1974-02-20 ;¡ :)ð MINUTES OF the public hearing of the Zoing Board of Appeals held on February 20, 1974 at 7:30 P.M. There were present: Jack Fitzgerald - Chairman Charles Hutton - Secretary Charles Sicard Richard Sanderspree being the members of the Board. On a motion by Mr. Sicard, sec- onded by Mr. Sanderspree, the minutes of the January meeting were approved as read. OLD BUSINESS - None NEW BUSINESS - Variance #342 - Jay Wassel - to pl&ce a mixed occupancy building (Commerical and Residential) with a 20' front setback in lieu of the required 50' on the property situated at East Side of Route 9. Zoned C-3. Jay Wassel was present, being the owner. This building is called the Old West Trading Post with the Tepee being next door. The upper story of the building to be constructed would be made into an apart- ment, where someone would live to watch the business which has been burglarized several times. It is to be a giftware and leather goods store. Mr. Wassel was told not to proceed with the building by the building inspector. The footings were already in. When Mr. Wassel applied for a building permit in Lake George, he was told the pro- perty was in the Town of Queensbury. Mr. Wassel was questioned by Mr. Sicard regarding sewage. Mr. Wassel went to the Department of ---- Health and everything was satisfactory and a perculation test was made. c}5/ -2- The Queensbury Planniqg Committee approved the application. The Warren County Planning Board approved in concurrance with the Town of Queensbury Planning Board. No other persons appeared for or against this application. Jack Fitzgerald made a motion that this application be approved. Dick Sanderspree seconded the motion and was passed. Variance #343 - Walter Loetterle (John Mason) Rockhurst Road (Zoned R-l) to place an addition 23' front setback in lieu of the re- quired 30' on the property situated at Rockhurst Road. John Mason (Son of Alger Mason, who is contracting to do the above work) was present. Mr. Mason said they were asking for an additional 7' because if it was 30' back like it should be, it would be too near the lake and there would be 8' of exposed foundation showing from the lake which he didn't want to do. Mr. Loetterle said neither neighbors were in objection. George Liapes said several neighbors had called him wanting to know what the variance was all about but noone had any objections. Questions regarding the obstruction of view was discussed. There was also a question regarding the spilling of gas and oil which might run into the house from the garage as there would be a step down. The new addition would be a garage attached to the house with a bedroom over it. If the garage is higher than the house, there might be a problem with gas and oil running into the house. Mr. Mason said as long as there was a drain and the floor was slopped the opposite way .~ from the house - there would be no problem. William B. Hall and Mrs. Hall appeared. who lives beyond the property in question. Mr. Hall is a neighbor He wanted to know how far -3- :( S' ;¿ out the new addition would cane and how much it would obstruct his': - '--- view. He also stated that this road was getting cluttered with gar- ages. Mr. Fitzgerald (Talking to Mr. Mason) "You keep saying something about 8' of wall not looking good but you could make it look good with bricks or other things." Mr. Mason - "Yes, I could, but it would be terribly expensive." Mr. Hall said this would set out farther than any house on the road but said he would go along with this variance and would remove his vocal objections. Mr. Sicard made a motion that this variance be approved in as much as it would apparently not be any closer to the road than any other house and should be in agreement with the Adirondack Park Authority.
