MINUTES of the public hearing of the Zoning Board of
Appeals held an February 19, 1975 at 7: 37 P.M.
Due to the fact that the Warren County Planning Board
was meeting at the sane time, results of their meeting were
not received and saœ of the following applications had to
be tabled.
There were present:
John Fitzgerald, Chairman
Charles Hutton, Secretary
Richard Sand.erspree
George Kurosaka
being the nanbers of the Board. On a rrotion by Googe Kuro-
saka seconded by Mr. Sand.erspree, the minutes of the January
rœeting were approved as read.
Old Business:
Variance #387 - Duke Concrete Products, Inc., west
side Bay Road - Zoned M-2. Further details regarding this
in the minutes of the January rœeting.
Mr. Roger ~ th, Manager of Duke Concrete Products was
requested to reapply to the Town of Queensbu:ry Planning Board
for this Variance which was approved.
George Kurosaka made a notion that Variance #387, Duke
Concrete Products be approved in conformance with the Town
Planning Board. 4 votes approved.
New Business:
Variance #388 - William E. Threw, Luzerne Road, Zoned
R-3 - to enlarge a non-conforming use on the property situated
on Luzerne Road.
William Threw was present and stated he has operated a
swimningc'Pool business for three years at the a1::x:>ve location.

Mr. Thre1f.7 stated that he wanted to enlarge so his equip-

rœnt could be under cover.
There were no appearances for or against.
The TcMn of Queensbury approved with no ccmœnts.
George Kurosaka made a notion that Variance #388, Will-
iam Threw be approved. This rootion was seconded by Charles
Hutton. UnanirrDus .
Variance #389 - Robert Eldred, Zoned R-4 - to use an
existing building as a retail store in an R-4 zone on the pro-
perty situated at Richardson Street.
Mr. Edward Fane was present as attorney for Mr. Eldred.
Mr. Fane stated this 'WOuld be a 28' x 50' building used as a
retail store. Mr. Eldred presently operates a Pet Store.

Mr. Leslie Hillis, who owns property north of this build-

ing was against this application as he has two residential build-
ings nearby and the tenant Mr. Kevin Maxim (also present) was
willing to purchase this property until he heard of this appli-
cation. Mr. Maxim lives in an apart:rœnt over a garage and
said if this business was opened, there 'WOuld be traffic fran
Newcanb Street and he would not want to buy this property.
Mr. Robert Eldred was also present and stated this store
'WOuld be for wearing apparell and gifts. After discussion be-
tween all concerned, an agreement was reached which was included
in the following notion.
The Town of QueensWry Planning board approved.

George Kurosaka made a notion that Variance #389,
Robert Eldred be approved provided there is a fence errected
at the West end of the building to block through traffic,
that this be approved with the stipulation that owner re-
apply after one year to give time to reevaluate the situation.
This was seconded by Mr. Fitzgerald.
Mr. Fitzgerald arœnded the above motion to add that
the establisl1rœ!nt oot be opened nore than 10: 00 P.M. each
evening.
Unaninous.
Variance #392 - Kathleen Chesney, Corner Peggy Ann Road
and Braydon Avenue. Zoned R-3 - to place an addition on an
existing garage less than the required 30 ft. setback on the
property situated at the Corner of Peggy Ann Road and Braydon
Avenue .
Mr. Dennis McCue (One is going to build the addition if
approved) was present"
There were no appearances for or against.
Mr. Hutton made a motion that Variance #392, Kathleen
Chesney be approved in conforrtance with the Town of Queens-
bury Planning Board. The motion was seconded by Dick Sander-

Special Pennit #55 - Harry Stewart, West ~untain Road,
Zoned R-2 and R-3. - to extract stone, sand and gravel in an
R-2 and R-3 Zone, on the property situated at west side of
West M:>untain Road.
Mr. Harry Stewart and Mr. William Threw were present.
Mr. Stewart (OWner) stated that Mr. Threw 'WOuld be extracting

the sand and gravel to use.
Mr. John VanDusen, neighbor had no objection.
A letter from Michael Woodbury was read by Mr. Hutton
who was in strong objection.
The Town of Oueensbury Planning Board approved with the
provision that it 'WOuld not create a water pocket.
This application had to be held pending the outcone of
the Warren County Planning Board.
Variance #390 - IDng John Silver, Upper Glen Street
Zon ed C-3 and R-4 - to place a sign less than the required
setback on the property situated at Upper Glen Street.
Variance #391, Pizza Hut, Upper GLen Street, - to
place an oversize sign less than the required setback on the
property situated at Upper Glen Street.
Mr. Robert Platt of Signs of Progress represented IDng
John Silver and Pizza Hut.
George Kurosaka disqualified himself.
Mr. Bodenwiser of the Alpenhaus Þbtel had no objection.
Mr. Fitzgerald asked for the minutes of the rœeting
when these applications were approved. Mr. Fitzgerald infor-
:rœd Mr. Platt that these variances were granted on the grounds
that there be no non-conforming signs. Mr. Platt withdrew
the application stating he 'WOuld talk to the owners.
Daniel Olsen, 29 Carlton Drive was in objection of non-
cofnning signs.
Diane Barber frcm the League of Wanen Voters was also
against the non-confonning signs.

Variance #393 - Scott McLaughlin, Route 9L, Zoned R-3
to place a 3 ft. by 7 ft. sign on the face of an existing
building in an R-3 zone on the property situated at Route 9L
1/4 mile from Cleverdale Road.
Mr. M::Laughlin was present and stated he needed the
sign for dealer plates for the State. The sign would not
be oversized. Mr. McLaughlin has operated his business for
25 years.
Mr. Fitzgerald wanted the minutes to shOW' that the
Board is not in violation of the Lake George Park sign re-
gulations .
The Town of Queensbury Planning Board approved.
D. Sanderspree nade a motion that Variance #393, Scott
McLaughlin be approved in conformance with the Town of Queens-
bury planning Board.
This notion was seconded by Charles Hutton. unamim:>us.
The rœeting was adjourned at 9:02 P.M.
