Board to study. He advised that there would be no non-conforming
signs and that it was not a noisy business.
Warren County and Queensbury Planning Boards both approved the
request. There were no other appearances.
Upon motion duly made by Mr. Sicard, seconded by Mr. Fitzgerald,
and carried unanimously, it was resolved that the Board finds that
approval of variance #322 would not be detrimental to the neighborhood
and not harmful to the public welfare and be it further resolved that
application for variance #322 be approved.
Mr. Paul Cushing requested delay of hearing variance #323,
Mooring Post ~1arina until attorney Mannix could be present.
Proof of publication was then established for application #324,
STEPHEN T. POWERS TO PLACE A DWELLING IN AN M-I ZONE ON THE
PROPERTY SITUATED AT COUNTY LINE ROAD, TOWN OF QUEENSBURY.
Mr. Powers, appearing on his own behalf, explained the matter
to the Board and said he wanted to improve the looks of the land.
There were no other appearances. Both Planning Boards approved the
request.

Upon motion duly made by Mr. Sanèerspree, seconded by Mr. Sicard,
and carried unanimously, it was resolved that the Boards finds that
approval of application for a variance #324 would not be detrimental
to the neighborhood and is a reasonable use of the land, and be it
further resolved application for variance #324 be approved.
Proof of publication was then read by Chairman Fitzgerald for
application for variance #321 MARGARET AND LAWRENCE WAITE TO CONVERT
AN EXISTING STRUCTURE INTO A ONE-FAMILY DWELLING ON ADJOINING PROPERTY
WITH AN EXISTING DWELLING AND RETAIL STORE ON THE PROPERTY SITUATED
AT COUNTY LINE ROAD, TOWN OF QUEENSBURY.
When Mr. Kurosaka asked if this was a separate lot, Mr.
Liapes advised that it is all together presently. Appearing on
behalf of the application was Mrs. Waite who explained the plan to
the Board and told them there was question as to the need for a
variance. Mr. Fitzgerald advised that the Waites should be 100%
sure before making any improvements. Appearing for information was
Kay Watters. There were no other appearances. Both Planning Boards
approved the application.
Upon motion duly made by Mr. Kurosaka, seconded by Mr. Sanderspree,
and carried unanimously it was resolved that the Board finds that
approval of application for variance #321 would not be detrimental
to the neighborhood and in conformance with the Town and County Planning
Boards' recommendation and be it further resolved that application for
variance #321, Margaret and Lawrence Waite be approved.
In the final matter of business, Mr. Fitzgerald read proof of
publication for application for variance #323, MOORING POST MARINA,
INC. TO ENLARGE A NON-CONFORMING USE IN AN R-l ZONE ON THE PROPERTY
SITUATED AT CLEVERDALE, TOWN OF QUEENSBURY.
Appearing on behalf of the application were Paul Cushing, John
Mannix, Esq., and Mr. and Mrs. A. Poland. Messrs. Cushing and Mannix

explained the plans to the Board (demolishing some existing buildings
and replacing with new ones, moving other buildings, etc.) ~~.
Sicard asked about type of construction and Mr. Fitzgerald asked for
pictures.
Mr. Cushing presented a drawing for the Board and the assemblage
to review. Joan Robertson, Cleverdale, appeared and asked several
questions pertaining to setback, parking facilities, lighting, etc.
Mr. Albert Poland advised that they (the owners) did not want anything
the neighborhood did not want and assured everyone that it would con-
tinue to be run in the same manner as presently.
Mr. Fitzgerald advised that referral would be made to the Town
Attorney for an interpretation as to whether the land is one parcel
or 3 lots.
Other appearances were by Judy Wetherbee, Clifford Witham, and
Elliot Lawton. The Queensbury Planning Board approved the request.
Mr. Fitzgerald had a phone message from John A. Dale objecting stren-
uously.
Upon motion duly made by Mr. Fitzgerald, seconded by Mr. Sicard
and carried unanimously it was resolved that approval of application
for variance #323, Mooring Post Marina be granted providing any
necessary approvals of the Adirondack Park Agency and all other
agencies be obtained and that approval of the Town Attorney for
50% expansion of an existing non-conforming use be granted. Be it
further resolved the Board finds that granting of the application
would permit a reasonable use of the land and is conforming with the
recommendation of the Planning Board.
There being no further business to come before the Board, the
