240.92 RESOLUTION AMENDING ZONING ORDINANCE TO CHANGE THE DESIGNATION OF PROPERTY OWNED BY F. T. & E. P. COLLINS, DONALD SMITH & STANISLAW KOSTEK (TAX MAP NOS. 105-1-10, 105-1-11 & 105-1-12, 105-1-7, 105-1-8, 105-1-9, 105-1-4.22 & 105-1-14) FROM LIGHT INDUSTRIAL - 1 ACRE TO HIGHWAY COMMERCIAL - 1 ACRE RESOLUTION NO. 240, 92 , Introduced by Mr. Nick Caimano who moved for it's adoption, seconded by Mr. Michel Brandt. WHEREAS, F. T. & E. P. Collins petitioned the Town Board of the Town of Queensbury for a zoning change of their property, bearing Town of Queensbury Tax Map Nos. 105-1-10, 105-1-11 and 105-1-12, from LI-1A (Light Industrial - 1 Acre) to HC-1A (Highway Commercial - 1 Acre), and WHEREAS, on March 24, l992, the Town of Queensbury Planning Board recommended approval of the petition and recommended that property owned by Donald Smith and Stanislaw Kostek, bearing Tax Map Nos. 105-1-7, 105-1-8, 105-1-9, 105-1-4.22 and 105-1-14 also be rezoned if the owners consented, and WHEREAS, the Warren County Planning Board also recommended approval of said petition, and WHEREAS, a public hearing, after due notice of the proposed rezoning of all aforesaid properties, was held on this matter on April 27, l992, and WHEREAS, the Town Board of the Town of Queensbury has made a determination that the rezoning will have no significant environmental impact, and WHEREAS, the Town Board of the Town of Queensbury has considered the conditions and circumstances of the areas to be rezoned, NOW, THEREFORE, BE IT RESOLVED, that the Town of Queensbury Zoning Ordinance is hereby amended to re-zone the property owned by F. T. & E. P. Collins, Donald Smith and Stanislaw Kostek, Town of Queensbury Tax Map No. 105-1-10, 105-1-11, 105-1-12, 105-1-7, 105-1-8, 105-1-9, 105-1-4.22 and 105-1-14, to HC-1A (Highway Commercial - 1 Acre), thereby authorizing all uses permitted under Section 179-23 of the Town of Queensbury Zoning Ordinance, as set forth in the Code of the Town of Queensbury, except that this rezoning is conditioned on the use of the property being limited such that it will not include, parking garages, gasoline stations, drive-in theaters, golf driving range, miniature golf, outdoor recreational facilities operated for profit, hospital, nursing home, health related facilities, farm and construction equipment sales and services, mobile home sales or veterinary clinic, the intention of the Board being to eliminate from permissible uses, those uses that the Planning Board has recommended be eliminated and the rezoning is further conditioned on the Planning Board, keeping curb cuts to a minimum, and BE IT FURTHER RESOLVED, that the zoning map for the Town of Queensbury is hereby amended to provide for the rezoning of said lands, and the Town Clerk is authorized to arrange with the Town Surveyor to update the official Town Zoning Map to reflect this change, and BE IT FURTHER RESOLVED, that pursuant to the requirements of Article ll of the Town of Queensbury Zoning Ordinance and Section 265 of the Town Law, the Town Clerk shall, within five (5) days, direct that a certified copy of said changes be published in the Glens Falls Post-Star and obtain an Affidavit of Publication, and BE IT FURTHER RESOLVED, that this amendment take effect ten (l0) days after said publication.
