RESOLUTION AUTHORIZING SUPERVISOR TO SIGN
CORRECTION DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS
RESOLUTION NO. 431, 92

WHEREAS, the Town Board of the Town of Queensbury previously
rezoned a parcel of land in the Town of Queensbury located near or
adjacent to Corinth Road, and bearing Zoning Map Book No.
148-1-7.1, and
WHEREAS, as part of the zoning, a Declaration of Covenants,
Conditions and Restrictions was required to be filed and same were,
in fact, filed and previously corrected during l990, and
WHEREAS, the Town Board has been advised that the Corrected
Declaration of Covenants, Conditions and Restrictions contains an
error in that the Tax Map Numbers referred to as rezoned
erroneously refer to 148-1-7.2 when, in reality, the same should
refer to 148-1-7.3, and
WHEREAS, the Town Attorney has advised that this modification
to the Correction of Declaration of Covenants, Conditions and
Restrictions is for purposes of correcting the same to make it
consistent with what the intent of the parties and resolutions
were,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury hereby
approves of the revised Correction Declaration of Covenants,
Conditions and Restrictions presented at this meeting, and hereby
further determines that, under the circumstances, a public hearing
is not necessary, and
BE IT FURTHER
RESOLVED, that the Town Supervisor is hereby authorized and
directed to execute the revised Correction Declaration of
Covenants, Conditions and Restrictions on behalf of the Town of
Queensbury and to place the seal of the Town of Queensbury on said
document, if necessary, and to complete, execute and place the seal
on any other documents that may be necessary in order to file the
revised Correction Declaration of Covenants, Conditions and
Restrictions.
