RESOLUTION REQUESTING ENACTMENT OF A SPECIAL LAW
BY THE STATE LEGISLATURE
RESOLUTION NO. 289, 92
, Introduced by Mr. Nick Caimano who moved
for it's adoption, seconded by Mrs. Susan Goetz.
WHEREAS, pursuant to Article 9 of the Constitution of the
State of New York, the Town of Queensbury may request the enactment
of special legislation, and
WHEREAS, the Town Board of the Town of Queensbury is
specifically desirous of requesting enactment of a bill by the
title of "An Act to Authorize the Establishment of a Public Library
District for the Town of Moreau, in the County of Saratoga, the
City of Glens Falls, in the County of Warren, and the Town of
Queensbury, in the County of Warren", and
WHEREAS, it is determined that a necessity exists for the
enactment of such legislation and that the facts establishing the
necessity are that the Town Board, as the local government, does
not have the power to enact such legislation by Local Law, and
WHEREAS, a Municipal Home Rule Request Form must be completed
and the same has been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury, on
behalf of the Town of Queensbury, hereby, pursuant to Article 9 of
the Constitution of the State of New York, requests the enactment
of Senate Bill No. 7542, entitled "An Act to Authorize the
Establishment of a Public Library District for the Town of Moreau,
in the County of Saratoga, the City of Glens Falls, in the County
of Warren, and the Town of Queensbury, in the County of Warren, and
BE IT FURTHER
RESOLVED, that the Town Board of the Town of Queensbury hereby
declares that a necessity exists for the enactment of such
legislation and that the facts establishing such necessity are that
the local government does not have power to enact such legislation
by Local Law, and
BE IT FURTHER
RESOLVED, that the Town Supervisor and Town Clerk of the Town
of Queensbury are hereby authorized to complete the Municipal Home
Rule Request Form, which has been presented at this meeting, in a
manner consistent with the terms and provisions of this Resolution
and consistent with the vote taken thereon.
