1974-10-16 ;¿ ,/3 The official meeting of the QUEENSBURY ZONING BOARD OF APPEALS held October 16, 1974 at 7:34 P.M. There \Vere present: Jack Fitzgerald "- George Kurosaka Charles Sicard being rœmbers of the board. Charles T. Hutton and Richard Sanderspree \Vere absent. The minutes of the September meeting \Vere read and approved. OID BUSINESS Variance #373, Thomas Sprague, Quaker Road - M-l Zone. Mr. Fitzgerald said we v.ould hold acting on this 'W'ltil saœone could find out if Dick Sanderspree v.ould be coming in late. Mr. Fitzgerald read a letter from the League of Waren Voters asking that the Queensbury zoning Board of Appeals be broadened because of rœmbers on board being absent or disqualifjing themselves. NEW BUSINESS Variance #370, Pete Mosher's Used Cards, Luzerne Road and Western Avenue R-4 zone. Ronald Newell was present on behalf of Mr. Mosher. This is a request to place a 24' x 30' building in an R-4 Zone to enlarg§ a non-confo:rming use. Mr. Albert Worth of 5 Luzerne Rœ.d wanted to know what this building would be used for and Mr. Newell stated it v.ould be used for storage. Mr. Worth further stated that the old bus that is on the property is an eye sore and Mr. Newell said that this bus v.ould be rem:>ved when the building is built and would house all of the parts that are presently stored in the old bus. Mr. Sicard questioned the parking problem and Mr. Newell said that there is parking facilities in front of the building which is off the road. Mr. Fitzgerald asked Mr. Worth if he thought a building v,ould look better than the old bus being there and Mr. Worth agreed it v.ould, as long as everything is '- kept in the building and not on the outside. Mr. Sicard made a IIDtion that Variance #370 be approved subject to the following condi tions: -- -_.....:~"--,'->._- ") 0 CfJ~ / / -2- '- 1 - The existing storage bus be rem::>ved from the property entirely. 2 - All used parts be kept in this new building. 3 - That SOIœ provision of parking of cars be made so they will not be parked on the street. This rrotion was seconded by George Kurosaka. Both planning boards approved with the condition that the bus be rem.:>ved. Mr. Howard Krantz, attorney from Rheenrand Krantz asked if the Zoning Board could neet one week fran tonight to hold a special neeting on Variance #373, Thooas Sprague because of the absence of Mr. Hutton and Mr. Sanderspree. Mr. Fitzgerald asked the people to call the Town Office to find out for sure which date and what tirœ. Mr. John Leræry asked if Variance #378, George Boychuck could be held at this special rœeting also. Mr. Fitzgerald stated that he regreted the inconvenience caused tonight and both of these matters were be held over until the special neeting. Variance #375, Bruce R. Wiederspiel, Route 9 Miller Hill, C-3 and R-4 Zone. Mr. John R. Milanese appeared on behalf of Pizza Hut. Mr. Milanese stated that property would be joined on Route 9 with a Long John Silver Restaurant. The entire parcel is zoned C-3. The front of the parcel is currently zoned C-3 and the rear thereof R-4. Mr. Milanese further stated there would be a 50' buffer between the residential and comœrcial properties, and had talked with Mr. Nornan À1-PfoJ,.\A<.JS Bodenweiser, wOO owns the Alphanas Motel and assured Mr. Bodenwèiser that the covanant to retain the trees would not be broken. Mr. Bradley Patch owner of property that would border the Pizza Hut asked what would happen with the garbage and Mr. Milanes~ said the building would contain a 5' enclosurec'at the rear of the building and said they would mt accumulate that ItUlch garbage. " '- A lengthy,off the record discussion followed as an informational rœeting for the neighbors and those interested in this variance at which tiIœ Mr. Milanese tried to answer questions they had. 300 -3- '",-- Å,.Pf-rJfMJ 5 Mr. Bodenweiser of the Älphan:LUo Motel on Route 9 said he had attended two other meetings and it was agreed that the trees are not to be touched on the property for the buffer zone. Mr. Daniel Olson, 29 Carlton Drive questioned the developer about the required 50 foot buffer zone by the residential rorders, the possible raroval of tress, and a fence separating the restaurant from the residential area. He asked that the natural trees be left as they are and that a 6' fence would be advisable. Bradley Patch, 4 Carlton Drive said he was against the restaurant be- cause it would decrease his property value. Mr. Al Hedger who owns property directly in back of this proposed bus- iness asked about garbage, rodent control, parking, lights, fish and pizza srælls and the establishrœnts I hours. Said he wouldn't object if a fence was put up and the areas was kept clean. Mrs. Jackie Belenger went on record as saying she wanted the trees left as they are and a fence erected. On a notion made by Jack Fitzgerald secorrled by George Kurosaka, The Board: RESOLVED; Variance #375, Bruce R. Wiederspiel, Route 9 Miller Hill, C-3 and R-4 Zone be approved providing the following stip- ihlations : 1. Final grading is approved by the Town Engineer. 2. There be a 50' buffer which would maintain the natural tree zone now existing and that a six foot, chain link fence also be included, subject to requirerœnts by the Health Department. 3. That all signs on the property be conforming and are to be turned off when the property is not in use. 4. That this variance is only applicable as long as the property is used for this operation being a Pizza Hut and Long John Silver. '-...- 3Dj -4- Variance #376, Christopher A. Rivett, West M::>untain Road R-3 Zone. .,,- To operate a beauty shop in the basement of his home. The only thing that was questioned was that of an Exit door out of the basement of his hare. This was inspected by the building inspector and was found to be safe. On a m:>tion by George Kurosaka seconded by Jack Fitzgerald The Board: RESOLVED: Application for Variance #376, Christopher A. Rivett, be approved as a hare occupation. Both Town and County Planning Boards also approved. Vatiance #377, First National Bank of Glens Falls, Quaker Road C-2 Zone. To connect the existing Queensbury Office leased from Bernard Birn- baum of the Queensbury Shopping Plaza with a new structure owned by the First National Bank of Glens Falls. This would be a 20' setback from adjoining pro- perty line. Messrs. Clark, Hayes and Gregory of the First National Bank were present. Mr. Clark said they are trying to db soræthing about the traffic problem which now exists and to expand their facility. On a motion by Charles Sicard, seconded by George Kurosaka The Board: RESOLVED: Variance #377, First National Bank of Glens Falls be appro- ved as it confonns with ooth planning boards and subject to the beau- tification cœmittee for landscaping. Special Permit #52, Glens Falls Country Club, Inc. COillltry Club Road, R-3 Zone. Mr. Paul Cushing appeared on behalf of the Glens Falls Country Club. He stated they propose a building 40' x 80' pre-engineered steel to be used as a maintenance building for the golf course equiµnent, together with certain errployee spaces. The special use involved is a maintenance _. ' building in an R-3 zone. Mr. Cushing stated that the old building which now stands will also be retained. Mr. Sicard discussed the possibility of a traffic problem with 3o~ -5..... tractors pulling out on to the road on short notice.. '- Mr. Boynton wanted to know if they kept their golf carts in this building and Mr. CUshing said they did but they will not be kept in the new building. Mr. Sicard questioned the possibility of putting this building soræwhere else because of the beautiful piece of land this is and thought this might ruin the landscaping of the land. Mr. CUshing stated if they put the building soræwhere else that the oper- ation WJUld be split, and that this building would be centrally located to get to the/· greens, etc. Mr. Fitzgerald questioned whether the old building would be painted and Mr. CUshing assured him it would be. On a motion by George Kurosaka seconded by Jack Fitzgerald The Board: RESOLVED: Special Permit #52, Glens Falls Country Club, Inc.
